I'm experiencing the same thing as other reports on this site regarding Circuit City not honering thier lemon warranty. I purchased a Sony XBR 50" rear projection tv from CC on 10/22/05. I purchased the extended warranty when I bought the tv, it cost me $569.99 plus tax $600.00 bucks for all intense purpose. My tv has had 4 repairs not including the 6 lamps that have been replaced in 3 years. First the optical block and the lamp had to be replaced, that was in Aug. of 2006. Next, int Oct. of 2007, it stopped working and CC sent an outside repair co. out and they said they would have to take it to thier shop to do the repair. They replaced a power supply and the lamp balast and another lamp. When they (radio,tv, and appliance) brought it back, they just ploped it down in my family rm. and left. When I came home I was very happy to see it because it had been at the repair shop for almost 2 months. After reconnecting it, to my suprise, it STILL didn't work. I called RTA and they said it would be 2 weeks before the could come back to check it out. I said NO WAY I was waiting 2 weeks and they said they would see what they could do. I received a call from one of thier techs the next day and he went out of his way to come the following day. The tech informed me that what they had fixed was fine and it was another problem. A cooling fan had gone bad and he would have to order the new part. At this time I was very angry!. The tech said he could "rig up" another brand of fan just so I could utilize the tv until the part came in. I reluctant agreed because I wanted my tv after not having it for so long. Next in Nov. of 2008, the tv started blinking on and off every 2-3 minutes. I called CC AGAIN, they sent out a tech 2 weeks later and guess what?!. The same cooling fan had gone out again! At this point I called CC back and said that I wanted my tv replace under the no lemon garr. They said a case manager would call me within 48 hours to process the claim. 2 1/2 WEEKS LATER, I finally got a call from a person named Morgan (which convienently was the day after the tv was fixed) and she said they don't replace tv's that are working. I told her that I had instructed the tech not to even fix the tv because it qualified for the no lemon garr. and they would be spending money on a part that wasn't necessary. The tech said that they would fix it anyway and that in no way would impact the no lemon garr. Morgan then said she would check with some other manager and call me back within 2 days. I waited a week and called her back and left her a 10 minute message. She called me back after the weekend and said if the tech had to order a part ( because I had called in another service call because of yet another problem) that she would authorize a replacement. I am PISSED!!!!! It already qualifies for the replacement without this repair! So, obviously she is giving me the complete run around. I have had it with Circuit city! I am writing this report, I am contacting my local news station (action 9 whom investigates issues like this), and I am contacting an attorney to bring a lawsuit angainst CC. All they have to do is honer THIER warranty! I'm going to copy a paragraph that is in my sunday newspaper Circuit city flyer, right on the first page, and I quote, "

"To our valued guests,

You may have seen CC in the news recently. Our co. has a 60 year long history of leadership in consumer electronics retailing, but we've struggled lately, in part because we lost sight of what is most important- YOU our customers.
I am personaly commited to making sure that CC makes you our top priorty and we intent to give you many reasons to shop with us again. We have been taking steps to provide a much better store experience and we believe you will see a different CC when you visit us this holiday season. CC "Advantage Protection Plans" are offered by a third party company and are not impacted by transistions in CC's business. Most importantly, we will continue to do everthing we can to make it easier and more enjoyable for you to shop at CC. You have my word on that.

On behalf of all of us at CC, I want to personally thank you for standing by us. We are working hard to earn back your business and keep it by providing a superior level of service.

Sincerely,

Jim Marcum
Vice chairman
Circuit city stores " End quote

I'm going to write Mr. Marcum a personal letter when I'm done with report and make sure he is aware of the level of service (or lack there of) I'm receiving from his company.
