I purchased a Saturn on 5/9/05. The dealership tried charging me 1000.00 for tax title and reg, and wanted 200 down. After telling them I could not pay the down payment or the reg fees and would not be purchasing a car, they refigured the numbers and eliminated the down payment, and the 1000.00 for fees turned into 541.00. I got my insurance on the 18th of May and had to put 400 down.
My first car payment of 160.00 was due on Friday May 20, 2005. I was not able to get there because I was working, so I showed up at 9:00am Monday morning and waited for them to open. When the finance guy showed up he told me they will not accept my payment what so ever and that there is no grace period. He stated that when I bought the car I was told if payment was not made on or before the due date that the car could be repossessed. I advised him it was stated as "could", not "absolutley would"! I was then told I have to either hand the car back voluntarily or it will be repossessed.
Its one thing if I did'nt show up for a week, but one business day is insane!! I was then told that I could voluntarily hand the car back, and then come back in two weeks after they do their reporting to the credit bureaus on the 1st, and get another car. I know as a consumer I have rights, and Massachusetts has pretty scrict laws protecting consumers, so I called the Attorney General's office and was advised thatI do have rights and that under Mass General Law Chaper 255B section 20A paragraph B) After a default by a buyer under a consumer credit transaction, the secured creditor may not bring any action against the buyer or proceed against the collateral until he gives the buyer the notice described in this section. The notice so required shall be deemed to be delivered when delivered to the debtor or mailed to the debtor at the debtor's address last known to the creditor. The notice shall be in writing and shall be given to the buyer ten days or more after the default. The notice shall conspicously state the rights of the buyer upon default.
I am now filing a formal complaint with the Massachusetts Attorney General.

Patricia, I think you should file your complaint with the Better Business Bureau as well as the Atty. General in Mass. They might be linked and it will strengthen your case. Ask the Atty. General to review the report in Kentucky. Atty. General Greg Stumbo has filed a consumer protection lawsuit against the Louisville JD Byrider and the corporation-JD Byrider, Inc. from Indianapolis.
