I have had several problems with Citimortgage, and like other reports I have seen I would love to see them put out of business.
My problems all started with First Nationwide Mortgage, all was going fine up until I had a severe loss of income in August of 2001, after 3 months and not being able to replace this income I knew I was in deep financial trouble. I contacted First Nationwide to see if we could work something out to reduce payments until I was able to find new income, at that time I was approaching 90 days past due and was able to bring the loan current again. I was told that they could/would not offer any assistance until I was 120 days past due and that I should let the loan go to that point if I need to restructure things. Stupid me!!
I believed them and did not make the payment that day and waited another 30 + days to allow the loan to go to 120 days. What they did not tell me was that at the 120-day mark they would start foreclosure proceedings also. In the beginning of November 2001 I tried to contact the mortgage company to work out some sort of restructuring and could not get through, all lines busy call another time.
Finally got through to the mortgage company and went through Lisa, a CSR, who transferred me to a supervisor named Sharron Trone, who then transferred me to another supervisor named Latrinda who transferred me to her supervisor Nathan. Well I got nowhere with Nathan and asked for his supervisor, he refused to give me his supervisor and hung up. Called back again and asked directly for Nathan's supervisor and was put into a voice mailbox for Linda Rose.
December 10, 2001 contacted Mortgage Company once again and finally got a direct extension for Linda Rose by calling random number till I got someone to give me her direct extension. She stated that she would fax a Loss Mitigation package to me, which she did, and we returned via fax the same day. I was told that it would take up to 30 days for them to review, all along starting the foreclosure unbeknownst to me.
Saturday morning, January 5, 2002 I received Foreclosure papers. I contacted Linda Rose on January 7th and was told she told me that she did not see that anything had been done, re-faxed Loss Mitigation package and was told that it would take another 7-10 days at a minimum. Contacted a private attorney on January 8th who advised to put this to rest right now, contacted Linda Rose who put me in touch with her supervisor Karen Morton who worked out a workable solution. January 9th I received a fax confirmation of our phone conversation as requested from Karen Morton.
January 17th Called and left a message for Karen Morton to see what was holding up the agreement, again on the 21st. Finally got in touch with Karen Morton on the 22nd and received the agreement late that day. Asked about the legal fees they had on the agreement and received a response on January 24, signed and returned the Forbearance Agreement under protest of the legal fees and foreclosure on January 30th. Felt like I had no choice but to do what they wanted. The initial forbearance agreement was for 6 months and I was told that things would be re-evaluated at that time. During these six months I worked with a credit consulting service to try and manage my debt to an amount more in line with my current income.
In early July I received a letter stating that I had 10 days to pay $5884.67 or the forbearance agreement would be canceled, contacted Karen Morten and explained that in April of 2002 I chose to enter into bankruptcy after losing my last source of substantial income, but that I could now make the regular payment but any type of repayment would be very difficult at the present. The bankruptcy was filed July 15, 2001. July 22nd I received confirmation that the mortgage company had received official notice of the bankruptcy and that I should continue to make my regular payments.
This stopped First Nationwide from being able to peruse the foreclosure. During this time my family had to make a military PCS to Nebraska and we rented the home. In October of 2002 I came out of the chapter 7 bankruptcy and contacted Jeanne Hodgson who I had been working with during the previous forbearance period and explained to her that I was looking for work and if we could continue the way we were going that I could focus my efforts on finding reasonable employment, but if not that I would have to find what I could.
She was fine with this until I asked her about an appraiser telling my neighbor that I was going to lose the home to foreclosure. At that time she looked further into the computer and informed me that the Company had resumed foreclosure proceedings and the only way to stop it was to enter into another forbearance agreement now. If I had not asked about the appraiser I would not have known that they were continuing.
Even though the mortgage company had my current address, this information was not provided to the attorney handling the foreclosure so I did not receive a copy of the Motion for Summary Final Judgment that was filed, evidently according to the judge who denied my request to delay the proceeding so that I may retain an attorney to represent me it was my responsibility to notify the plaintiffs attorney not just the plaintiff, God forbid if our court system looks out for the little guy.
Unfortunately I could not retain an attorney in Florida to represent me on such short notice for the hearing on November 26th, which I lost and the sale of my home was set for 60 days later. Fortunately I was able to avoid the sale by entering into another Forbearance agreement to make full repayment, which I did.
Now you would think that this is where the story ends, well I thought it was all over when I made my final payment on the forbearance agreement a year early in November of 2003 during which time Citimortgage merged with First Nationwide. With the exception of the irritation of not being able to make my payments on-line as promised by Citimortgage's e-billing department and not receiving statements for my mortgage since the bankruptcy, which I did elect to stop when I signed up for the e-billing option, of course I don't get the statements on line either, all has been relatively smooth until today, August 26, 2004 when I look at my mortgage screen on Citimortgage's web page and see a current amount due of nearly $2500, my payment is a mere $655.
These are charges, I am explained to, that have not been paid from my Forbearance Agreement, the one that supposedly included all of this and I paid off a year early. Of course their attitude is that it is my problem not theirs. So here we go again, all I know is that I fulfilled the agreement I made with them, paid all the charges I was told I owed regardless of the fact that the foreclosure action should have never begun, well things are different now and I will fight them right to a final judgment on this.
