A Rip-off Report investigation has uncovered an unbelievable consumer ripoff being perpetrated upon owners and drivers of out-of-state vehicles by the City of Los Angeles, issuing parking citations to out-of-state vehicles by City of Los Angeles parking enforcers.

The Los Angeles Parking Enforcement Bureau reveals and acknowledges that parking enforcement practices by the City of Los Angeles, unlike other California cities, are flagrantly and knowingly in violation of California State Law.

Owners of vehicles bearing out-of-state license plates in Los Angeles should be put on notice. Because of this unlawful parking enforcement practice, the City of Los Angeles has granted unto itself a license to steal your out-of-state vehicle.

With the exception of rental cars, owners and drivers of out-of-state vehicles in Los Angeles which receive parking tickets in that City are not treated equally under the law. The fundamental legal requirement that a mailed notice be sent to a vehicle owner of any outstanding parking citation issued to their vehicle is deliberately ignored by the City of Los Angeles.

DRIVERS AND OWNERS OF VEHICLES WITH OUT-OFSTATE PLATES ARE HUNG OUT TO DRY.

California vehicle owners DO receive notices of outstanding parking citations by mail and are given the opportunity to pay an overlooked citation without any monetary penalty, or to contest the citation. However, owners and drivers of out-of-state vehicles in Los Angeles are denied the same legal rights and protection written into the law.

Particularly vulnerable are the thousands of out-of-state students enrolled at the many universities and colleges in and around Los Angeles. The students, as well as out-of-state businessmen and frequent out-of-state visitors from neighboring states, do contribute substantially to the Los Angeles economy, a fact which the City of Los Angeles chooses not to appreciate.. An out-of state vehicle is targeted game for the voracious parking vultures.

The California Vehicle Code does not distinguish between parking citations issued to California vehicles and parking citations issued to vehicles bearing out-of-state plates. Only the City of Los Angeles makes this distinction --- to the unmerciful financial detriment of drivers and owners of out-of-state vehicles.

The law states that if a parking citation isn't paid or contested within 21 calendar days from its issuance, the parking citation agency MUST mail or deliver a notice of delinquent parking violation to the registered owner of the vehicle. The registered owner then has 14 calendar days to either pay the fine, with no penalties attached, or contest the citation. (Logically, a vehicle owner not in control of the vehicle at the time, but in receipt of a notice of delinquent parking violation, would first come to some resolution with the authorized driver of his vehicle.) According to the law, the vehicle owner bears the ultimate responsibility for parking citation fines.

The sections of the Vehicle Code that follow the above hinge on that section and repeatedly make reference to that mailed notice of a delinquent parking violation to the registered owner of the vehicle a legal necessity and safeguard that Los Angeles does not follow for owners of cars with out-of-state plates.

WHY IS THE MAILED NOTICE SO IMPORTANT? WHAT ARE THE CONSEQUENCES?

The first consequence is this. If there is no response to a mailed citation from the vehicle owner within those 14 days, and the fine is not paid or contested, the fine is then automatically doubled. A $40 parking citation becomes $80, a $60 citation becomes $120, etc. An out-of-state vehicle owner who doesn't drive the vehicle of course is not aware of this because he hasn't been sent the legally required notice by the City of Los Angeles.

THE CONSEQUENCES THEN GET WORSE.

The state law says that five or more unpaid delinquent parking citations will result in the booting, towing and impoundment of the vehicle, but ONLY after five or more instruments of notification to the vehicle's owner have been timely sent and presumably ignored by the owner. But in the case of out-of-state vehicles, vehicle owners are NEVER notified by the City of Los Angeles.

Instead of ever notifying the vehicle owner, the multitude of brilliant City of Los Angeles parking enforcers then chase and track the out-of-state vehicle. When the hoped-for five unpaid parking citations (legitimate or not) have then accumulated ah hah! ZAP! The City's boot crew goes into action. They surreptitiously immobilize the legally parked vehicle, leave a notice on the windshield, and the driver or owner MUST pay the City DOUBLE fines for all five claimed citations within 72 hours. Remember, the ignorant out-of-state vehicle owner has never been notified.

TICKETS ISSUED, WARRANTED OR NOT, TRANSLATES TO DOLLARS AND JOB ADVANCEMENT.

According to a recent PBS documentary entitled Pain and Parking in Los Angeles, there are 200 of these unarmed booters employed by the City of Los Angeles who do nothing but disable privately owned vehicles citywide. Also, LA's Parking Enforcement and Parking Violations Bureaus are not affiliated with LAPD. The sole raison d'etre for all of these unarmed parking ticket issuers is citations, warranted or not, which translates to dollars and job advancement.

WHAT HAPPENS IF THE EXCESSIVE MONETARY DEMAND IS NOT PAID WITHIN 72 HOURS?

(The supposed negligent driver can't come up with the demanded cash without resorting to criminal activity, and the vehicle owner doesn't even know of the situation.)

ANSWER: The City of Los Angeles then steals the legally parked out-of-state vehicle.

Yes, still with no notification to the vehicle owner, still in violation of state law that requires that notification, the City of Los Angeles then tows the legally parked out-of-state vehicle to one of its impound lots. Real law enforcement uses terminology such as grand larceny, auto theft, extortion, blackmail, crime against property, etc. when such an action occurs in the private sector. Unlike the rest of the country, City of Los Angeles bureaucrats and politicians call it parking enforcement.

A further in-depth investigation of each of the parking citations supposedly issued to one out-of-state vehicle by the City of Los Angeles, revealed that a number of the citations were bogus, physical impossibilities, no doubt manufactured by zealous enforcers afraid of not meeting their quotas.

Los Angeles is not primarily interested in solving parking problems. Just or unjust, by hook or by crook, the parking enforcement objective by the City of Los Angeles is to maximize revenue -- for both itself and the private company with which it contracts for that purpose.

In spite of numerous complaints and lawsuits against the City, nothing has changed. Ultimately, the City of Los Angeles will be held liable.

IMS division of Lockheed Martin Corp. sold

Ripoffreport.com has recently learned that the IMS division of Lockheed Martin Corp. was sold in August 2001 for $825 million to Dallas-based AFFILIATED COMPUTER SERVICES, INC.



Since 1994 Lockheed Martin IMS Corp. has been the sole contractor with the City of Los Angeles as the city's Parking Violations Bureau, serving as the "processing agency" for Los Angeles parking citations. Lockheed's present 5-year contract with the City of Los Angeles expires on October 3, 2002.
