Cellz4Less Scammed me of $200 buy selling me faulty equipment then failing to refund my money! Culver City California

I purchased a "NEW" cell phone on Ebay from Cellz4less on May 15, 2008 for $178.00. After waiting 2 weeks for them to ship the phone, it arrived via fedex ground (it was advertised to be mailed fedex 2 day). I opened the box only to find that the phone was outdated and did not work. I immediately called them and after numerous attempts to reach a person (say 100 calls) I finally spoke to someone who told me "no problem Ill send you the RMA information and we'll send you a new phone". I got the email and then I had to pay to ship it back to them.

My new phone arrives 5 days after I mailed them the first phone. I open the box to find that the phone is not new. There are phone numbers in the contacts and there are pictures on the phone of someones kid, and again it did not work. I immediately call them again. They said no problem return the phone to us and we'll issue you a refund!. This time they payed the shipping and I shipped the phone the next day. I never recieved my refund. I have called them several hundred times, there is no answer. They do not answer the phone and there is no way to leave a voice mail. I have also emailed them about 50 times, with no answer. Now I am out a phone and 200 bucks. This company is a scam.

I did my research. They had good feedback on ebay and there was nothing out there when I googled them. Now after all this, all i can find is bad things. Im a few days short of filing a report with the police department in my town. I have emails saying they will be refunding my money,and I havent seen it yet. They are no longer a seller on EBay. I wonder why. but I have located them on Craigslist. I have called a number they have on there and some lady who barely speaks english answers and gives you the number where noone answers.
Total Rip Off. I will NEVER buy from Ebay again either.
