We bought a new HP laptop from Circuit City # 3511 in Aug. 03 for my daughter to attend LSU. We paid $1,684.01. It crashed Dec. 03. We sent it off and after about a month they repaired it and sent it back. Same thing again in Jan. 04. Now the third time Jan 05, her first day back for this semester the hard drive is failing AGAIN.

Now City Advantage nor Circuit City will honor the warranty for which we paid 194.99 plus tax. They have given me the run-around since Jan. 18th. When we purchased this laptop and our salesman insisted we needed this warranty because they would REPLACE it if it failed 3 times within the warranty period. They LIED!

My daughter has worked hard to get into this university and to maintain her 4.0 GPA. She also takes notes from classes on her laptop and e-mails them to a deaf student. She is unable to use this laptop that I still owe 1 payment on and I have been ripped off by CIRCUIT CITY and CITY ADVANTAGE.

I am now preparing to file suit in court to recover costs on this nonfunctioning laptop.

I never contended that it was Circuit City's fault that the 2 laptops were defective. Only that THEY sold me the warranty with the words "If the SAME THING goes wrong 3 times within the warranty period, we will replace it with no hassle". After the 3rd time of hard drive failure, I expected CC to honor their promise. They did not. No need for future reference because I will NEVER buy another product from Circuit City and I will NEVER buy another HP product either. So Goodbye and good luck to everyone who has the misfortune to give these companies your hard earned money.

Just for future reference ma'am, HP sent the DV1300 Series to all the consumer stores as well as sells that series on their website

It's not Circuit City's fault that your laptops were defective, we don't make them...

CONSUMER PREVAILS!

Finally after weeks of ongoing negotiations we were able to prevail. Our money was refunded for the useless service contract that we purchased, and we were able to "compromise" with a CC gift card (which I hated to accept because it meant spending MORE money at CC), and a check for half of the court costs for our filing fees. I would advise everyone who has been ripped off by Circuit City to just go ahead and file suit. It may cost you but without spending more money you will NEVER prevail. The only way to get their attention is with an attorney! By the way, the new HP Laptop that we bought with the gift card, broke within 2 WEEKS and neither laptop had ever been dropped. HP contends that the hard drives on both laptops were defective. Now I read on Yahoo that HP has a recall for the battery packs on a number of laptops and guess what-my daughter has one of the defective battery packs. Does this surprise me? No-because now I know that Circuit City buys this HP CRAP because they go so well together. NEVER BUY AT CIRCUIT CITY AND NEVER BUY HEWLETT PACKARD PRODUCTS. Heather, Chris, Alex and all you other rude jokers who defend CC and bash all consumers will one day be in our position and what goes around, comes around. Cost of filing suit: $130.00 Cost of making Circuit City honor their warranty: PRICELESS!!

What is the nature of your complaint? Why did CC refuse to honor the contract? Did you daughter drop it? Can you please characterize the nature of the malfunction? This way maybe I can help you understand why CC did what they did.

My suit was filed against Circuit City February 17, 2005! It may not help but it sure made me feel a lot better! Maybe if enough of their "former" customers follow up with legal action, it may help others in the long run. Thanks to all who do not just accept Circuit City's lies and deceit.
