Centex Home Equity rip-off! I want my over-payment back. Dallas Texas

In July 2003 we refinanced with Centex Home Equity. The first rip-off came when we found AFTER the loan closed that we were paying points to "buy down" our interest rate. We could've saved $12,000 and our rate wasn't all that great. In November 2003, we got an offer from another brokerage firm and decided to refinance again. December was a difficult month for us and the extra money would've come in handy since I was having major brain surgery.

The loan didn't close in December as hoped but we still made our house payment. January came along and we couldn't make our pymt to Centex. Made it on Jan. 30th, 2004 thinking that we were closing the next day or so. My check would've cleared. Well, there was another problem in closing with the new lender so my check returned to Centex. During this time the loan closed with interest from Jan. 1 2004 through Feb. 28. They had received everything that I owed plus more! My 1/1/04 payment was taken care of through the interest. There was no need to send them more.

I also received my escrow account (minus January) but in order to save my account they should've taken the escrow account and made my jan. payment. They did not. OK, I received the escrow money. They received the payoff on the 12th of Feb. I need to find out if the money was wired because if it was then they received the money Feb. 6. I remember that week very well because I was in L.A. for an MRI and barely had enough money to make it home! Plus it's marked on my calendar.

Two weeks later I get a call saying I needed to pay an extra $1008.14 and it needed to be wired right away in order to record docs. They said they didn't have enough money to close the loan. I wired it. AFTER I wired the money it seemed odd that they needed more. I called the new mortgage lender and she looked over everthing. I did indeed overpay Centex. She called them for me and said that they were going to send me the overage.

I have yet to see any money. I called today and was told that they sent me overage already of .86 cents. There are so many discrepencies as far as dates and amounts here that you could get your head spinning with it all! There's more but Centex has no intention of paying me back! I'm really irritated and should've listened to my gut feeling back in July when we were looking for a lender. Centex didn't give me a good feeling.

They still haven't sent me a copy of my appraisal and after the loan closed no one ever returned my calls. They had my money so that was that. The customer service dept is rude as well. They could care less about you or your problems. They are taught to just take the money and run. I want my money back! What can I do?? I want an accounting as to how they applied my money for the last 6 months. I'm not getting it because my loan is now closed! I want my over payment back! HELP!! That would help pay my hospital bill from December!
