My mother who is 80 years of age hard of hearing and her health is not that all good. My father who has heart condition was not with her on this day due to the exstreem heat was told by his doctors to let the house. Their vehicle had been in an accident and bee consider a total loss end of May beginning of June 2012. They had finally gotten the pay off check for the total lost of the car. On July 6, 2012 my mother had gone on her own to Brad Benson Mitsubishi/Hyundai to look at what type of vehicles they had. The only reason she had gone there in the first place was the previous vehicle was purchased there a 2008 SanFe. My parents were both pleased with that little SUV and that is how all this took place. When she got on the lot a salesman had approached her she said she was looking told him what had happen with the prior vehicle and that was the reason she was there. Before you knew it he found a care for her a used 2010 Elantra SE with mileage of 36780. My mother did like it but was not sure if she should do anything with out consulting my father or I.

As my stated the next thing she had found herself in the finance manager office. There were two of them in telling my mother about all this and that and the vehicle come with an extended warranty she had replied to them she does not need that then she was told about road hazard and something else that had went with it the two both speaking to her at the same time tag teaming her. Here is an 80 year old Irish woman who is hard of hearing and have two finance managers getting her confused and fluster. The managers had told her she can even have her started during the winter months  if she has any trouble starting it. My ask much would that cost was told in the sum on that would be about $600.00/$650.00. My mother "No Way" she does not have that kind of money. My mother started to get nervous she said her head started to spin and wanted get out of that office. They with all the confusion my mother was going through told her that she needed to sign I guess it was the agreement to purchase of the vehicle. My mother was buying it. There was no financing or leasing involved.

At that my mother did sign granted she did but was not fully a ware what they had accomplished. The Elantra was to have been originally $19,000.00 when all the items were listed the sell of this vehicle became to the amount of $24,000.00. My mother said that was way too much to pay so then what did they do took off $2000.00. The final amount came to $22,200.00 and wanted the payment right there and then. My mother said she does not have it she did not bring her checkbook that it was at her "HOME". Management said no problem we will have the sales person drive the Elantra to your "HOME" and follow her while she drove the rent a car she had been using to get the check. They were so afraid that she would leave Brad Benson dealership and not come back with the check or to purchase the Elantra. They were a fraud of their living lives they would loose a deal and knew they could take advantage of her because of her age number 1- secondly they had daze and confused with their high pressured sales tactics. That was exactly what they did he took the Elantra drove the vehicle to Edison and follow my mom to her apartment. He apartment is a senior citizen apartment and it is secured unable to get in unless you have a key or buzzed in. My mom brought in the sales person in and this is how srued they are made my mother get her check book wright out the check in the amount of $22,200.00 and brought another set of paper work and had my dad sign them. Who even knows what those papers were that my dad had signed. The sales person left now this was all on July 6th. On July 8th I called my mom to check in with her  and my dad because it was the 4th of July weekend I was a way.

While speaking to her she had told me that she had gone to Brad Benson and she got a new car. Now mind you mother was happy because she did this all on her own. I myself is the automobile industry and our company lends the money to the dealers who then lends it to the customer and then the customers pay us back each and every month. I have been doing this over 20 years. I was concerned because I know that the car industry are not selling cars like the use to and how they can be very driven to make a sale regardless. As I was asking her questions said she bought the car for $22200.00 I was taken back a little but then thought it could have been a Sonata told he it was 2010 with the miles of 36780. I ask what make and model she said a Hyundai not sure the make. That is when I really got nerves told her need to know the make and she will need to call me back immeadtly with it.

