Hello all I am at the end of my rope and don't know what to do, here goes my story. Years ago I had a capitol one card with a $300 limit, after I got divorced I had too many expenses so I did not pay it and it grew to 1300 I owed. So I get a letter from a law firm (collection agency) that I am being sued so I start making payments ($25) a week.

After a few months things got better I called the collection agency to ask how much was left they said $150 so I sent a check in with final Payment in the memo and ten received a letter from the attorney saying the case was dismissed. Ok now here is where things get stupid, I pull my credit report and cap one is on there saying I have a balance of 4365 that is past due and they keep reporting my negative every month, so I call the collection agency they cannot figure out why so I call cap one they have NO record of me at all. They said it was transferred to legal, so I speak to legal they say yes it was paid your fine HOWEVER every month since cap one is reporting me negative I dispute it they verify when I call them they say they don't know who is verifying. but they keep on doing it so I make huge mailings to all 3 bureaus including cancelled checks, over a years worth of transactions to cap one and the letter from capitol ones collection company saying the case was dismissed with no cost to me, now I am told it's not enough. How much more do I need to prove a debt isn't mine?

So after getting a letter from Experian last month saying the debt was verified again (I dispute it constantly) I called in person they told me it had been marked paid, I was over joyed got a fresh copy of my report to see my score jumped 80 points and cap one said current/closed. Then I get a letter from transunion saying it has been verified so I call them saying how can this be Experian reported it paid, so I got another copy to fine this month cap one reported I owe $365.

Can anyone tell me what to do? They are telling the bureaus I owe them money, they are telling me I don't and even if I wanted to pay the $365 and make it go away I can't because they have no record of me, what can I do???

First off all, let me say that I do work in the credit card industry and have done so for quite a few years. Your situation is very unique and very disappointing.

In the field where I primarily work, we often have cardmembers telling us that there are some negative things being reported on the credit bureaus from our company yet nothing is showing up or the account was charged off such a long time ago that we can't help them and it's very hard to back track where the account was sent.

In some areas we CAN help them because if the account is still with us there is a number for our company's credit bureau disputes department and they will help with anything that is reporting incorrectly because by law, we are supposed to be reporting accurately and if something is brought to our attention as incorrect then we are to update that within a certain time period.

In other areas we can't because the account is not with us anymore. This is the condition I believe you to be in from what you had written. From what I've read, it sounds like you went through all the necessary steps and the credit bureaus are starting to get corrected. Since Experian sent you a letter stating the account was paid off, I would suspect that the other bureaus will start to get that information and have it updated as well. The unfortunate thing with those bureaus is that they may not have everything up to date until six months after the change was put through. Although I don't have any real suggestions for you, I would say to wait for just a bit longer because of the time periods that the credit bureaus have. I see accounts all the time where someone won't pay for 30 or 60 days and we'll report them to the credit bureaus and the person's score won't drop until 4 maybe 6 months later. Again give it a little more time and congratulations for coming back from such a bad place. It's not an easy thing to do but you accepted the responsibility and to action. A lot of people posting reports on here could learn a thing or two about responsibility from you.
