I will be short. This is run around world and Chase never listens to what you say. My Mother in law passed away following a stroke in Feb 2005. In March we tried to work with Chase to either assume the lease or dispose of the vehicle. They refuses but yet called us when a payment was not made. We (no legal obligation) made the payments from March 2005 thru April 2006. We wanted to assume the lease and acquire the vehicle. They would not talk to us.

We went to the dealer the car was obtained from. They told us to surrender the vehicle to them or to another Toyota dealer. We did this. Chase told us that Mall of GA Toyota did not exist. They do.

Now i get a letter of repossession. This is crap. We tried to work with Chase and they snubbed us. Now they want to persecute us.

I have written them a letter demanding they back off. I no longer want the vehicle no to do business with them. I have obtained council and ready to go to court if they post a negative item on my wife's credit account (who the letter was addressed to). I am also going to copy the letter to the dealers involved and the FTC.

I am angry.

Today when i called the toll free number i was told i needed to call a west coast office. I did asking for a fax number to send an advanced coy of the letter. They have as now not provided me an address to mail the hard copy or a fax number to send the advanced copy.

I will set up informational pickets at dealers who use Chase telling their customer not use Chase if this issue is not resolved by 7-15-2006.

issue settled

We reached a settlement with Chase that was good for us and tehm. The probate office for Chase in Arizona ended up with this issue and was an angel - she understood the issue, proposed a settlement, whcih we accepted and she walked it through thier process.

I should have updated this Last August / September when we settled but forgot i had this posting.

You really don't need to do anything now except forward that repo letter to your mom. Only if they try to collect from you or some other family member or put bad reports on your credit need you get upset and take further action.

It would be good to notify them in writing by certified mail that the former car lessee is deceased and there was no estate if that is the case. Did you get something in writing from the dealer saying you surrendered the car to them? Forward a copy to Chase. If you still have the car at your house you can tell them where to pick it up and start charging them to store it until they do.

Don't lease cars thru third-party finance companies in any case. Even if you don't die there are a lot of problems with that arrangement. Use only the finance company that is owned by the car's manufacturer. At least they know where all their dealers are.

Chase?

THis morning at 9AM EST I called Chase Probate Department to request a Fax number to send an dadvanced copy of a letter as a reult of their Repossession letter. I was first told they do not accept faxes and when i threatened to hav emy Lawyer called they said we will get back to you as soon as someone gets into teh office. Well, now 6:30PM and still no fax number! They lied to me again.

Chase is coming after YOU?

Let me see if I understand - your mother had a leased car with Chase, and she died. Chase repossessed the car and is coming after YOU - personally - for the deficiency?

If that is the case, then Chase has a problem - you are not the guarantor of the lease. If mom had an Estate they may be able to go after mom's estate's assets for the deficiency - but not your assets or you personally.

The fun will really begin when Chase charges thed ebt off (after all, I doubt Mom will pay it) and sends it off to a Collection Agency or Junk Debt Buyer. These companies very well may try to get you to pay it. If that is the case, I suggest you go to some of the Consumer Credit Boards (Debtorboards, Creditnet and Creditboards are three good ones) and bone up on Fair Debt Collection Practices Act. The CA or JDB may be paying YOU if you play your cards right.
