In 2002 we refinanced our home through CitiFinancial. In May 2003 we were hit by a tornado and had $39,000 damages. Our basement was flooded. We filed claims with our homeowner's insurance. They began to pay us and we started to have repairs done. One check was for $11,000 made payable to me and my husband (since we paid our insurance premiums direct and not through our mortgage co.) with a notation of CitiFinancial on the side, for us to show the manager and have him sign off that we were having repairs made.

(FEMA had come in and inspected our home and said it was not safe for me to be inside since I have Asthma-due to the amount of water damage in the basement. He said it needed to be repaired ASAP and the wet carpet removed because mold and mildew were getting bad and it could be fatal to me.)**

Citifinancial's manager was rude to me and yelled at me and took the check from my hands (with people all around the office seeing this) and said he was going to deposit the check into Citifinancial accounts. (My husband and I had already signed it since we were on our way to the bank to deposit it so the windows could be ordered and the new carpet could be ordered and we had to pay a deposit to get this work started.)

The manager then called our insurance company and yelled at our agent and demanded that they pay the money to CitiFinancial. She explained to him that "we were the insured" and had to get the repairs done, and the only reason CitiFinancial was noted on the check was because the repairs were over $5,000 and the law states we have to notify the mortgage company of repairs being done. (After this incident, our homeowner's insurance cancelled us and said they would not be able to cover us any more.) Leaving us with $22,000 damages to pay for ourselves.

Citi's manager took the check and deposited it in CitiFinancial's account. He refused to give me a phone number for his Supervisor and told me my mortgage was no longer in his office. (We tried to get an extension of payments for 2 or 3 months due to tornado damage.) He held the money from May 2003 until August 2003. I had to get one of the contractor's to go to CitiFinancial with me to get $5,000 released to order the custom built windows we needed.

We had to try to pay for repairs ourselves. (I was also disabled in June 2003 due to a work related accident.)We used up our savings and sold some furniture to get repairs done.

Then in August 2003 I received a phone call from a girl in CitiFinancial's office telling me that she could lose her job if the manager knew she had called me, but she had to let me know what was "going on". She said our mortgage had been there all along and he was lying to us. She was sure he was trying to foreclose on us. We had to file Bankruptcy in Nov. 2003 to stop them.

Then in May 2004, CitiFinancial called us and said they were going to reduce our interest from 14.9% (it was supposed to be 13% but it was changed after we signed the paperwork to 14.9%), to 6% and reduce our monthly payments from $1533 to $854 a month. We waited from May 2004 until July 2004 and still no paperwork. They tried to Foreclose on us again. We had to file Bankruptcy again to stop it. We paid payments through Chapter 13 through July 2005. CitiFinancial called us and said we were "current on our payments" and they would work with us and we could make payments to them. We let our Bankruptcy be dismissed and tried to pay CitiFinancial again.

We were approved to refinance and CitiFinancial gave us three different payoffs, ranging from $73,000 to $144,000. The man on the phone said he was in their Loss Mitigation department and said "they would not allow us to refinance with anyone else". I told him he was not "God" and could not control us or what we did. He was rude, yelled at me and said "we just needed to let them have our home and be done with it." He caused us to not be able to refinance. The lender we were trying to use said he had never seen such a mess, and they could not refinance us unless we could get a legitamate payoff. That was in October and November 2005. They continued to transfer our mortgage again.

All this time since July 2005, they refused to accept our payments stating that "our mortgage was a mess and they could not accept a payment until it was corrected because the money would sit in a floating account until it was corrected." I tried to call every office from Coppel, Texas to Levittown, PA to Hanover, MD and was told the same thing.

(One bookkeeper sent me copies of our records and told me to get a lawyer because she had sent through more than 3 directives to correct our mortgage paperwork. Money was posted in 2005 that was paid through our Bankruptcy and then removed and put in their pocket in interest posted prior to our Bankruptcy filed Nov. 2003 and right after the tornado hit in May 2003.) We were current at that time, so there was no interest due. All this time we were still trying to get our home repaired little by little.

In March 2006 we hired a lawyer who contacted them by phone and letters disputing the amounts they were trying to charge us ($10,000 in legal fees) and stating we were in arrears over $25,000. He told them the fees were unreasonable and they had refused to accept payments and the amounts were wrong. A woman in their Loss Mitigation Department said she was going to "put our mortgage on hold" due to our property dispute with people we had already paid off and CitiFinancial could not Foreclose on us while we were in the property dispute lawsuit. Our lawyer tried to get them to accept $4,000 on our mortgage and she said it would be put on hold.

