On December 30th I bought a Toshiba Qosmio computer (stock number G25-AV513) i also purchased the 2 year warranty that included accidental damage and any service. When i got it home (after haveing the $100 CC service package installed) I found the Right speaker blown and the Operateing system was glitchy.

I took it back within half an hour of picking it up and asked to return it. I was told that i could return it for a full refund, minus my $100 service pack charge. While doing so i ended up talking to Michael in tech service. He agreed that the particular computer was a lemon and said that if i wanted to he would have a new one shipped in from another store ASAP. I agreed that this was a great idea.

When i went to confirm this at customer service i dealt with the store manager (Danny). After two and a half hours of trying to exchange the product Danny finally said "I dont believe that there is anything wrong with this computer and i dont want to drive out to the South County store and pick a new one up because i think your going to just return that one too." When he said that, after trying to return it for 2.5 hours, i said fine, just give me my money back.

He then proceded to tell me that it was going to be a $300 restocking fee because it had been taken out of the original packageing (The circuit city tech support crew took it out and i had it at my house less than an hour.) Also, when i first came in to return it i asked the young woman at the counter ( i can not remember her name) if there would be a return fee and she told me that there would not be.

I understand that the $100 service pack charge is non-refundable, but to be smacked with a $300 return fee because i received a bad product is unacceptable. In addition to that i do not feel that the afforementioned statment by the manager, Danny, was necessary or in line with good customer service.

If you purchased a car and took it home, then found out the air conditioning didnt work, the manufacturer told you it was a common problem, and the dealer treated you like this CC store treated this poster.....YOU WOULDNT WANT THE CAR EITHER!

They had a blown speaker!

THE OS WAS NOT WORKING!


Are you saying "tough luck" your stuck with it??

Good lord man! Your house must be full of broken and non-functioning products you have collected over the years that your just happy and content to sit with. All of which have been that way since the day you bought them.


The manager even told this person that he didnt want to give them another one because "they would return that one too".

Are you totally obvlivious to these facts?

Why should this person pay $300 for a computer that they have only seen a malfunctioning example of? And the manager refused to show, give, or sell them a functioning one.

This is the exact quote of the manager.....

"I dont believe that there is anything wrong with this computer and i dont want to drive out to the South County store and pick a new one up because i think your going to just return that one too"

A BLOWN SPEAKER!?

POORLY FUNCTIONING OS!??

This poster clearly was willing to just exchange it for the SAME product and the manager decided that this customer didnt deserve a fully functioning product for the money they spent.

How you can possibly call this fair or even ethical is beyond me. This manager clearly dropped the ball, and kicked it out of reality.

It seems by his post that the manager was cool with an exchange. I dont get why people dont understand that when you buy a computer, you buy a computer! I'm gonna go back the car dealership and tell them I changed my mind and that I dont want my car anymore...

I clearly saw the non-refundable part of the issue. I only suggested adding that to the claim in court because it is the only form of punishment you MIGHT be able to get for your hassle. As I stated, asking for gas milage and time off from work never flies well with the courts. Obviously the most important part is getting your $300 back for the restocking fee. How in the hell Circuit City maintains that it is going to "restock" a computer with a blown speaker and messed up OS is beyond me.

Good lord man!!! They DID go back to the store! How do you think this person got tapped for $300 in the restocking fee for a DEFECTIVE PRODUCT?! Something which you have maintained "never happens" yet time and time again another person gets hit with and posts on this site about.

Take these crooks to court! They STOLE $300 from you for a "restocking" fee on a product that they will never "restock". And if they do, then you know just what kind of scam they really are running. I feel even more sorry for the person who gets this "restocked" computer in the future.

I have just two things to say to Ben. 1. I clearly state that i understand the $100 service was non refundable and want just the $300 restocking fee back. and 2. I bought the computer IN PERSON AT THE STORE.

Why didnt you just drive out to that store to pick it up? It seems that would have saved you some trouble. And I dont know why you think labor should be refunded. If you go to the dentist and he fills your cavity can you just say "I changed my mind, I dont want my cavity filled" and expect a refund?!

Ben for the love of everything holy WHY?! This is a problem with every computer reseller, get over it!

Your situation is typical of Circuit City. By all means, look at all the other Circuit City threads on this site. You will see many that match your situation almost exactly.

Dont even waste your time trying to settle this with Circuit City direct or with their corporate offices. You will get NO satisfaction. I assume by the amount of the restocking fee that your computer was in the $1500+ range. For that reason I would immeadiately file in small claims court. File for all the money involved including the supposed non-refundable $100. Do not ask for penalties and especially DO NOT ask for reimbursment for things like travel expenses, lost wages due to missing work etc. Courts dont pay attention to that, and often are quite hostile to your case if you do.

If you do finally settle on this route, please continue to post your experience here on this thread so all can see what has happened.

BUT....be prepared!

If you do a search on Circuit City here on this site and look at the responses over the past few months you will see a distinct pattern of abuse by Circuit City employees. I have no doubt that they WILL post on this report soon. If they have not done so already (at the time I'm typing this, there have been no responses or rebuttles posted).

Their responses will be harsh and outright mean at times. They will focus first off on the "our policy is posted" excuse first most likely. They will completely ignore and never respond to the fact that you clearly stated in your original post "I was told that i could return it for a full refund" and "i asked the young woman at the counter if there would be a return fee and she told me that there would not be". They will act as if you never said it, thus didnt read their "posted" policy, and have no right to complain. If you attempt to continue to hold to your story they will just repeat like a broken record "our policy is posted". I have even tried to argue this out (since the policy is NOT posted at the store near me!) to no avail.

There next line of attack (or should I say deflect?) will be to outright call you a liar for even suggesting that they charged you a restocking fee for a defective item. They will just simply say "nope...couldnt happen...we dont do that". Totally ignoring the fact that you along with many many others have posted this exact same tactic by Circuit City. And it obviously HAPPENED!! Somehow they seem to think that people just wake up one morning and decide to make up a long complex story about Circuit City ripping them off over a restocking fee. It can get quite amazing the blatant pathetic excuses they try to hide behind. Some will even go as far as saying they were trying to "help" right after they call you a liar, a crook, and a cheat.

So be prepared! Both in court....and here.

restocking fee not on exchange

The manager can say all he wants, he is trying to bully you. he HAS to exchange it within the 14 days. There is a 10% restocking fee but only on RETURNED pcs, not exchanged. Demand that he exchange it, and ask for the "cool line", an 800 numbers that will get you results