In 10 minutes my mom called me back and told me it was a Elantra I nearly died i said to my mom how much you pay for it she kept saying for everything $22200.00. I said what! tell me and let me know what is everything, she said everything. Here  am hoping  and praying she has leather seats, GPS navaigation system the works and that was not all that. It was all back end products that those finance managers had my mom to believe that had come with the Elantra it was included with the car. I told my mom not to do anything I hung up the telephone called her bank and put a stop payment on the check for the 22,200.00 that was written to Brad Benson. I called my mother back told her what I had done since  I am POA on her account and over see her finances. My mother was so up set how they took her for the Elantra. Technically that it only worth top dollar and it is the Elantra SE 2010 is $15,600.00 or 15,800.00 tops! Take $22200.00 minus about 800.00 for taxes the prep documentation fee highest $500.00 that then would bring it down to $20,900.00 - 15800.00 = 5100.00 worth of back products they were trying to take or sell to an 80 year old woman. The car is not even worth that amount. My mother was so upset I told her they were taking advantage of her they were trying to swendal the only bit of money that my mom and dad had to their name. They have no savings they live on social security that is all. I tried to do good with the dealership I called Monday first thing in the morning 07/09/12 about 9:00 I had requested to speak to the manager on duty no one else. Call was transfer to a Mr. Jim Grace I told him I needed a copy of everything i detail of what was on the vehicle and what had been sold as a back product to my mother at first he did not want to say said that was between them and their customer. Well his tuned changes when I told him that the stop payment on the check was made and reasoning to why. That I was looking out for the best of my mothers interest and felt she was taken. Till I get the list and figures my money will not take the vehicle. He was nice because he had to be if he wanted to keep the sale.

I spoke to Mr. Grace told him to back everything off cancel everything void out what ever it takes. Then we will start a new and once we feel those figures are justify I do not have a problem to come to Brad Benson with a certified check for the correct amount have no problem that my mother liked the car but there is no way she will be paying $2200.00 for a 2010 ELANTRA just no way. He said that ok will do everything over all my paper work is with finance manager and he was not in and all the draws were closed. Mr. Jim Grave said speak to Eric Phillip and let him know what was agree tomorrow 07/10/2012 he should be in around 1:00 PM and he will leave the message to call me. I waited and waited and it was now 2:00 PM so I had called Mr. Eric Phillip explained what had happen and reason why and the stop payment of the check. Everything been discuss with Mr. Grace and to back off everything and start a new. I must hit a nerve with Mr. Phillips he will cancel the warranty and the insurance company is then to mail back the check for the difference that they can not cancel void or do everything over. Their system will not allow only way is to bring a certified check to the dealership since the check of $22200.00 was cancel and make it for the $22,200.00 I said ok as long as I know my mother is going to get her full amount back for the difference I will do that.

The next day 7/11/12 the more I had thought about it I said no I am not going to bring a certified check for the amount that he wants it for no way I told him. I want everything voided out cancel and backed off when I spoke to Mr. Eric Phillips well I must hit a nerve he started to be rude said he is not backing off nothing and who am I do give them a bad check when it is to be guaranteed that my mother needs to honor it and only way to do this is what he said and then insurance company will refund us the money told him no it will not work that way cancel everything out start from a new and have the insurance company refund them the money that is due till then they can wait but I will not bring in a certified check for $22200.00. Well one thing led to another. Told him that he was taking my mother for granted and who the hell is he to sell products to an elderly woman of 80 years of age who does not need it. I told him he was greedy and the stop payment stays that I am looking out for my mother interest not theirs and told him if not taken care of will take care back to them. He went crazy said you can not do that you are responsable for that vehicle told him no we are not the vehicle is not insured with my mother insurance company and all the paper work has not left their office because it not completley a done deal. From their I had hung up from him was not going to have him speak to me in that way ended call.

On 7/12/12. Mr Eric Phillip now is calling me at my place of business trying to smooth over everything told him same thing again he started to bully me over the telephone told him come get the vehicle it is in the parking lot at my mother residence and keys are under the mat. Mr. Eric Phillips started is ramp page again told him done speaking to him at this time what ever chance of getting this resolved is now done. Too much has happen and the car is in my mom parking lot and Brad Benson or anyone of their sales mens can come and get it. We do not want it. On 07/13/12 Mr. Jim Grace called me this time at my place of business how he got the telephone number not sure. I have been using my own personal cell phone when these calls took place. I was taken off guard when I was the one who answer and he ask for me. Hw was always nice and polite and willing to work things out an again he still was. Remember I had the stop payment done on the check. He could not figure what had taken place on Monday and everything was agree upon and now it is not ask what taken place told Mr. Grace it all changed when I was ask to speak to his finance manager who done the transaction with my mother that what had happen. Did not like telling me who was I to stop payment on the check and I need to do this and need to that and I better do this and better to do this. That is when I said to Mr. Grace too much has happen my mother does not want the car does not want to go to the dealership because she feels she was taken and  trying to dooped her or swindle her out of her money for a car that is not worth what they were asking for. He begged me to please speak to my mon and reconsider ask if I can do that told him too late he needs to take this up with his finance manager he is the one who caused this mess and my mother wants nothing to do with their dealership. Mr Grace said know you are looking out for the best of mom interest that he would probably do the same if it was his mother he said he is trying to work things out and make things right please see if my mother will come to their dealership that he knows they could make good for all what had happen. I said OK I will see what my mom will say. Remember my mom is an 80 year old Irish woman she still has a lot of spunk and pride and no one will take advantage of her.

