bordercityaudio.com Sold Fake Samsung Galaxy S3 Detroit, Internet

bordercityaudio.com sold me a fake (clone MTK6575) Samsung Galaxy S3 16GB on November 19th, 2012, received on Nov 27th, paid $420 COD (their requested choice of payment).  I realized it was a fake after a few days of use  and after comparing it to a friend's genuine S3, and notified them on Dec 11th.  I sent them photos of the phone's build code and internal storage. It was the same phone they had sent me pictures of prior to delivery (but they just sent me photos of the phone not powered on).

December 13th, they confirmed via email they would refund me, less any shipping fees via Paypal or cheque.  Dec 15th they notified me that it was their busy time, so they would try to refund me the after Christmas. In the meantime, I was asked to ship back the fake phone which I did on Dec 15th.

Contacted them again Jan 10th, in which they indicated their Paypal was frozen, so they asked if I had interac. I responded 'yes' but did not hear back from them.  

Decided to contact the Better Business Bureau and Samsung (as well as Apple) customer services to see if they were authorized to use their logos as BBB accredited and authorized internet dealers.  The BBB indicated they were not authorized and Samsung and Apple confirmed they were not authorized dealers.  

Jan 29th.  Their website changed in the new year and they now had a 1-877-666-1331 customer support line.  Prior to this, I was corresponding via email with their Kijiji delivery rep in Canada.  I spoke with Michael who said that a cheque may have been mailed out 

Still nothing had been received so o I then contacted Tim at Customer Support (their main support rep) the next day.  Jan 31st was told by Tim that they would send $200 via Paypal and the remaining via cheque but that it would take some time as it would be coming from New York.  Then on Feb 1st, Tim asked whether it would be okay just to send a genuine S3 in exchange which I agreed to.  

Feb 11, Tim indicated that they were waiting for a Blue coloured S3 in their stock. 

FEb 19th, still no S3 in stock

Emailed them again on the 27th but didn't hear back, nor on March 1

Mar 4th:  Tim said they tried sending a cheque but it was not received.  So they said they sent an iPhone5 instead.  

Tried calling them on March 13 to the 19th but never received any answer.  Nor any emails were replied back to.  

March 21st was able to get through again calling from a different line.  They said because they didn't hear back from me (????? - although they actually responded during this time to an alias email I sent to them, the next day, just to see if emails were still getting through), they thought everything was fine. I asked him to provide me with the tracking number which he said he would have to call me back.  I never heard from him again nor have been able to get through to them ever since.  I checked with Canada Post to see if they ever received anything from bordercityaudio which they confirmed nothing had been sent.  

So, I've been out $420 Cdn since November and cannot seem to get a refund or an exchange from this company and they appear to be ignoring my calls/emails.  I have all the email correspondence saved as well as photos of the original phone.
