We contracted Cavanna Construction on 10/22/2008 to install a cement patio and place it under roof for a total of $13,000. Work was to be completed in the spring of 2009. A deposit of $10,490.00 for material was given to Ricci and Vinny Cavanna on 10/22/2008. March of 2009 I contacted Ricci Cavanna to see if we had a start date for the construction of my patio.

I was told that they had a family emergency and had to fly out of town immediately that Vinny's father had passed away and they were taking custody of Vinny's youngest brother. Ricci stated she would call me in 2 weeks. 2 weeks go by and no contact. I called Ricci again and was informed that they are working on an addition project that was started in the fall and I was next in line to be completed that they would be contacting me in two weeks with a start date.

2 weeks go by, no contact, I again contact Ricci and am told that inspectors are holding up the other project and that it is a bank funded project with specific deadlines that I would be contacted in two weeks with a start date. 2 weeks go by no contact, I again contact Ricci and am told that Vinny would be calling me. Vinny called and said he is trying to get the cement guy to get me in the schedule and he should be able to start in 2 weeks....he would call me the next day with a start date.

No contact again so I called again, this time my phone calls go unreturned, I received a letter from Cavanna Construction stating my project will be completed in the spring of 2009 that they are busy with another project. Well spring officially ended June 21, 2009 and work still has not begun and my phone calls continue to go unanswered.

At the advice of my attorney who stated that Cavanna Construction is in breach of their own contact I sent a certified letter with two acceptable options...at this time the letter has gone unreceived. Cavanna Construction has made no attempts to contact me and is still in possession of my deposit. I will be hiring an attorney if I am not contacted by Cavanna Construction by July 7th 2009.

We hired an attorney who rewrote the contract, and Cavanna Construction agreed to the new contract.  Work is to be completed by October 2nd every day after $50.00 penalty to Cavanna.  Work began 3 weeks ago, and so far the old deck is removed, and site cleared some footers poured, but not in correct spots according to our inspector, have not seen nor heard from them since.  Found it interesting that the District Attorney called me in regards to my report on ripoff reports...so we are ready for criminal and civil charges if the work is not done.  So far they are going to be after the agreed date since according to Cavanna Construction the pad for the patio has to cure for 28 days before they can construct the roof.  my calculations tell me that 28 days for cure if they poured today would make it October 2nd with no roof....Does a district attorney and a private lawyer calling to get work done sound like a reputable company to you?

TO WHOM IT MAY CONCERN, I AM WRITING THIS TO INFORM EVERYONE THAT CUSTOMERS LIKE THIS ARE THE ONES THAT GIVE CONTRACTORS A BAD NAME. I CONTRACTED WITH THIS FAMILY IN OCT OF 2008. AT THAT TIME WE CLEARLY OUTLINED THE TERMS AND CONDITIONS OF THE CONTRACT. WE STATED THAT WE HANDLE EVERY JOB IN THE ORDER THAT THEY ARE CONTRACTED. WE WILL NOT START ANOTHER PROJECT UNTIL WE FINISH THE ONE THAT WE ARE ON. IN MAR ON 2009 THE HOME OWNERS CONTACT US AND STATED THAT THEY ARE HAVING A PARTY AND WANT THE PROJECT COMPLETED ASAP. WE EXPRESSED OUR CONCERN WITH THAT AND WE TOLD THEM THAT OUR CONTRACT WAS IN FACT DETAILED AND SHOWED THAT WE WOULD COMPLETE AND OR START AS SOON AS WE COMPLETE THE JOB THAT WE WERE ON. THE WEATHER AGAIN WAS NOT IN OUR FAVOR, WE UPDATED OUR CUSTOMERS BI WEEKLY TO LET THEM KNOW THAT STATUS AND WE HAD NO PROBLAMS. IN JUNE OF 2009 WE CONTACTED THE HOME OWNERS TO INFORM THEM THAT WE WOULD LIKE TO START THE PROJECT AND GAVE THEM A START DATE, WE THEN ASKED THEM TO GIVE US PERMISSION LIKE WE DO TO ALL OF OUR CUSTOMERS. THEY THEM RETURNED OUR CALL AND STATED THAT THEY WOULD NOT BE AGREEING WITH THE CONTRACT THEY FELT THAT THEY DID NOT HAVE TO PAY THE WEEKLY PAYMENTS AS AGREED IN THE CONTRACT SIGNED BY THEM. WE EXPLAINED TO THEM THAT WE HAVE A CONTRACT FOR A REASON AND A SITUATION LIKE THIS. WE WERE NOT AT ALL RUDE OR DISRESPECTFUL TO THEM, WE JUST LET THEM KNOW THAT THEY NEEDED TO KEEP WITH THE TERMS OF THE CONTRACT AND IF THEY ARE NOT THEN WE WOULD NEED TO HANDLE THIS FURTHER. THE HOME OWNER THEN CALLED AND LEFT A THREATENING MESSAGE AND LEFT THERE ATTORNEYS TELEPHONE NUMBER. AT THAT TIME I CONTACTED THERE ATTORNEY AND ASKED HIM HIS POSITION ON THE MATTER. HE STATED THAT HE INDEED DID NOT READ THE CONTACT SO I READ THE CONTRACT FOR HIM AT THAT TIME. THE SHORT AND THE LONG OF THE STORY IS THAT WE HAVE PHONE RECORDS AND PROOF TO SHOW ANYONE WHO IS INTERESTED, WE ARE A GOOD FAMILY OWNER COMPANY THAT TO BE HONEST TRUSTS THE WRONG INDIVIDUALS, AND THAT IS WHY OUR CONTRACTS ARE SO DETAILED BECAUSE OF PEOPLE LIKE THIS AND THEY TRY TO PULL ONE OVER AND NOT PAY FOR WORK THAT THEY REQUESTED.
