Mr Brian Korte was retaining by me to handle a short sale on my property. I also even had the buyer that was ready to purchase the property and the property was in excellent condition and alot of equity in a wonderful neighborhood.
I met with Mr Korte, whom we thought was VERY KNOWLEDGE in the foreclosure, short sale and loss mitigation business which he is not.
We met with Mr Korte and provided him all the necessary paperwork and a check for $500.
Mr Korte said he was going to be calling the bank and start working on the short sale since we already had a buyer with a 800 credit score and lots of money in the bank.
I spoke with Mr Korte on several occassions and he provided me information that everyday everything is fine.
I received a paper in the mail from the bank's attorney that there was going to be a sale date in 4 weeks. I called Mr Korte again, and he advised us that he was speaking with the bank and the attorneys for the bank and they were going to be giving us a 60 day extension so we can do the short sale.
Well, another 2 weeks went by, and I called him again (2 weeks before the sale date), and he advised that we were getting an extention from the bank and they were willing to work with us. I told him that was fine and I want to get that in writing as i know how these loss mitigation departments are.
I called Mr Korte a few times more that week and the following week (1 week before the sale date ) and he stopped returning my phone calls. I called a few more times and very very upset that we did not hear anything from him, and he lead us to belive everything was fine.......since he told us the bank was giving us 60 more days.
Well, 2 days before the date date, we STILL HAVEN"T heard anything, so i called him a few times from a different number and he still didn't bother to take my calls. My husband and I were very upset, and we decided to call another attorney 1 day before the sale date. !!!! I went to the new attorneys office, and met with him, and the first thing we did was call the bank to see the status and they told us the sale is doing to be tomarrow. They advised they never heard from Mr Korte, and we had no attorney representing us and they never received the contract for the short sale !!!!!!
Mr Korte LIED and never spoke to the bank, nor the attorneys from the bank. And, he told us that we had 60 day extenstion and never gave that to us in writing, because he LIED and never spoke to the bank or attorneys.
The new attorney got us an emergency hearing and a 60 day extenstion.
We reported Mr Korte to the Florida Bar Association, and he also has 2 other compliants.
When I paid the $500 retainer fee to him, he immediately went to my bank to cash the check, and he DID NOTHING FOR US AT ALL.
I wrote a letter to him requesting my $500 fee back, and he wrote back a nasty letter, how dear I ask for the fee back ??? He advised he faxed a letter to the bank. If he faxed the letter to the bank, why was it not sent certified mail or why did he not follow up on the file with the bank ?
He mailed the nasty letter with a copy of the faxed letter and would not return the fee. I feel he should have returned the fee since he did not do anything at all and built our hopes up.
If I didn't go get another attorney 1 day before the sale date, we would have lost our home, and thought our attorney, Mr Korte was handling everything.
This attorney should not be lying to clients and promises. If he could not handle any more files, I would have rather had another attorney or he should have given me the file back plus my money.
I lost $500 to a crook, so i hope no one else losing their money with him.

I am dealling with Jay F Romano  and I think he is giving me the shaft Only I caught him early.  I feel he is trying to sell me out on a EECO case when he wanted 44% if we win . Then he said he wanted $7,000 to file in Federal court when it costs $250 and I can do it pro se for free. I refuse to give him $7,000 But he wants me to sign for $15,000 but I have to resign because which he never told me and give up my workmans compensation case.

My experience is too lengthy and too incredible to type out here. It's beginning to look a lot like everyone else received the same service. This Law firm is turning out the same way as the Chinese Sheet Rock Df Sammarone Saint Lucie West, Florida

I don't know about your case, but Brian Korte owes me Money!!!!!!

Mr. Korte hired me to do appraisal work for him. It has been over a year and half and he still owes me $650. Pay up!!!!!! I performed the services and you think you are better than me?

Better yet, I had to hire another attorney to handle the case you abondoned on me.

I think you should take re-certification class on ethics.

Below is an exact copy of the letter sent to your boyfriend the real owner of the property names removed per website in regards to this matter you posted.

In addition you failed to mention you provided me a fraudulent contract between yourself and your mother as the basis of your short sale, and I would not go to court for you and assist you in commiting fraud.

Coming out of bankruptcy for failure to make your bankruptcy payments, delaying sending contracts to your lawyer and lying to the bank is not the way to save your home. Additionally, I find it is funny that you chose this venue to air your grievance, but you have given me no choice but to respond.

I am writing in response to your letter dated December 12, 2007, and must say that I am insulted and appalled by your letter.

I met with you on November 20th, 2007, when you paid me the $500.00 that you now want back? But let's go back to the day before when you called me and faxed me the information and before I met you or took your money, on good faith I had infact already sent a letter to Shapiro & Fishman, LLP on your behalf on November 19th, 2007. (letter and fax receipt attached Exhibit A) On November 20th after our meeting, I called Shapiro & Fishman and did not get a return phone call.

During our meeting on November 20th, you told me you were going to send me a contract later that day, when infact, your contract came over to by office by fax on November 22nd, 2007 (copy attached of fax cover). I don't know about you, but I don't know any law firms or lenders that are open on Thanksgiving or what you expected me to do with that contract on November 22nd, 2007. My staff and office did not return to work until Monday, November 26th, 2007, at which time your contract was faxed to Shapiro & Fishman, LLP on your behalf. (copy and fax receipt attached- Exhibit B).

On December 3rd, when I have left numerous messages for Seth Karasik from Shapiro & Fishman, LLP, I sent a letter to Washington Mutual Bank. (copy attached and fax receipt Exhibit C)

On December 4th, Seth Karasik from Shapiro & Fishman contacted me and asked me to send him everything again. On December 4th, I sent everything to Seth Karasik by e-mail on your behalf, requesting them to postpone the sale. (copy of e-mail attached Exhibit D)

Carolyn has called my office and cell phone relentlessly for questions and answers. There was a message on my assitant's answering machine that Carolyn needed the contract faxed immediately to the Bankruptcy attorney. Why didn't you have a copy of the contract? You only sent me a faxed copy, I was not hired to fax documents for you and have nothing to do with your Bankruptcy attorney, you hired me to postpone your sale for a short sale.

The lenders and attorneys are inundated with clients in foreclosure, which I tried to explain to Carolyn and this is not the only file on their desks or mine. I did everything I said I was going to do and more, these workouts take from 30 to 60 days to negotiate and it has not even been 30 days. I am sorry that you feel you did not obtain the representation that you wanted but I have more than earned my money.
