I recieved multiple calls for a person with part of my last name. I kept hanging up. Finally I wanted to end the phone calls so I talked to CBCS. They phished for my name and address which stupidly I devulged in the effort to resolve the fact they were calling the wrong person.
Now I am having to defend my credit from a debt from direct energy who I never had an account with. I had TXU and recieved a rebated from my down payment when I left Texas. Direct energy doesn't know who I am and I cannot get any staments or invoices from cbcs on the debt I am said to have owed. Now I have given them my name they have changed the name on the collection letters and have theatened to "ruin" my credit.

Once again, your lack of the basic fundamentals of grammar, spelling, and punction leave me dumbfounded. But, you have now climbed to a new high (or low). You see, in this country, someone is considered "innocent" until proven "guilty". You might want to review our Constitution. Where in the h#ll do you get off telling someone that the burden of proof is on them?
How is he supposed to prove he is innocent when he knows nothing about the alleged debt? Just what do you think "validation of debt" means?
I would also like to know just where you went to school. I want to be more than sure that none of my grandchildren attend it.

The first rule is to NEVER speak to any debt collector on the phone. It will never do anything positive for you, and in most cases will make things worse, as you have found out.
Now, CONTRARY to the bad advice given to you by the former CBCS collector Brainless Natira, the BURDEN OF PROOF is ALWAYS on the collector to prove that you owe the debt. You NEVER have to prove anything to anyone that you do not owe the debt. This is FEDERAL LAW. It can be found under the FDCPA section titled DEBT VALIDATION!
All you need to do is send a DEBT VALIDATION request by certified mail, return reciept requested. Be sure to put the certified# on the letter itself and keep a copy for your records. This is very important for when you SUE them.
In this request clearly dispute the debt, and DEMAND to see whatever you signed to create the alleged debt as well as a full account history. Also inform them that debt validation materials will be the only acceptable communications and that all other communications and/or collections activity will cease immediately.

my dear the burden of proof is on you obviously you need to send in the rebate the rebate proves you didnt owe any thing and you where with a nother co after you send that in and dont be scared of ink!
the cannot and wont ruin your credit its ment for those who refuse to pay the bill so just sent the rebate to 230 e.town street columbus oh
i forgot the zip but they will get it and make sure it is a copy
