I purchased a vehicle with Cash Backs auto back in late 2009 and in the early morning of 03/25 my vehicle was reposed.  I called the office at 9:00 am that morning and talked to Rick the regional manager, who from the start was very rude.  I informed Rick I had called the police when I saw my car was missing and they informed me Cash Backs had the auto.  I asked him why was the car reposed and he told me no payment was made.  I went on to tell Rich that I made the payment on 03/01 (payment was due 02/28 however it was a Sunday) and it has been debited from my bank account.  After further investigation it was confirmed that they had received the payment however one of his employees did not print a receipt and they processed the payment to the wrong car.  I than asked if they could return the car from where the reposed it from.  His answer to me was that he did not know what time they could take the car back.  I was ok with that and asked him to connect me to the person in front so that I could up date my insurance information since I had changed insurance.  After giving Evelyn my insurance information, I receive a call back from Rich to tell me that now my car was towed due to they did not have my updated insurance information and that not only would he not have my car delivered that now I have to pay $150.00 repo fee.  By this time I am upset and told him what if I decide to let him just keep the car, he said that he would take me to court and then hung the phone up in my face.  I feel that this is not acceptable when the car should not have been reposed from the start.  I refuse to pay the $150.00 fee he is charging me and he has poor customer service skills.  I have had several problems since I bought the car, I ended up taking it back within the first week due to the breaks.  Of course the warranty ended in 15 days and each time I had an issue they want to charge me for services.  I just recently bought new tires for the back because they were so bad and they were supposed to be new when I bought the car.  This company does not provide good service or cars that will do not constantly need work.  Rich who is the manager is VERY rude and has no customer service skills, he swore at me, hung up on me and when i first went in proceeded to tell me racist, sexist and vulgar jokes...this guy is a joke himself and needs to be shut down!

Hello everyone, sorry I did not update this thing a while ago.  I ended up fighting this in court and I did win, Cashback Auto agreed to settle the debt they charged us and report the credit bureaus that the debt had been paid in full.  I apologize R D Kennedy for making your family business sound so horrible, I look back at what I wrote and it still makes me kind of angry at the fact that we could get no where with Rich.  I am very pleased to hear that he has been fired and I appreciate
the business you offered us when we were in need, I dont know if I would ever buy a car from your business again because of what happened but I hope now that he was fired your business is under better management and is upholding to the A+ in which the BBB gave you.  

Again Jim from Orlando, your an IDOT because you dont know what your talking about.  I HAD insurance the WHOLE time the car was in my possession, if I did not have insurance than the judge would not have sided with me on this case.  I had all my documentation supporting the fact that I paid my monthly payment and I HAD INSURANCE on the car from the start date in which it was in my possession.  Also, I paid my monthly car payment on time every month, i did not fall behind at all.  Some people may fall behind and run into a situation where they get their cars repossessed because of this but this was not the case in my situation, R D Kennedy this had had nothing to do with me at all. 

Again, I appreciate Cashback Auto manning up to the situation and making things right in the long run.

Without Regard....

Without regard to the original complaint...although I stand behind my original statement of why the car appears to have been repo'ed...because the borrower failed to have REQUIRED insurance as per the contract.

However, let us set the record straight regarding a major point...

In regards to the respondent for the dealership...anybody and I do mean ANYBODY can buy a BBB membership.  Anybody and again I mean ANYBODY can BUY any phoney BBB accreditation they want.  Now maybe your store operates within the guidelines of full honesty and full integrity.  If so, then great.  But its NOT because of the BBB. 

The BBB is a well known SCAM known by the business community.

The BBB is NOT part of any government body, law enforcement agency, judicial body.  The BBB is NOT part of the district attorney's consumer division.  The BBB has ZERO enforcement powers.  The BBB has ZERO connection with ANY judiciary body, minor or otherwise.

