 I purchased a GMC truck in Jan 2015 from Classic Cadillac /GMC in Anniston Alabama.  Initially the Vehicle Service Contract (VSC, Extended Warranty) was added to the purchase price of vehicle, I decided to cancel this contract within my rights and within the legally allotted time of 30 Days. I called for a period of 6 days to cancel my VSC which totalled $5200, and found the Finance Mgr on vacation, with a client, unavailable, or out of the office. I had also left 4 voice-mails, I received zero return communications. I finally drove an hour back to the dealership only to be left sitting and told I could not cancel the VSC, even though I was within my 30 days. I asked to speak to the General Mgr and was told he was busy and unavailable with other clients. I again asked for the General Mgr or the owner of the dealership to discuss why the dealership was unable to cancel the VSC. The General Mgr did meet with me after a delay and instructed me that he, nor I, could not cancel my VSC as it was PART of the contract, which could not be altered. I expressed my displeasure and assured the MGR I knew the law and my rights and requested a letter from the GM stating that the VSC was unable to be cancelled with his signature. He then stated, I quote " you planned on F**** us this whole time" and continued to speak in a rude and arrogant manner.  At that point my patience had ended. He then informed I would have to come back again as the employee who could cancel the VSC, had already left for the day, and the staff required to perform that task does not work on weekends. I could not attain any signed letter or statement from the General Mgr in regards to any of the above, he said he would not sign anything and I would have to come back the following week. I also asked for a letter stating I was at-least at the dealership requesting a cancellation on Jan 26th, the General mgr stated he would not sign or provide that or sign documentation and that I was to return the following week. I can only speculate, but I believe this tactic was to delay my request until after the 30 day cancellation window, since I was nearing the end of my 30 day cancellation for a full VSC refund.

I returned the following week for a second time. I drove an hour back to Classic Cadillac, which was their next business day on Monday Jan 28th, 2015. I sat in the service waiting area for 45 minutes. The finance Mgr (Eric) then called me in and gave me a signed and dated VSC cancellation notice, dated Jan 28th. This time he was able to complete this without the office personnel that was required as stated above in my previous visit to the dealership. Today is May 15th, (Approx 100 days), my VSC contract has still not been cancelled according the the VSC provider Allstate Car Care. I spoke with the VSC provider Allstate again today and was informed that the contract had been cancelled on Jan 30th 2015, but another contract has been written and applied to my vehicle dated the same day Jan 30th, 2015. I have no idea what the second contract is or entitles, but it has a price of $5200 dollars also. In my opinion this dealership is committing fraud by cancelling the contract as requested and then applied another to which I had not agreed to or have any knowledge of. This second contract was applied to hold up any refunds in regards to my purchase.

The acct Mgr at Allstate tried to speak with the Finance Mgr at Classic Cadillac/GMC on my behalf, but she was informed he was on Vacation and unavailable. The Allstate Car Care provider called me back after a few days and informed me she has also been unable to contact the GM or the Finance mgr. I am still waiting for the VSC on my vehicle to be cancelled approx 105 days later, and the $5200 credited back to my loan balance. My largest concern is the second contract that was taken out in my name after the first one was cancelled on Jan 30th. I know nothing of the second contract that Allstate Car Care said was applied against my contract by the dealership and has been in a pending status for over 90 days.

There is no question that the dealership is in the wrong based on your post. They have gone overboard in stating that a replacement contract was written for the same date as the cancelation of your original contract. I think you need to bring in an attorney. It would be better for you if the dealership would respond to complaints, but it appears they play dirty. This is when you want to really send a message - providing a false contract after you cancelled the first one is beyond sleezy. I hope the judge not only gives you the $5200 but damages too. Good luck.
