This is regarding a Boost Mobile promised to delivery a free replacement phone for my older cell phone. a Motorola i465. I am on the shrinkage program and had neverly gotten to a fee of $35.00 with only one more $40.00 month payment when the email I received for the fee for the month of December 2012 showed that I now owed $50.00 again leaving off all my on-time payments.

I contacted the customer care number for Boost and was told that my phone would be obsolete soon. The clerk said my fee of $ 40.00 was the right fee since I have always made on-time payments. and I let him charge my account for the $40.00 monthly fee for December and the clerk also offered me a free phone of either a Samsung smart phone, a Blackberry or a simple flip phone to replace my soon to be obsolete cell phone. I told the clerk I wanted the Samsung smart phone and gave the clerk my full address. The customer service clerk than told me I would received this phone in 7 days.

After waiting 7 days for the phone but not receiving it, I again called the Boost service line and go through Boost horrible service line.  I finally was able to speak to another customer service representative who informed me that the phone would arrive in 7 business days. This clerk gave me my claim number and made sure to save it since at this point I am wonder if I will ever receive this phone.

After waiting 7 buisiness days and NOT still not receiving any phone in the mail I called Boost again and this time I was told that it would be 15 business days before I would receive the free phone. I waiting and when the phone still did not arrived within 15 business days I called Boost again only to be told that I would not receive a free phone after all and my shrinkage fee is showing 50.00 again. I asked to talk a supervisor and was transferred to a supervisor who also said that I would not get a phone because the free phone program was discontinued. I told the supervisor that it was fraud to tell someone that they would receive a free phone that then simply not delivery it.  I asked the supervisor how many people were promised a phone that did not receive one? The supervisor did not answer. Supervisor cut my phone bill to $25.00 but I am not happy with the one time $ 10.00 credit.

I would like to find other Boost customers who were promised a phone and never received their phone. How can a company promised free phone and then just not delivery one?
To that is doing business in bad faith with intention of providing what is promised.

I like to find other consumers in this situation and file a class-action lawsuit over this upsetting issue. I am very, very unhappy with Boost Mobile, particularly because I've always pay my bill on time only to find out that the shrinkage fee promise is as fraudlent as is everything else about Boost Mobile promises.
