Appeal Request
Where does it state in the CC & R’s how to get a parking pass on a holiday weekend (Veterans Day) @ 10 pm at night when your daughter needs to borrow your car to take her step-father to the airport to catch a red eye?
My step daughter’s car was not in good working condition and when she needed a car she called us. This was approximately 9 pm on 11-9-13. We allowed her to borrow our car while she left hers in the guest parking. After returning from the airport around 1:30 am it was discovered her car was missing. We thought it had been stolen!
My wife frantically tried to find out where the car had disappeared to and after a lengthy search it was discovered in the towing yard. It will cost $170.00 dollars to get it back.
We ask for our $170.00 to be refunded to us as we could not get a parking pass.
My proposal to the board is to create a “Welcome Committee” to inform any new people moving into the neighborhood of the consequences in the aforementioned scenario.
I would be willing to spearhead this committee and draw up a letter (with board approval) that we can distribute to any newcomer to our community.

Mr. John T.,
Per our previous conversation we had on the phone on 12/21/13 @ 3:15 PM. I alluded to the fact that I, and my wife and the owner of the car have all stated and will testify to the fact that the car was parked in the guest parking space and not on the sidewalk. Also, when the owner picked up the car you told her and I quote, “It wasn’t where you were parked but that you were parked in guest parking after 11 PM without a parking pass.”
Now that we have requested a refund you have decided to change your story. If you recall I had mentioned you may have had her mistaken for another vehicle. I still hope this is the case.
Otherwise, legal action will need to be sought. Certainly, you and I have better things to do than to take time out of our busy schedules and the courts than to go to small claims court to allow a judge to settle the matter. On the other hand this may be the only way to settle this issue.
I do hope you will reconsider the mistake on your part by towing this car inadvertently and refund our $170.00 dollars in an efficient and timely manner.

The person who rebutted your post "cares" because THEY are a consumer just like you. Kinda rude of you that someone would take time out of their life to answer your questions and YOU act an a*s. ANYONE who is going to respond to YOU are going to be consumers like yourself. Oh sure the ppl you are complaining about MAY read it, but 99% of the rubuttals are from consumers like you who are giving YOU the benefit of their knowledge and experience.

Sounds like you know what you are talking about except the part where the towing company is supposed to but a sticker on your windshield and give you a warning! If you read what I had stated you'd see it was a holiday weekend on a Friday night after 10 pm which is well after the permit office had closed.
My contention is that when approached at the tow yard the driver changed his story to say the car was parked on the sidewalk not the time frame in which the car was parked. The car was not on the sidewalk.
Why did the driver change his story?
And if you don't work for the towing company or HOA what do you care?

Apparently your HOA has parking regulations that require a permit, your step-daughters car did not have that permit and was towed. There is really no debate about that, what you are debating is that you are an exception.
Okay..the people you need to appeal to is the HOA. Because again the tow company is there to tow cars without a permit, they are not there to read into some magical crystal ball and see what is the reason the car is there. They did their job.
Perhaps if you can make a case with the HOA that their "permit" requirements are too tough and impractical they may decide to issue you the refund. However, I can also just about guarantee that won't happen because as a Homeowner/Resident you are supposed to know the parking regulations.
No I do not work for this or any other Towing Company, nor Home Owners Association.