I called my mom as said I would when I spoke to her and ask if she reconsider and will sit down and do everything over. My mother said like hell she will that the car went back to dealership ask what does she mean. My mom had called a tow truck and had the vehicle picked up on a flat bed and brought back to the dealership with key on 07/13/12 around 3:30-4:00 PM peak time of business. I started to laugh to my self ask her why. My mother said from Monday - Friday she was getting calls three times a day from managers at Brad Benson and they were bullying her and telling her that she needs to replace the check or they will put her in collections and this is a warning if she knows what is best for her. My mother said no one is going to bully her bit my mom health ia not all that well and because of the calls that were coming in that my father started to get chest pains and had to start to take his nitroglycerin pills. My mother also was getting very upset because of my dad and the way they were speaking to her. That is why she had the car towed back. This gets better just as my mother thought the worse was over they got their car back and everything should now be OK everything is now even they have their car back and non the ware. Brad Benson continue to call her that Friday on the 13th that she can not return the car back to them it belongs to her and just kept calling and calling.

On Saturday the pursued to call her and harass her even when she told them to stop calling her and  not to be contact me her daughter 'StOP' means STOP!  They just kept continue to call and call. That my father who has a heart condition and 83 years of age started to fear for themselves because they would not let up. Saturday night 7/15/12 at 9:00/9:30 PM my parents hear this loud knocking on their door a fraud to answer it my mother looked out the peep hole and saw it was her neighbor. I said in the beginning my mother lives in a senior citizen building and it is to be survalanced, but can not be 100% so they are still careful before they will open the door. This tenant said to my mom and dad that there were two men out side looking to come in and she wanted to know what they wanted she would not alow them in because she had no idea who they were. The one gentlemen replied do you know Mr & Mrs ?? said she does, he told her that my parents had lost their key and he was returning them back and if she could give the key to them. This little old lady did not know anything better at that my mother started t shake and my father started to get chest pains. What these two men did they were the managers from Brad Benson or salemens or both had one follow the other in the car one was in the Elantra and the other one drove another car and broke back the Elantra back to my mother residence left it in parking lot had given keys to a stranger they did not know told her my parents lost thier keys and to give it to them and took off. This was all at 9:30 PM on a Saturday night. This have been on going since July 6, 2012 and still to date 07/16/12. i am still,k getting calls at my place of business from them and so is my father as of today a a Mr. Kees or Keys called them again telling them they can not bring back a car of theirs once driven off the lot and they want their money for the Elantra.

Please tell me if this is not harassing a senior citizen and bully them to the point now my mom and dad is a fraud of their lives. I mean this and I can understand why. My parents address was a PO BX in NY they have their driver licences is a NY address so how disd they know where my parents lived to bring that Elantra back to thei residence in NJ unless it was the salesman that had gone to their home in the beginning to have my mother write the check the 1st time when this all had taken place. I my parents are a fraid to go out not knowing what they will do next. I consider this assualt would you not an intent to harm some one or intent to believe they would bring harm. It is not battery but assult to the elderly. Is there not a law about this to protect the elderly from harassment bully or embessel / fraudlently / con them out of their life saving for what little money they have. I have heard a lot about Brad Benson and there horrible tactices of high preassure salesmenship that they do and something needs to be done about this. If I do not get something resolved my next stop is to the Attorney General and I will be reporting them for what they have put my parent through over a stupid vehicle. If only they would have taken it back it would have nver gotten to this, but they are the ones who is tormenting my parents on a daily bases and will not leave them a lone as said it is still going on and now it is 07/16/12 10 days. My parents need help from someone and put these guys who is  pursuing to scare them and they are not well my parents no less. Someone please help them. I am sure if it was your parents you would not allow this to continue it would be put to a stop!
