I first met Bruce T. Mulhearn in the summer of 2003 while I was serving one year of duty in the US Marine Corps. Bruce offered me a position in the corporate office with a title of "Land Acquisition Specialist" when I was released from active duty. I thought it was an honor for Bruce to make such an offer to me.
I was released from active duty on December 30, 2003 and began to work with Prudential California Realty on January 5, 2004. During the past three years, Bruce and I also developed a friendship and I looked at him as a "mentor". I felt previlged to have one on one conversations with Bruce while skiing in Mammoth or Tahoe.

In May of 2005 his close friend and CFO of twenty years passed away and I found myself "filling some of his shoes". Bruce asked me to take over the "Mulhearn Advantage Programs" which soon came to be known as the "Mulhearn Disadvantage Programs". I immediately noticed that all of the foreclosures and bridge loans were in violation of federal and state lending and disclosure laws. I notified Bruce and worked with his new CFO to ensure compliance with Truth in Lending. But, there were several loans made by Mulhearn Realtors, Inc that were predetory and in violation, which is what the other complaints in this website are referring too.
By January of 2007 Bruce and I had (3) other partnerships together and I was named as "Vice-President of Construction and Development". In March of 2007 I decided to leave the company.

In June of 2007 Bruce's CFO handed me a breakdown of the joint venture which indicated there was a loss in one of the projects. I could not believe it and I began to go line by line, check by check, and number by number. I found nine descrepencies in this spreadsheet totaling over $2 million dollars. I approached Bruce with a line by line breakdown of the mistakes. He did not even look at my numbers and he actually reverted to name calling.
We are currently in litigation against Mulhearn Realtors for Fraud and breach of contract.

There are over 12 lawsuits filed against Mulhearn this moment and over 125 filed in the past decade. There are two cases filed in the same court with very similiar circumstances. It is my understanding that Bruce always settles the cases that his attorney's feel they cannot win. Bruce classic line is that "a bad settlement is better than a good lawsuit". But, he will always settle for half of what he owes. Which means that it is always a good settlement for Bruce.

I have also filed a complaint with the labor board for commissions that were withheld or not paid by Mulhearn Realtors, Inc.

The score today is that mine and my wife's credit report is ruined. It is December 18th and we cannot even afford a Christmas tree right now. Our home phone rings 18 times a day from creditors. Our cars are probably going to be repossesed. The bank is most likely going to take our home.

Some would speculate that we live outside our means and I would argue to these people that if someone stole over a million dollars from them and did not pay them over $150k in commissions...how would they be today?
But, even if I loose everything today. We will some day prevail.

I have five children and I am now facing another deployment at the end of 2008 and I only prey that I am paid monies due to me before I deploy to give my family peace of mind.

Who is Tim Rush?

Public records indicate that Mr. Rush's salesperson license was revoked by the Department of Real Estate 1995 .  I wonder why Mr. Rush would take it upon himself to engage in a public character debate.  What is his interest?  He was not ever present in any court proceedings!

Mulhearn awarded Final Judgement against Marin

Update to the above story posted by Eddy Marin.  On August 9th, 2011 The Honorable Susan Bryant-Deason, Superior Court Judge in and for the County of Los Angeles awarded a final judgement to Bruce Mulhearn in the amount of $455,713.28.  This judgement ordered Eddy Marin to pay Bruce Mulhearn immediately.  Mr. Marin had previously authored a complaint against Mulhearn on  this website proclaiming that Mulhearn had committed a number of wrong doings against Marin.

This judgment against Marin in favor of Mulhearn indicates that the findings of the court based upon evidence were that Mulhearn acted in an appropriate and truthful manner and there was no wrong doing on Mulhearn's part.  A direct contradiction of the allegations made by Marin on his Rip-Off Report posting.

Separate from this action Mr. Mulhearn is involved in further litigation concerning Mr. Marin's conduct in other matters.  Recently the bankruptcy court adjudicating Mr. Marin's bankruptcy issued an order permitting those matters to continue in State Court.  Posted by Timothy Rush, Sr. Vice President, Prudential California Realty.

On Thursday, January 13th, a Judge in Los Angeles County Superior Court affirmed a prior judgment of nearly half a million dollars against Eddy Marin, finding in favor of Bruce Mulhearn and Prudential California Realty, which was based on the erroneous allegations previously posted by Marin in this column.

Months ago an independent jurist and a C.P.A. came to the conclusion the Mulhearn/Prudential had lost hundreds of thousands of dollars on various construction projects headed up by Marin. This court battle confirms that Bruce Mulhearn and his company was in fact the victim.

In addition there is a slander and libel lawsuit pending against Marin, brought by Mulhearn that is as of this writing pending a trial date. We will post the results when they are known.

Defamation of Character

Bruce Mulhearn has filed a defamation of character lawsuit against Eddy Marin on May 16th, 2008; this case seeks actual and punitive damages as well as attorney fees from Mr. Marin and is awaiting adjudication through the courts. Due to the fact that Mr. Marin is out of the country presently, the case is awaiting his return before it can proceed. Mr. Mulhearn will post the outcome once that occurs.

How do you respond to a malicious character and company assassination when the cowardly perpetrator is by design allowed to remain anonymous with a website as the Rip-Off Report?

I recently read a business article where companies large and small are being negatively impacted due to the size and scope of often unfounded misrepresentations seen on the Internet. On a more personal level, children have committed suicide based on organized, malicious attacks on a person's character.

The problem is it's almost impossible to correct directly, as the recipient who is being attacked has no way of responding directly to the attacker. The character faces no real danger, as he is not only hidden, but also faceless.

My company has been in business for 41 years. We have literally helped hundreds of thousands of clients buying and selling their homes and income property. We have 2,000+ agents in the field. Are we perfect? Of course not. We take our agents from the human racethey are imperfect. There are occasions in any business, in any person's life, where mistakes are made. The key is what do you do about the mistakes? In our company we endeavor to correct them. We believe very thoroughly in being problem preventers, not problem solvers. In this litigious society in California, anyone who doesn't feel that they have been given substantial and fair treatment always has the alternate choice of hiring an attorney, thereby becoming a plaintiff, or the option of filing a complaint with the regulatory agency that oversees my license and that of my company.

In addition, the Association of Realtors, through the use of its Code of Ethics, has a system of arbitrating these matters between parties if there is a complaint. The agent, or the Realtor, is in the middle on many transactions if a buyer or seller has a complaintit might be a buyer with a leaking roofor lack of immediate possession at close of escrow, then the agent is also named and becomes involved as a participant in a lawsuit.

Does a company have options? Do we ignore these character and company assassinations? Or do we respond to them? A magazine article advises we should respond and give our point of view. The danger? To exacerbate the problem, the person or persons on the other end have anonymity and continue to contribute further misinformation. We're proud of our company, we're proud of our track record, and we will continually do our best to counter any malicious accusations.

As a company with a strong leadership position in the industry, we strive daily to improve our service delivery and our agents' knowledge and skill level.

Any person who has a legitimate complaint, and wishes to emerge from the shadows to engage in a civil dialogue to correct any perceived or real problem, I am happy to speak to them.
