I purchased a brand new computer from the Circuit City store in Salisbury, NC . The computer didn't work upon installation and they refuse to give me my full refund. They want to charge me a restocking fee when its not even our fault the computer doesn't work and they don't have a replacement!

Circuit City in Salisbury NC is a complete rip off! On saturday night...the night before the super bowl...I went to the Circuit CIty to buy a new computer and some other computer hardware. My total was nearly $1600; The store didn't physically have the computer I wanted. They had a display but said they could not sell it. My husband had to drive to Concord, NC to personally pick up a computer that we had pre-paid for in Salisbury..the next day..which was sunday. The day of the super bowl. We didn't have time to install the computer on sunday...but my husband did take the computer out of the box on monday morning and began to install it. Right away, there was a problem. The screen shot said there had a been a problem due to software of hardware changes even though none, from us, had been made.

I immediately called the store and was told to bring the computer in for them to look at it. My husband took the computer and all of the things we bought to the store the next morning. He works second shift and could not take it Monday afternoon. Sheena, the operations manager, said they didn't have any more computers like the one I bought in their store and she would not give my husband a full refund even though we paid in cash. She wanted to charge my husband a RESTOCKING FEE!!!!!!!!!!!! That was sheer nonsense! A restocking fee for what?????? Because a product we bought doesn't work and they don't have a replacement???? Sheena was very rude to my husband. My husband was given a corporate phone number only to be told by a woman that our issue was a "store issue" and not a "circuit city" issue. Say what??? They ARE circuit city at their corporate office, right? My husband asked to speak to HER boss and she hung up on my husband! WE are now out nearly $1600 and in possession of a product that doesn't work and that we paid cash for. I feel that Circuit City deliberately rips people off when they buy their products with this nonsensical RESTOCKING FEE!!!!!! My next step is the BBB, Consumer Affairs and Court if necessary! I refuse to pay a restocking charge when it is NOT our fault the computer doesn't work. I purchased a product in good faith that was suppose to be functional and brand new! Not a broken piece of crap that doesn't work and now I am out money because they have to "restock" IT??????? Why would they restock a computer that is obviously NOT functioning???? WOuldn't that be an issue for the person who bought it AFTER me???

Circuit City Restocking Fees

I am the person who originally posted my rip off complaint for the Circuit City Salisbury, NC store. I believe this store and Circuit City in general get away with the restocking fee because many just take their money, minus the restocking fee, and leave it at that.

It's unfair to charge a consumer a restocking fee if they don't have a replacement product that is identical to what the consumer originally purchased and the purchased product is either damaged (in the box) or is defective. Which happens to be my case.

I should not have to wait for them to obtain the product from another store which takes them several days. I should be allowed my money back in full so that I can go, that very day, somewhere else and purchase what I originally wanted in the the first place.

The restocking fee is a method for Circuit City to make further profits on their merchandise even though all that is involved with defective merchandise is to either resell it "as is" (an open box sell) or retape it and send it back to the manufacturer for a replacement and then resell the replacement.

Either way, they are making their money back. We placed the computer back in its original box and packaging so there is no extra work for Circuit City to perform other than a strip of box tape.

I totally agree with your situation as I was a former employee of the company reported. I do agree on restocking fee's on high dollar products if the consumer returns it and does not wish to take an exchange. However, when there is no exchange available, the consumer should get a full refund. After all, it's not their fault the product isnt in stalk.

Pursuing the issue with the BBB and court is your own call. However, I would definately recommend that you return the product to the store and take the restocking fee, so that you will at least have some of your money back. Maybe later you can get the restocking fee refunded in the even that you win a court case or something.
