In July I ordered a battery-operated atomic clock with nature sounds from Brands-on-Sale. The clock arrived and the instructions stated the type of external power source required. We had several and tried them all but none worked. I then went to CompUSA and Circuit City where I tried adjustable adapters. All met the power requirements but none worked. Thus I returned the product as defective and requested a full refund.

About a week later I contacted, by phone, Brands-on-Sale for a status. It took two days to get a response and when I did I was informed that I would have to pay a restocking fee for them to send the defective product back to the manufacturer.

The actual cost of the clock is $66.99. The restocking fee was $29.54 or 44% of the cost of the radio! In other words, I'm paying to send the radio back to the manufacturer AND giving them a profit off of defective equipment!

I have no problems with REASONABLE restocking fees for products returned that work as advertised. But I have a real problem with me paying to ship defective products back AND provide the seller with a profit on defective products.

American Express agreed and opened up an investigation; however, they didn't really understand the issue and after talking with Brands-on-Sale felt I wasn't being treated unfairly. I then called American Express again and made sure the investigator understood the issue. This time I was provided with contact information of the investigator and my account was credited the $29.54. I'm hoping for a different resolution this time.

The short of it is this - Brands-on-Sale will make a profit off of you regardless if the product works or not. You WILL be charged a restocking fee and it will likely be UNREASONABLE AND UNJUSTIFIED.
