Greetings, Jan 08, I purchased a brand new 07 Infiniti (M35x) and for over a year I fought with the Infiniti services team to address a rattling, pinging, rocks in a can issue coming from the exhaust system beneath the front of the car. Finally it took the regional manager to come down after filing two complaints with the inter-circle consumer affairs department. From that point; it took both of us to go into the garage and actually have the tech take the "heat Shield" off and to our demise. 

Now; the new and current general manger for Charles Barker Infiniti tried to ease my pain recently by working a deal on a 09 (M35 Sport). I have owned this car roughly two weeks and again the rattling issue has returned. I have had an intermitted issue with the passenger mirror when putting the car in reverse and the AC in the seat hardly works in this car. Upon giving Charles Barker an attempt to resolve the issue on July 8th; I'm not only disappointed, but very dissatisfied because from one perspective I'm being told it's just how the engine sound on the cars and is normal, yet it doesn't happen on every car.

From another perspective; it was identified by tech as a rattle or pinging sound, but yet they cannot duplicate it on other models or fix the issue. Technician and though he here's the issue; when speaking with the service manager he then tells a slight different story or regurgitate it differently. I'm now looking to take legal action against Infiniti because "WE" as customer should NOT have to drive a $60 thousand dollar car with a rattling sound on acceleration. I no longer want the vehicle and looking to return it and/or take whatever measures necessary to square this matter away. This same sound has been experienced by many customers across the US; they either end up going back and forth with the tech teams.Details: Problem 07/06/09, Purchase 06/30/09, $56000, $855.00/mo., M35Sport, Sales person: Bobby Ford, Service mgr: Sharon hatter stock#18518

This is the following after the arbitration and call to the BBB with fact os email to representative handling my case.

Mister Hernandez, I have several concerns because I contacted your office several days following the arbitration. Also, I have recently contacted your office about the issues that have worsened. * Days after the arbitration I went to Passport Infiniti and they found they needs to change out the "y-pipe" on the exhaust. * They also attempted a repair of the rear speaker deck and now I assume it has came a loose again, because the noise is back. * They still did not fix the rattle in the sunroof, due to time constraints * Several after receiving my car from the dealer, the whole exhaust system has been shaking and ratting. * I assume they did not put clamps and tighten the pipes accordingly. Call the Barker Infiniti but they cannot get me in till 12/17. * Now the car hiss and makes the rattling sound even more and I assume it's due to the weight of the of the exhaust system hanging lose. * The arbitrator made a decision without some of his notes that were mixed in with mind. * He also states he did not hear the sounds from the exhaust as everyone else in the car. * Even the admitted he heard the slight difference as he puts it. * The arbitrator did not acknowledge the fact I brought reports from dealers and consumers who have had the issue fixed. * The arbitrator only mentions that Mister Gettler brought in documents and the exhaust and the engine * We have to call attention to the arbitrator hearing because he did not here any of the sounds that everyone in the car heard. * This arbitration appears to have some type of bias as it appears that Mister Gettler and the arbitrator have worked together before. I will be pursuing this matter further by contacting consumer affairs and the justice system. There needs to be some action taken against dealers as such for the quality of work and having someone in the corner of the consumer. Because now my car is worst than before with louder noise and the ENTIRE exhaust system is hanging lose. Noting the dealer can only see me on December 18 to repair the issue. Now, there are possible stress fractures in the exhaust system which could be giving off the hissing sound on top of the rattling during acceleration now. The rear exhaust section of the vehicle is knocking around every time I hit bumps in the road. This is unacceptable and will local media stations about this matter. Lastly, I have contacted your office twice and left a message for you and no one has returned my call.

You said "Jan 08, I purchased a brand new 07 Infiniti (M35x)" Then because of the "noise", "Charles Barker Infiniti tried to ease my pain recently by working a deal on a 09 (M35 Sport)."

You have had this new car for two weeks and it is making the noise? 

Now this one, you also say it is not only making the same noise BUT "I have had an intermitted issue with the passenger mirror when putting the car in reverse and the AC in the seat hardly works in this car." 

My guess is you are trying to get out of the $855 a month car payment.

To date; the exhaust issue still remains and worsens as time goes on. All of the research done me and issues reported across the country. Still, when do we find that the customer is ever right about an issue when going up against a car dealership? Granted; the sales people and the service managers are little guys who do their jobs and attend to the needs of the customer. For which I have no problems are complaints about them, because they have tried to understand my pain with this issue on my new vehicle and have gone the extra mile to try make things are done a sthey should be.  But its the quality of a purchase and the ability to have an issue resolved if one arises. IN my case this vehicle has been there more than 3 consecutive times for the same issue. Also and as of 7 or 8 days ago, I made my second visit for the noisy rattle/squeaking sound of the sunroof when the rear half is open. So what happens the second time around; the tech rides with me and in a matter of seconds he hears the sound, but cannot absolutely identify where its coming from. We arrive back to the dealership and in a matter of 12 minutes my car was ready after they lube or tweaked something. Was the issue resolved; NO IT WASNT! I called the services manager back with in 2 minutes of leaving and told her to record this and that I didnt have any more time to waste their and that I bring this up when we go to mediation or arbitration. Now, I finally receive a call today from the BBB and Infiniti to do a buy back, so now we are going to arbitration and you best believe all issues are going to come up. Because the quality control of the vehicles are not up to par. Nor do I believe the technicians are fully doing their jobs, outside making visible assumptions. Im sure they are not putting in effort into researching issues; because if that was the case. On my first vehicle, it would not have taken several months to resolve issue when the regional rep and myself actually when to research and found the problems ourselves.
