When you and I finally came to an agreement, I felt very ashamed.I became more ashamed with every email you sent me. There was definitely something missing from our original dealings. I have certainly learned a lesson in the last few months. I hope we both have. Most divorces are due to lack of communication and you and I went through an extremely difficult time due to that reason.

You went above and beyond when it came time for a settlement Debra. Not only did you refund my purchase price, but you also gave me money for medical bills. BUT you did not stop there. On top of all that, you offered me that little female pup that we have been wanting for a very long time now.

You say I did not mention if I would ever get a pup from you again. YES. I would love to have another pup from you . After all, you were the breeder I went to in the first place.

I DO love your website. I have many websites that I view on a daily basis. Yours is one of them. Y It is unfortunate that I cannot 'erase' ripoff. My apologies to you.

There are always TWO sides to a story. You and I were in WWIII and not seeing the other side.

I think that was is happening here is one of the saddest stories I have ever heard. Does this lady not have a conscience? Not only is she 3000.00 dollars richer but she off-loaded a sick puppy onto you. If that puppy were not sold it would have been her problem. How would she like to pay all of those bills?

Do not give up. My suggestion is to continue hounding all of the agencies that might be able to help.

After reading about your problem I did some research.

California does have a strict lemon law on the sale of dogs. Pursue it by any means available to you.

Hydrocephalus is a fatal congenital defect as you said.

I think she is doing this to you because you live so far away. You can't just knock on her door and demand your money back.

I have read that California has one of the strictest puppy lemon laws of any state. I know for a fact that no sales contract will out do the lemon law in any court. Just like if you buy a car in California. Does not matter that you signed a contract does not matter if the guy told you the engine is ready to blow the car still falls under the lemon law. If the breeder did her homework, her sales contract would almost appear like the lemon law.

I would contact the Attorney Generals office they will open and file a case for you without you being present.

Also the good part about that is you can also claim pain and suffering, mental anguish, all funds used for vet, transportation including time spent traveling, including airfare if you must attend a court hearing in the USA and attorney fees. I am not sure if you can open a court case in Canada and make her come to you or not. I think with how strict the lemon law is in Ca. you may want to fly here.

Good luck to you. I would think it would be in the best interest of the breeder to refund all moneys you paid. I am pretty sure you can sue her up to 150% of the cost of the dog and that does not include all attorney fees, travel charges, plus like I mentioned mental anguish. to a maximum of 5000.00 (I think)

I have asked this family several times for medical records to show proof of said defect. As of 8/06/05 I have not received such.They have had the puppy for three months already!



Even without proof of said claimed defect I emailed her we will cover the puppy for three years or lifetime for disabiltiy or death from Hydrocepalus.



She went balistic on me after I sent her that email. I saved the email if anyone wants to see it.She demanded another puppy ASAP and I told her that IF her current puppy died within THREE YEARS I would send her another.



The reason I chose to hold off on sending her a puppy ASAP was that I had no medical records received at all on the puppy she claimed was defective.



What I DID have was an email last week

desribing a happy playful healthy puppy!!So I thought since he is acting happy and fine that perhaps he was fine!



UNTIL I COULD SEE MEDICAL RECORDS HOW WOULD I KNOW FOR SURE.



Should a breeder have made all decisions on what to do BEFORE any kind of medical proof was given ?



Should a Breeder have just sent her another puppy like she demanded ASAP........BEFORE even seeing proof of defect in the puppy sold to her ?



It has been three months and I haven't any medical records or letter from Vet...nothing at all.



Dont't we have the right to some kind of proof of defect?We have never in my decade of breeding,ever sold a puppy with a fatal defect.



I do not beleive her puppy has a fatal defect. Her vet hasnt contacted me! Client hasn' sent me any medical records at all.

I would contact the General Attorney's office and report her as fraud, also, it wouldn't hurt to contact the local animal regulation department. They may be able to locate her and shut her down.



It's a crime for any person to breed unhealthy animals, sell and have no remorse for their actions.
