CapitalOne Auto Finance Will not give me a pay-off notice... ripping me off on late and " other " fees that their Rep's promised to remove from my Account Internet

Okay here's the deal with my experience dealing with Capitalone Auto...


First the invitation to a $30,000.00 auto loan came in the mail and there terms were borrow it all or as much as you need and pay it back in 60 installments.

I accept.. mistake number one.. Accepting the loan..

The dealer takes my down payment and then hands me a contract for 66 months, what??????

Like a fool, mistake number two; I accept, with the intent of correcting this with capital one... WRONG!!! Capital One tells me there's nothing they can do and that I locked my self in... I let it go...

Two years go by and I missed a payment by mistake, no biggie. I call them up to pay it over the phone and add the additional late fee as I don't want it to remain in the balance. Forget about the fact that I had to pay $15 bucks to make the payment. So, I pay the kind lady working here in the USA. 

Next statement, late fee still on the bill, what? PLUS now, a new charge : OTHER FEE $20.00 bucks, What the hell? So once again I call them.... 

Mr. Trik we'er soooo sorry for the inconvenience and the kind lady promised me that the late charge and other fee ( whatever thats for ) will be removed...

Yeah, right fat chance.. Never did it come off my statement.

Whatever, it was a total of $40.00 bucks. I told my self at the end of the loan I'm sure we could clear up the mistake or hell if I had to eat it I would, they are Goliath and i'm just one little guy in Brooklyn, NY.. so moving right along, this is where it gets interesting... I fall on some hard times, missed two payments. They sent me a letter to cure the loan, I call and am explained that I am eligible for deferment, so long story short - heres the process: wait for the deferment letter sign it and send it back with my deferment fee of $35.00 (NY State stupid rule), sounds simple enough, right? Hell no, god forbid. 

So I send in my letter with two checks, One a full payment and the second $35.00 for the deferment fee. My next statement comes along and reads that I am still past due two more late charges and now $40.00 more bucks in those "what the hell OTHER fee's"... 

Back on the phone - Mr. Trik we did not receive your deferment letter in the time allotted! WHAT!!!! ???? Okay, no use complaining (they neglected to tell me that they had to receive it back with-in 15 days, the best part is it took 10 days for them to get it to me, LOL) - I ask, so, How do we fix this? - Well were gonna have to do the whole deferment over again... UGGGGGH!! 

Okay, no prob. They sent out another deferment letter - and get this - I have to send another $35.00 check and I ask but for whatever for? I all ready sent the fee in! Heres the kicker, she says those funds went to your principal... Yeah, right sure it did.

Anyway, she tells me as a courtesy there removing all the late fees and OTHER fees from my account, remember I had all ready paid for one that was never removed but they PROMISED that they would remove them all? I'm still waiting for that one to happen..

I was forced, in the meantime to change checking accounts due to my hardship, so I call up and give the Rep. the new account info and tell's me I have to be charged a over the phone payment fee, seriously? Come on!!  Whatever, I pay and  ask if my account is up to date and that were back on track with the automatic payments, YES, Mr. Trik we're all good... Such liars... 

Next payment date rolls around, nothing!! I call up - Hey, what's the deal? Why didn't Cap One take the payment outta my account? We'll sir we tried but your institution bounced it back? WHATTTTTTT !!!!!!!!???

That, my dear, is impossible - there is over three months worth of payments in that account. Wouldn't you know  they never updated my new institutions account info in their data base... Shocker, no? 

Okay Miss, could we update it now and I would like you to make sure I don't get charged any late or other fee's seeing since it wasn't my fault.

No problem Mr. Trik. She takes my info, my money, charges me $15.00 to do so and tells me everything going to be fine. Thats not even Bulls**t it's horseS**T ... 

Next month, same scenario .. I get a manager on the phone who haphazardly try's to tell me it's all my fault and that I was supposed to mail them a void check to change accounts.. Not none of the ten or so Rep's I spoke with even mentioned that to me... 

The best is that three times I called to make a payment on my due date and Capitalone's system would not let the Rep take the payment due to the fact that my automatic payments were still in force, even though they had promised me that they stopped them. 

Lies, upon lies, upon lies.... They haven't a clue and no one know's their a*s from their elbow over there.. They tell you no problem and mislead you and purposely with hold  information as so you can rack up late fee's and interest charges and whatever those "OTHER" fee's are for... 

