Caprice Michelle along with her attorey Daniel Paz recently sent me a settlement agreement to avoid the terribly undesireable place she has put herself in.  Caprice Michelle a licensed real estate agent and happens to own a house in Rockwall, TX.  She committed countless violations of the law in the process of leasing this property ($3,300 per month).  So after she was notified by myself and Rockwall Code Enforcement of the issues regarding the house a few days after that, I suddenly was served a notice by her "assistant".  The notice stated that she has terminated my right of occupancy.

Well just so happens that is a VIOLATION of the law and is considered retaliation by a landlord.  So I notify the authorities of the countless problems with the house such all 3 of the airconditioning units broken, she then proceeds to terminate my rights to live at the house.

Then a few days after that I receive a letter via certified mail from her attorney.

RE:  Caprice Michell Swiercinsky:  240 Willowcrest Lane Rockwall, TX  75032.

Stating the following:  


1.  BLA..BLA...BLA


3.  You agree to release my client, Pink Dallas LLC, e-Executive Realty, relating to claims relating to the Lease and the Lease  Property and any claims or cause of action for breach of contract, negligence, fraud, negligent misrepresentation, violations of the Texas Deceptive Trade Practice Act, violations of the Texas Property Code, violations of the Fair Debt Collection Practices Act and violations of the Texas Real Estate License Act and the Rockwall City Ordinance.  

If you could only see how many LAWS she has broken, I bet she does wish I would sign this document.

We are never happy to meet discourse in our professional lives, but true professionals are mature enough to realize that losing for all to win, just might be the solution!

 Though Caprice – Michelle was granted a judgment in her favor after being the victim of some free loading tenants that kept multiplying like rabbits, yet none of them could pay her the rent for the home she rented to them. This was her personal property she rented and unfortunately, she most likely will never be able to collect on this judgment, however it was nice to know that the judge saw right through their B.S. and verbally humiliated and reprimanded them in open court !  Beware Nathan Sorrell because judges are not tolerating this kind scam to take advantage of home owners and are setting examples of offenders!

Beware when qualifying ALL tenants but especially be on the look-out for those mentioned in reports like this one.  Caprice should have been less trusting and qualified these guys like she would have done for a client’s property! In a word she liked them and extended them too much trust, believing that their hard times were just temporary; only to later discover that their hard times were a carefully calculated career path for these repeated offenders.

In fact it was her kindness that was at fault for this happening just as much as their pre-meditated scheme, to take advantage of her busy schedule and her success, that they apparently believed was great enough to support a few more grown children, besides her own!

You better believe that her Broker; who cares tried coming to her rescue to help mediate this unfair predicament and would proudly do it again! Though this wasn’t a property Brokered by e-Executive in the end and though we  REALTORS perform the job of finding prospective tenants, it is not the job of the REALTOR, to determine what renter is most qualified, based on what they may claim in a application , rather we send it off to a third party credit and/or background checking agency that does this as a profession. 

In this case, since Caprice is the owner and decision maker of what course to follow, she made a mistake by not sending their application onto that third party. 

In retrospect, now reconsidering what is and is not in the applications of these applicants, we suspect that much of what was provided to qualify, was not true and in fact contrived to influence her to feel it unnecessary to be concerned about such seemingly strong applications.

 These third party credit/background checker companies are trained to find the true facts about applicants as similarly are property management companies.  They investigate beyond what an eager applicant claims and in the case of property managers they take it step further by dealing with their decision to accept an applicant by being the third party that deals with their every issue for the term of their lease. 

Thus typically; property managers often have a rough intimidating personality built for challenging prospects face-to-face in regaining possession of properties, but not so for us  more cheerful REALTORS involved in emotional sales experiences.

Whereas professional saleswoman;  Caprice-Michelle is in the business of selling homes to buyer’s for seller’s, making their dreams a reality AND SHE IS THE BEST AT WHAT SHE DOES!  We regret that she was victimized by these predatory con artists, HOWEVER we all learned a very good lesson from this, unfortunately it was costly one for her!

 We are delighted to announce that she has overcome this challenge and is back in full force ready to sell your home or help you buy one, with her Brokers steadfast support unwavering as always! We thank all of you who have helped, provided your support and came to her rescue!  I would be remiss if I failed to say how impressed I was with such a turn-out, but no surprise that Caprice is as popular and well liked as she is.  Her sales production speaks for itself on that issue and we are so proud to sponsor her as one of our own!

Finally, to speak to the placing of frivolous, false and contrived reviews as a weapon to harm and/or scare law abiding folks into paying money to extortionists.  Rip Off report should require facts to be presented and tested for accuracy before allowing their site to speak to the general public about someone’s character or company reputation especially when the author is guilty of slander violating Texas laws regulating such behavior?
