I would like to start by saying if you know an attorney or if you are an attorney that is not scared to take this company on, please step up.
I took out a loan with cash call for 2600.00 and yes I knew about the interest rates and of course I felt I will pay this off in no time and the intrest rate would not really effect me. However, things happend and I got behind by a month or two and the phone calls started and the harrasment started. I set up a payment plan with the company, because you do have options to catch up. But, in the meantime I was still receiving letters, phone calls and email about how I was late and accessing late fees. I called cash call to get them to explain to me how can this be when im on a payment plan. I was told it does not stop the fees accessing every month because according to contract im still behind untill I catch up. I will still access late fees and the letters, dont worry about them the letters generate automatically even if you are on a payment plan. Of course I asked to speak with her boss. I have asked for detail accounting on my account and I still have not received it. This company is a rip off and I hope enough consumers can get together and shut down this business so they cant hurt any one else.
There are so many comsumers out there that do not know what they are getting into with this company. All I can say is stay clear of them dont borrow from them.
Any attorney out there that wants to take this to court please please contact all these comsumers that need help to fight against this company.

I was aware of the Rosenthal FDCPA but not NY's law. Since the OP is in Virginia, neither applies - hence the information in the post is OK for that state. Still a waste to file a suit as the law allows Cash Call to operate with their high interest rates in Virginia.

I know this is not correct for 2 states.

In California, the Rosenthal FDCPA (state statute) imposes the same restrictions of the federal FDCPA for debt collectors on to creditors. The Rosenthat FDCPA allows for the same statutory penalties as the federal FDCPA.

In NY State, a section of GBL (general business law) forbids "harassment" from anyone or business attempted to collect a debt. Of course, this is moot in regards to Cash Call because NY State forbids the interest rates that Cash Call imposes-that's why Cash Call and it's partner First Bank of Delaware, do not grant loans in NY State.

There is not gonna be any type of class action lawsuit because of their interest rates. Further, anyone yapping about a lawsuit would be better off filing an individual suit-assuming they have a case that is.

Don't let others discourage you from any of your goals. Its people like others rebuttals here that make things worse for the unsuspecting consumer. Their opion means nothing. The only thing that maters is that we can pave the way for others not to had by Cash Call crooks......

Wasting Time.....

Cash Call operates within the guidelines of the law - they're allowed to call you as many times as possible, hassle you when you're late, etc... The fact you've setup a payment plan is irrelevant to the overall situation. The objective is to pay off the loan now - by whatever means possible under the law. In the meanwhile, you'll keep allowing them to make more and more money off of you. Nobody should use them - period. But stupid people do.....

Class action lawsuit won't work either. Just pay off the loan and don't use them again under any circumstance.

Even the BEST attorney cannot win a lawsuit if the defendant is conducting business LEGALLY.

In order to win a law suit against Cash Call, you have to have a CASE! No lawyer is gonna try to sue CC because of their interest rates because their interest rates are legal in the states where they grant loans.

This has been hashed over for almost as long as Cash Call has been in business.

I agree with you....

Some one out there must be willing to help us find a good attorney to file an action against this company. They seem to be able to get away with so much and yet, no one has ever challenged them... I would be one of the first to sign up and file the needs to help us out!!!