After close to a four month ordeal of their incompetence, I finally got the account settled but they never re-instated my automatic payments and refused to give me access to pay on-line because and get this one - there late and other fee's on my account... LMAO.. and their response when I asked why they hadn't been removed from my account, seeing since I was promised that they were? - Ummm, they hadn't a clue... and to top it all off after all the aggravation and the arguments of trying to get them to stop trying to pull payments from my old account and getting that account number off their data-base three months later, in January of 2007 I called in a payment gave them my account info, I even double checked with the rep as that my old info was not on the data-base- what do you think capitalone did?

You guessed it, magically they some how tried to pull a payment out of closed account that wasn't  supposed to be in their data-base.

My final payment comes along , with the fee's and all it's over $1,600.00 bucks and totally unexpected... I never signed on for a ballon payment and as far as I know it's the law that a creditor is to be notified in writing if his or her payment is going to change. For crying out loud would have that been that much trouble, at the least.

So, I paid what I could, they reported me to Credit Agency's as 30 days late and Shocker to the world charged me more late and other fee's...

What even better I can no longer even get a Rep on the phone, my account info is no longer in their system.

Capitalone Auto finance is ripping people off left and right and there's nothing any one creditor can do; they don't even have Rep's in the United States anymore.. Only one number you can get on-line and in the directory and even if you walk into one of their bank branches you'll get turned away with the one and only phone number that leads to some schmuck across the pond half a world away that can't comprehend what you're trying to tell him. 

I am going start an action against Capitalone in a court of law... 

Todays date is July the 27th, 2010.. 

I will return within two weeks with an update and perhaps a class action law suit against Capitalone Auto Finance...

Wait are you serious?  Let me get this straight, you open up a credit card with Capital One, use it and then pay the minimum, then you don't pay?  Are you serious? And you have the nerve to come on here to complain?  Why shouldn't they hit you with late fees and fines?  If you did the right thing like pay your bill you would not be in this mess.  Who do you think ends up paying for those items?  You think you should get it for free?  Shame on you!! 

I got my first credit card when I was a poor college student, I signed for it because I wanted the free shirt that came with signing up.  I charged only what I could afford.  Guess what buddy?  I still have that card, with a zero balance.  I never got a late payment notice, I never had to pay fines and fees.  Why you ask?  Because I'm not a deadbeat, always paid my bills on time. 

It's people like you who put this world into the financial disaster we're in. 

I would not rent to you.

I hope they garnish your pay (as little as it may be) and sue the pants off you

- Before you return perhaps you should look up a few things.  Such as what are your grounds for filing the suit.  Then perhaps you should do some checking beyond the buzz words like "Class Action Lawsuit" and see what it actually takes to file one. 

As to your situation.

- Were you forced to sign the contract..NO.  Even though it was for 66 months you decided to still go with it.  Capital One does not have Pre-Payment Penalties(at least as far as I ever saw).  If you had a 60-Month loan your payments would have been higher.  There is NOTHING keeping you from sending in additional money to pay down the balance quicker.  How do I know...I did the same thing with them and paid off a loan about a year early, saving quite a bit of interest.

Then it appears that you were late once, missed two payments causing them to send a letter to cure(basically a chance to get caught up before they repo the car).  You did have issues because you were "forced" to change your checking account.

My final payment comes along , with the fee's and all it's over $1,600.00 bucks and totally unexpected... I never signed on for a ballon payment and as far as I know it's the law that a creditor is to be notified in writing if his or her payment is going to change.

- If you look back at the deferment paperwork it is very likely that this comes from there.  The deferment lets you skip payments but moves the payments to the end of the loan in addition to the additonal interest.  Just about every company that does deferments moves these amounts to the end of the loan as a "ballon payment".

But when you do file your suit please be sure to post all of the information here so we can all follow it.

I am sorry that you went through so much. I have been getting the letter in the mail too for years, and I now need a new truck, as mine is old and have been thinking about calling Capital One about a loan. Thank you for taking the time to post this, because it saved me a lot of headaches. I am a woman with a disabled husband and occasionally am late on payments and I see that would be awful for me if I got this loan. Again, thank you for taking the time to post. Will be looking forward to your update.