The BBB SCAM is to deceive consumers into thinking they are part of the government and carry some weight among the business community.  Experienced business people know full well the exact nature of the BBB SCAM and we also know there are businesses who clearly operate without regard to honesty and integrity but HIDE BEHIND the BBB by claiming their business is so, so honest because they are a BBB "member" which again, ANYONE can become!

This is a response to a report that was posted here. I am an employee and the brother of the owner and an authorized representative on the behalf of the president and owner of Cashback Sales & Leasing Inc. 
 
Our business has been in business for 22 years and owned by the same family for the entire time and operating in the same location plus for a period of two years had a second location that was in Scottsdale Arizona.
 
We sell used cars mostly 3 to 10 years old with most of them being in the middle of that range or an average of 6-7 years old.  Our typical buyer comes to us with bad credit and is not able to get financed from conventional banks and lenders and in many cases have been turned down by other car dealers who like us are buy here pay here dealers.  We sell most of these cars for a low down payment and carry the note ourselves.  We perform a badly needed service for credit challenged buyers who are out of options to get a car that they badly need to get back and forth to work. 
 
We have an A+  rating with the BBB and that is a major accomplishment that we are very proud of and we worked very hard at to obtain.  In fact if you check with other buy here pay here auto dealers you will find very very few that have gotten or maintain an A+ rating. In addition we have passed the scrutiny of the BBB and are also a BBB accredited business because we have met their high standards that they demand to be eligible to be a BBB accredited business. 
 
We have a number of our customers who for one reason or another fail to make their payments.  The number is relatively low but when that happens we have no choice but to repossess the vehicle to limit our losses.
 
The incident reported here was handled entirely by the manager of our Scottsdale store and that manager is no longer employed by us and has been gone for quite some time.  I will not attempt to rebut the person who complained on a point by point basis as I am not familiar with the particulars of the person who reported all of the negatives about a former manager.  Instead I would point out that we sell USED cars.  USED cars can and do break down whether it is one we sold or one that anyone else owns or sells or buys. 
 
I would point out anyone who is reading this to take into account that a person making a complaint can say anything that they want to and no substantiation is needed.  We are very proud of the fact that for selling used cars to credit challenged buyers we have few complaints.  If you read our complaints that have been filed with the BBB there are but a scant few and they all were resolved.  This person represents a very small minority of customers who for one reason or another we were not able to resolve their problem.

You Said It All!

Here's your direct quote: "...my car was towed due to they did not have my updated insurance information...".


As a condition of your contract, you must carry the required insurance.  You apparently allowed the prior insurance to lapse, otherwise they would not have found out about lack of coverage.  When you allowed the prior insurance to lapse, that insurance company informed them.  BINGO!  End of story!


The payment mix up was not the cause of the repo and all of you screaming "lawsuit", need to read the story.  The reason the police aren't getting involved is because such a matter is indeed a civil matter, not criminal.  They get calls like this all the time!  They gave you the reason for the repo...and it was NOT a payment mix up!


You also seem to think nothing of a repo to begin with.  You asked them to just keep the car!  Do you ever think breaking out of the subprime mindset might be the right thing to do?  A repo is a repo whether you give them the car or they pick it up in the middle of the night.


You also talked of alleged mechanical problems.  That isn't a matter here.  Whether or not the car runs well, isn't an issue.  You are on the hook for the contract.  And by the way...THEY ARE 'BRAKES'...not 'breaks'!!!!


They need to be shut down?  What needs to be changed is subprime thinking!

So i tried to file a police report but the PHX police department is retarded...i swear i have never lived in a place where so many people are STUPID.  The police department said i could not file a police report for theft because its a civil lawsuit, but my lawyer is telling me i need a police report wtf! i swear i need to go back to WA where people have some sort of sense in them!

Since THEY credited the payment to the wrong account, and since you HAD insurance, this is Grand theft Auto, Bust them.

(Be sure you can prove it, have the cancelled check, and insurance papers when you call)

Good luck, it's plain the repossession is a false repossession, and since they want to "Invent" Charges that makes them thieves.

Don't let them get away with this theft by deception.
