Brighton Homes - Inverness Homes unfair retenion of deposit Cincinnati Ohio

In 2003 my fiance and I were looking to move from our appartment into a house. A friend of mine at work was planning on having Brighton Homes build them a house. We visited the subdivision whery my friend was building and looked at the different models and decided on one in particular. We picked out a lot and to initiate the process, we were required to put down a $1000 deposit. The next day we found the exact same model we were going to build in the same subdivision, listed in the paper. It turns out that the house belonged to my fiance's coworker who had to move because her husband was being relocated.

Because the timing was better for us in regards to out appartment lease, we decided to purchase the already existing construction. Well, Brighton Homes refused to give us our deposit back. Keep in mind that no work had been done.

We had not even selected any options. Were they breaking the law? Probably not. There is a time and a place for people as well as companies to simply "do the right thing", even when they are not reqired to by law. I do not think Brighton Homes did the right thing here. Although the house we were purchasing did not belong to them, I feel we were still buying into the Brighton Homes product.
