It is infuriating to see how much power credit card companies are given. Recently, we received numerous phone calls from a collections agency saying that our account from citibank had been turned over to them. To better understand the situation this credit card had a balance of $1500 and my husband had not used it in years. It was a leftover balance from his college years. He had been paying the minimum monthly fee for several months and it was being directly deducted from his bank account. So as one could imagine receiving this phone call was pretty upsetting. We had statements to prove we had been paying yet when we tried to contact them to ask why it had been turned over, they refused to talk to us about it and basically stated, "We don't care it is not our problem anymore." We paid it off the next day in the settlement amount offered to us by the collections agency and are now working on getting the "bad debt" history cleared from my husbands record. It disgusts me to see them get away with this and that there is nothing we can do about it. They can ruin someones life and not even blink an eye. In Conclusion, these people are the scum of the earth.

YOU are mistaken. I suggest you read the Fair Credit Reporting Act. The CURRENT CREDITOR may indeed change/delete a credit line with the CRAs. The CURRENT CREDITOR does NOT have to be the original creditor.

Please use a tad more accuracy with your postings.

Did the collection agency tell you that they remove the negative from credit report?

For one - THEY CANNOT DO IT -NO DEBT COLLECTOR HAS THE ABILITY TO REMOVE NEGATIVES FROM YOUR CREDIT REPORT. IF THEY TOLD YOU THAT LIED! ONLY THE ORIGINAL CREDITOR CAN DO THAT.

IF you had been paying against the account and Citibank sent it to collections anyway - they ARE REQUIRED TO FIX IT. They won't unless you file complaints with the Office of Thrift Supervision. The OTS will investigate and would have forced Citi to remove it from collections since you have been paying it and can prove that.


Just because you paid the collection agency - does not mean this has gone away.
more than likely it was sold as JUNK DEBT. The Collection agency paid pennies for it and made a lot of money off of you.

I have learned the following from past experience:

Sometimes when you have a delinquent account that you resume payment on, the original creditor decides it's not worth their effort to keep collecting the payments. Especially if the payments are not very large (you stated he was making the minimum monthly payments). So, the original creditor either turns it over to a collection agency to service, where they pay the collection agency to collect the money. Or, the original creditor may sell it to the collection agency and not be bothered with it.

Has the collection agency listed it on your credit report? Or just the original creditor? Many times if you are making payments before it gets reported by the collection agency, they will hold off reporting it. Did the account fall off the credit report, then get re-reported? Has the account been listed as a delinquent account all this time on the credit report? Is it being reported incorrectly? What exactly are they trying to get away with? Paying the account usually only results in a zero balance, but the bad info still remains. You might have been able to negotiate the bad info reporting before you settled, but it's hard to negotiate after they have your money.

One more thing. Here's something that has happened to me, twice, and I was able to get it fixed. I paid off a hospital bill to a collection agency. In the beginning, we agreed that as long as I made my monthly payments, they would not report the collection to the bureaus. When it got paid off, the collection agency forgot they never reported the bad debt, so they updated the account to show it was paid. Since there was not an account to "update" it basically reported the collection as a paid collection and my score dropped. I called the collection agency to tell them they did not have to report the debt as paid because they never reported the debt as unpaid, and could they please delete the entry. They did.

Now that you have settled it, make sure the original creditor shows a zero balance on your credit report. Also make sure you get a letter of satisfaction from the collection agency that they received your money and your balance is zero. You may need it in the future. It may be difficult to actually get the bad credit reporting from the original creditor off your credit report since it is technically a bad debt that was paid.
