On November 29, 2003 two employees from Bohmann Plumbing arrived to repair a dripping bathtub faucet. They gave me an estimate of $196.00 plus $39 service call to fix the leak. I authorized the repairs.
A few minutes later one employee came to me and said that he tried everything but the handle was seized and he could not remove it to accomplish the repairs. The employee said they would have to replace everything and they would have to cut a hole in the bedroom wall to get to the pipes. He said that would be over $1000 and I would have to get someone to repair the hole made in the bedroom wall.
I said I wasn't ready to agree to that expense and that I would think about it. The employee said that he would still have to charge $39 plus tax for the service call, and I agreed.
Here is the total work this employee did: removed a screw in the handle, tried to remove the handle with a handle puller, banged on the handle with a hammer, then replaced the handle screw.(20 minutes).
On December 15, 2003 I received my credit card statement (MasterCard) and I was billed $248.19 by Bohmann Plumbing. $248.19 would of been the price of the first estimate given me to repair the faucet. I was told by the employee I would be charged only the service charge.
On December 15, 2003 I called Bohmann Plumbing (262-789-8343) and talked to Brian Bohmann to inform him of the overcharge, and he said he could see no overcharge and that he didn't send his men out there for nothing, and that I didn't authorize them to cut a hole in the wall and replace the pipes so they couldn't do the repair. Mr. Bohmann was not very rational and could not see why I should not pay $248.19 for his employee to remove a screw, bang on a handle, and replace the screw. When I told him his employee told me I would only be charged the service fee, he denied the employee would say that.
I feel I should pay the service charge and not the total charge I would have paid if the repairs were done, because they were not done.

No repair was ever made. That is the "whole" issue. I was charged for something that was NOT DONE. The bizarre thing is Mr. Bohmann does not understand how wrong he was by doing this. I've related this story to over one hundred people and they all respond, "They can't do that!"
I reported it to the Better Business Bureau, they never made a determination. My report is on file if anyone investigates Bohmann Plumbing with the BBB before doing business with them.
I reported it to the local TV station who do expose's on fraudulent companies in the Milwaukee area. All the TV station did was send me Mr. Bohmann's response to me.
There was a determination made though. Hat's off to MasterCard. MasterCard investigated the charge, received a response from Mr. Bohmann, in which he attempted to justify charging for work not done. And Lo and Behold Mastercard sided with me, and my account was never charged. I only paid the service charge. MasterCard said, "They can't do that!"
In regard to the consumer response to Mr. Bohmann's rebuttal from Pat in Arizona, no work was done. Even after Mr. Bohmann's rebuttal and all his other responses concerning this, the point is never made clear that the work "was not done." His men could not remove the handle.
I don't know if Mr. Bohmann is a fraud, or just a person with very poor business sense. The bottom line is this. You can't charge for work you did not perform. Or, more simply put, "They can't do that."

Brian,
I am having a hard time deciding who to believe here.
Michael's original post stated that even though he did authorize the repair of the faucet for the agreed upon price of $196 plus $39 for the service call, he says the repairs were not completed because of the seized handle (handle, or valve? I find it hard to believe that the handle itself would not come off). If this is true, he has a legitimate complaint. You should not be charging him for a repair that he authorized if the repair could not be completed.
You stated that the repairs were completed as agreed. If this is in fact true, then you have every right to have billed him.
Was the repair actually completed or not?

Michael Henning called our company for service on a faucet problem in his first floor bathroom. He was told that there would be a $39.00 fee for the service call. He agreed and scheduled an appointment.
Our service tech. examined the faucet and gave Henning 2 proposals. The first was to provide and replace the washers and cartridges at a contract price of $196.00. The second option was to open the wall,then remove & replace the shower and tub mixer at a contract price of $1035.71. Dr. Henning authorized the first proposal and signed that he understood and approved the exact work to be done as well as agreeing to pay for the work upon completion.
When the job was completed Henning authorized payment using a credit card. The work was completed and paid in full on 11-29-03.
On 12-29-03 Henning stopped payment on his credit card. Our company provided the credit card company with copies of the contract and Hennings accout was charged for the work as contracted. Henning also complained to the Better Business Bureau and to a local television consumer advocate. Each of these agencies contacted us and agreed, after examining the situation, that Hennings complaint was unjustified.
