I made a trip to my local Circuit City store after seeing a great deal on a nice home theatre system (Denon DHT487DV) in the Sunday paper weekly circular ad.

I went to the customer service area after not seeing the item in stock and informed them of my intent to purchase. After 20 minutes or so, the CS person along with the assistant mgr realized that this was a pricing error and refused to sell me the item at the listed price. I asked to speak with the store mgr and as he came out, he also was carrying the "freshly printed" sign to post around the store of the mistake.

I feel that it should have been honored since no signs were posted. I had a friend that worked at this store and had him call the manager today about this and the mgr told him that the signs were posted the day before I came in there which I know for a fact was a lie because prior to me going to customer service, I searched the entire store for any kind of sign due to this being such a great deal. I am assuming that the store is trying to CYA.

I have filed a complaint with the Better Business Bureau local office, however, I am wondering if I may have some type of case (bait and switch, false advertisement, etc.). I have also contacted the corporate office of the store and was transferred to the regional mgr, left message, however, have not heard back yet. Any help would be appreciated.

The Store Manager by the name of Don Gillis was the one that came out with the printed items to post. I told him that I felt that he should be obligated to sell this item at the listed price. He informed me that he "would not" sell it to me. The bad thing is that I spent almost $3,000 at this same store just under a month ago on a new plasma tv and mentioned this to the mgr and he replied with a very condescending statement of "and we appreciate your business". I then asked what he could do for me and he replied with "I am not obligated to do anything".

Can you believe that someone in customer service, especially a manager would say something like that ?

Price was supposed to be 599 but was in the ad for 299. Also, an update to this article. The regional mgr called me and said that he could give it to me for what the employee discount was. It was very close to the mistaken ad, so I bought it.

At least at the 2 local Circuit City stores in my area. If the online price was still the cheaper, they maybe buying it online, and selecting in-store pickup would have enabled you to get it for the cheaper price.

As for "bait and switch,' it does not meet the definition. They did not offer to sell you another product, and say that it was out of stock.

As for false advertising, it is kind of a gray area. Mistakes do indeed happen. But usually they know right away, and post the info before the store opens.

As for the managers comments, without being there and seeing the whole thing transpire, I can not comment on that.

Just out of curiosity...how much of a price difference was it?

have you tried ordering online with in store pick-up

I often will order things I want online with in store pick-up at my local circuit city. This ensures that the item I want will be in stock when I arrive at my local store. It also insures that I get the advertised sale price. Maybe you can go around the incompetent manager by using his company's website to get the system at the advertised price. I hope this helps!

(((competitor's name redacted))) includes "not responsible for typographical error" in their ads; Circuit City does not.

That doesn't change the law, it does make it easier to cool off the customer when management points it out.

Put yourself in their shoes. If you took out an ad in the newspaper to sell you 2001 model car, but a typo made the ad say a 2007 model, do you think you would be obligated to sell a 2007 car? Your obligation should be limited to correcting the ad as soon aas you found out about the error. Likewise for them, and it sounds like they did.

Maybe the manager could have offered you a few bucks off in light of your previous plasma TV purchase (unless you got a great deal), but he didn't. It's hard to know why without also knowing your attitude at the time, or how much of a pricing error you were asking for.

Thanks for the input. I thought about the fine print, so checked out the ad and the only thing printed that was in fine print was about the "no interest financing". The funny thing about all of this is as of this morning 2/27/2007, on Circuit City's website, the ad still shows incorrectly. I would think that if it was a true pricing error, that the company would want it fixed immediately.

Now if you went in and they had tried to switch you to something else, you could have a "Bait & Switch" case. But as far as I know the law does not prohibit errors in advertisements.