We did not hear anything else from them after May 2006 and our lawyer considered the matter settled.

Then in April 2007 they tried to Foreclose again and tried to say we were in arrears $41,000. We had to file Bankruptcy again to stop it. They did not even bother to send a lawyer or attend the Meeting of Creditors to discuss working out our mortgage. They did not contact our lawyer. We had to let Bankruptcy dismiss and now again are trying to get this worked out.

I talked with THEIR attorney this week and he said He will try to get us a legitimate payoff. He said they are preparing to try to Foreclose on us again.


We can't refinance due to the property dispute, or without a "legitimate payoff quote". With all the damages we had, it's taken all we had to get repairs done. CitiFinancial will not take repsponsibility for their actions or their employees actions. Someone in authority needs to.

I will not give up my home, and my husband and I will fight with everything we have to see Justice done. CitiFinancial and Citi Group were sued by the Federal Reserve Board of Governors in May 2004 or 2005 for Predatory Lending and CitiFinancial had to pay millions. I believe they need to be sued again and fined hundreds of millions.

We all need to stick together and contact the Federal Reserve Board and the State Comptroller's office of each individual State involved. I have already talked with a lawyer and I am going to bring it to his attention about a Class Action Lawsuit.

CitiFinancial has to be stopped. They have hurt thousands and thousands of people, taken homes they had no right to, caused people to be suicidal and destroyed families. They are greedy, hateful, and rude and obviously "train their employees" to be the same.

(I spoke with a woman in their Coppel, Tx office two days ago, and she did not know anything about our mortgage, yet had sent a letter to us to "Reinstatement, Adjustment of Terms, Adjustment of Loan, etc.,etc. I'm sure you all have gotten their form letter sent through the mail.) She then proceeded to tell me I needed to talk with their Legal Department, but could not give me a number to call them. She then gave me the name of the same lawyer I have talked to for the past 2 years.

In unity we can prevail. We cannot be "faint of heart", and have to perservere. We have to be diligent and fight for our homes and our families.

I am willing to talk with anyone who wants to get involved with this, and I have access to the best attorneys in the USA.

Citifinancial transferred our mortgage all over the country,Coppell, Texas

Today is July 6, 2008. After Citifinancial's attorney told me he was placing our mortgage foreclosure on hold in January 2008, he turned around and Foreclosed "behind our backs" without notifying us on Feb. 4, 2008. In fact, my husband and I were on the phone long distance with the Compliance Supervisor from their Baltimore, Maryland office on Feb. 5, 2008 and he was asking if they were working out the Adjustment of Terms and getting things straight for us. He did not even know that they had Foreclosed on us on Feb. 4, 2008. He collected info from me and stated he had copies of our Homeowner's Insurance checks that the Manager of the Clarksvill e, TN office had taken from me and held for 3 months from May 2003 until Aug. 2003 when we had tornado damage on May 5, 2003.

We only found out on Feb. 23 2008 when a Real Estate agent came to our home to try to get us to accept $1,000 early move out check. I explained to her what had happened, and she was shocked. She said she had been contacted by Citifinancial's Property Management office by email only to offer us the $1,000. I explained to her we were not going anywhere. We contacted our attorney to file suit against Citifinancial.

When we went to court, Citifinancial's attorney even admitted to our attorney that Citifinancial had no idea what our payoff was supposed to be
due to our mortgage being transferred all over the country and due to all the Bankruptcies we had to file to stop them from Foreclosing. He said he would go back to Citifinancial and see what he could get worked out and would get back to our attorney. That was a while back and we or our attorney still have not heard anything from them.

They stated that they Foreclosed for $128,000 which was "lower than the resale value of our property", but reported $69,000 on mine and my husband's credit reports. (The crazy thing is our property appraised at $160,000 in 2005 and is worth a lot more than that now.) They not only have the wrong information in our records, they have never posted any of the $23,000 payments we made to them since 2002 correctly.

Foreclosure put on hold, waiting for adjustment of terms

I contacted Citifinancial's attorney. He said he put the Foreclosure on hold for 30 days to get time to prepare the Adjustment of Terms.
He said he is sure he can get something worked out for us. Lower our payments and interest rate.

I am still waiting to hear back from ethics @ Citigroup. I sent them an email with my account number, details and my email address. Can you followup with them for me and contact me.

Ok, I have two things for you. you need to do the adjustment of terms asap, Monday

You need to write which is the place where your report was received.

