My husband and I have been with capital one for almost 10 years, we are small business owners and with the economy it was getting a little scary since we are mason contractors, being with capital one for so long i felt it was only right to call way ahead and explain the circumstances just in case we would have some serious trouble, when i called and explained everything they seemed more than happy to work with us and thanked us for calling ahead of time instead of waiting to see what would happen at the last minute and not to worry they would work with us if need be. In that conversation i also asked them to take the hold off of are account cause we were unable to log on, this is how i make are payment and get are statement but we have been locked out so i had to call over the phone and make are payment every month even when they said it would be unlocked it never happened.

When August 2010 came around that was when my husband and i started to feel the pinch of not working for over a little of a month, him and I made some serious cutbacks so we would have payroll we were starting over 30 days before invoicing and they have 30 days to pay and we ended up getting alot of jobs that we were hiring so my husband went to take a line of credit so we had some overhead. I had called capital one to make my payment but asked if we could go over the due date this would be the only month and of course that was no problem, the csr even set my august payment up for aug, 31 2010 and i set up sept payment right away also for sept 3rd but it bothered me that the aug payment was on the 31st if something would of happened then they could have us over 30 days so my husband and i made a payment of $4000.00 $2000.00 for aug & $2000.00 for sept but the week of aug 18th him and i were suffering so i called capital one and asked if we could use one of the checks they sent us and write it out for 3000.00 i was told to go ahead no problem are account is fine, while i was asking them about the check we had recieved a phone call from the company we were doing a line of credit and that it just came up that capital one called the credit agents saying we were 30 days past due for august, we talked to a supervisor and he asked for 3 days to investigate and would get back to us, he seen we were never over due.

On Aug 24, 2010 i got a phone call from my bank after getting permission to deposit that check they sent it back bouncing all are checks just a mess, On Aug 25th 2010 I went to my bank and we called capital one to find out why andthey had no reason they talked to my bank manager telling her it was there mistake and please accept another check and we would do it for 3500.00 to help with all the fees, the csr promised the bank manager the check was good and there would be no problems so my bank took it then on aug 31st i had gotten another call from my bank telling me they sent that check back now we were up to 6,500.00 they told us to do and pulled out i have massive overdraft fee's, late fee's, they came and shut off are electric, and capital one just played games for over 3 weeks they left us so broke we couldn't even get are medications and I'm 100% disabled, my husband he's on massive heart medication,and they would not do anything to get this problem solved in fact they made it very very hard. When we call in to capital one we use passwords and it always worked until i had to have my husband call in cause i was not the primary holder and i told them this is going to be very hard he's gone from 4:30am to about midnight every night he's even working out in the field laying brick, well i finally got him to call but i had to give him the #'s cause he won't have his wallet on him not when laying brick, so i didn't even think of giving him the 3 # code cause we have passwords but because she decided to ask for it and they never had before he couldn't give it to her so she told him he had to go to a bank and show them his id and the bank had to call and confirm that it was him, 5 days later i still couldn't get him to the bank so i finally called capital one and the guy i talked to even took that out saying that was crazy, but here we were still waiting for that supervisor to call us about them reporting us to the credit companys, well we are still waiting for his call but the company ended up declining us cause they never got back to us on sept 20th 2010 we finally recieved a letter stating that capital one made a mistake and we were never late on are payments and it takes up to 60 days till it will come of his credit, banks are not loaning so you think were gettinga loan for the company.

The very sad thing they didn't care, I have letters they sent us they don't even realize they sent, they never noted are account like you are suppose to when a customer calls no one had any idea of how much they just defamed are name, broke us were we couldn't get are meds or food no gas and electric, I tried calling capital one to try and work this out but they didn't want to we were expected to take the loss, and i don't think so we are still trying to come out of this and this happened in august but they have no problem calling me for are payment, I told them I'm not paying we no longer have a contract in fact you broke are contact twice, why did i call and ask 1st if we could use one of the checks to avoid problems like this. At least we were able to keep are guys still working who all have famlies but my husband and i suffered and that should never of happened not only did they hurt us as a family but they hurt are business also for 25 years my husband and his dad started this company and just keeping it going in this economy is rough and nobody is helping the small businessman, no one helped us one bit but capital one almost took us out cause of the errors. I have all my paperwork to back up everything i wrote i went and seen an attorney and he even said we have a great case but i can't afford to pay for one, so i called the Fedral Trade Commission, I called ae Attorney General, and they have been great in fact yesterday i recieved a letter from the Department of Agriculture,Trade and consumer Protection and they said the issues in my complaint are within the authority of the agency of Department of Financial Institutions office of consumer Affairs, so i believe they found some serious wrong doing buy capital one cause they didn't even get to see the letters i have, I'm going all the way and please any of you if you have been done wrong by capital one fight back you have lots of rights, they just bank on you saying oh forget it thats why they try to make things hard, all you have to do is make phone calls and report them, fight back please or this will keep going on and I never want to go through this again. thank you