Secondly, you need to do the adjustment of terms asap, Monday..... what that does is establish a comfortable payment that is less than what you are paying now by either adding months to your loan at the same rate you have now (but basically doesn't go over a 30 year loan, if this is what you have, they will probably keep the same amount of months) or lower your interest rate on the same amount of months you have left..... what this does is bring your account fully up to date..... interest wise, if you have late fees or add on fees (bad checks or something they had to pay on your account on behalf of you..... generally only bad checks or your home owner's insurance premium) they will remain on the account..... but you will be caught up!

An adjustment is not only a help but it is generally the best thing you could do to move on......... there is still no early payoff penalty and you will have a lower payment, generally due to a lower rate, which is essentially, money saved as if you started your loan out at a lower rate to begin with.....

You have to have the money in hand for the adjustment, have they approved you for the aot? Do you know what your payment is going to be? You need to pay that payment on Monday and sign the Adjustment, you need to do this before the end of the month, you need to go into the office first thing in the morning. They offered the adjustment because they do not want to foreclose on your home. You have to do this where your loan is financed...... if it is not in the office (because it is transferred to collections or foreclosure) and you are communicating via phone, get ahold of them Monday and get the paperwork, it is only a single signature..... it says your new payment, your new term and sign here, it is a legal and binding piece of paperwork and replaces your original note and disclosure , it will literally take a minute to do.

I hope I have helped and I am sorry you are running into this trouble..... contact that lawyer and tell him, I am sure he can get on the ball and get you that piece of paper.... someone can

No such Department as "Ethics Dept."

Brian, I was on the phone for 3 hours. The number you gave said they were "Customer Service". No one has ever heard of the Ethics Dept.
As usual, they can only pull my account number up. Said to CALL THE COPPEL, TEXAS OFFICE.

They are trying to Foreclose on us this Friday, Jan. 4, 2008.

They refuse to get anyone on the phone. Will not transfer me to the Legal Dept. The Loss Mitigation Dept. says to call the lawyer who is handling the Foreclosure. I have talked with him for two years.

He only got us a payoff quote, but due to Citifinancial having our Credit Report messed up and reported wrong, we have been unable to refinance, especially since the laws have changed and it is more difficult.

The letter sent to us from the Loss Mitigation Dept says they want to do an Adjustment of Terms, etc., but no one will talk with me in the Loss Mitigation Dept about this. The lady whose name is on the letter said she doesn't have any information in the computer for me and to call their lawyer.


We need a miracle.

You will have to call on wednesday....... if you have that number, perfect because that was where it was faxed, ethics line. They will be able to help you from there...... if you get a recorded message and you can leave one, do so...... hope you get some resolution.......

also, once resolved, you can contact another citifinancial branch and have them take possession of your account through the district manager (transfer).... as long as it is not in collections, or foreclosures etc.....

So I gave you that info, helped you out and you act as though I wrote nothing..... I told you they are trying to figure out who you are and the number you needed to call. I have been contacted again about your account for more information since we faxed your complaint to ethics and legal....... did you even read what I wrote? That is kinda what this is for, you file a report warning people, people support or explain what you can do in follow-ups....... this is an open forum. It appears as though I went out on a limb from across the country and it wasn't even acknowledged....

so here is my follow-up...... they are still trying to find you, do the thing I told you to do already so there may be some resolution, as of yet you haven't as confirmed by the phone call I received yesterday

I wanted to clarify a statement in my report. The Citifinancial office manager that took our homeowner's insurance checks from me was in the Clarksville, TN office. (He lied about our mortgage being in his office and transferred our mortgage to another office and refused to help or give me any information.)He said he didnot have a supervisor that I could talk to.

An assistant in the Clarksville, TN office was the one who tipped me off that he was trying to Foreclose on us.

The Coppell, Texas office is the one who has sent us letters for two years and every person we talk to who's name is on the letters always says the same thing, "they do not know anything about our mortgage and cannot give me a phone number to their legal department or anyone else who can help us." Yet their name is on the letter we have. Then they say"their computer is down and I'll have to call back".

They are trying to Foreclose on us again and refuse to give us any help in trying to resolve this situation.

Not to argue with anything you wrote but some things didn't jive. either way, we had this report faxed to our ethics department for further review, they called us back yesterday and asked for information on the customer, I had no info and wasn't able to aid them any further into investigating this matter. If I were you I would contact any other Citifinancial and ask for their customer service number, explain your problem and say that your problem was posted online for aid and an employee faxed it to the ethics line and the ethics line is trying to figure out who you are to actually help you. I believe the customer service number is 8009226235 8-6est M-F.
