Violation of the Anti Patient Dumping Act: 42 USC § 1395dd; Wrongful Death; Violation of Civil Rights under 42 USC 1983; The Civil Rights Act of 1964 and the Civil Rights Act of 1991.

PARTIES Zelda Trahan is the Mother of the deceased, Purpose Godlsmith. She is a natural person who resides in the State of Washington, County of King. The Estate of Purpose Goldsmith is the surviving entity of the deceased, Purpose Goldsmith. American Medical Response, Inc. (AMR) is a United States manager and provider of medical transportation. AMR provides emergency response and dispatch services, non-emergency transport services, air ambulance services, event medical services, managed transportation services (paratransit) and paramedic and EMT training. AMR is locally operated in 42 states and the District of Columbia. AMR employs nearly 17,000 paramedics, emergency medical technicians (EMTs), nurses, doctors and support staff.

Laidlaw acquired American Medical Response in 1997.  In 2004, Laidlaw sold EmCare and American Medical Response to Onex.

Onex formed Emergency Medical Services Corporation as the parent of its two acquisitions. EMSC went public in December of that year.In 2011, EMSC was acquired by Clayton, Dubilier & Rice.On June 12, 2013, EMSC changed names to Envision Healthcare Corporation.

 Clayton Dublier & Rice; American Medical Response; Emergency Medical Services Corporation; Envision Healthcare Corporation are sued for violation of the Anti Patient Dumping Act, for wrongful death and violation of the Civil

Rights Act of 1964 and 1991.

King County is a municipality located within the State of Washington. It is sued as an entity under 42 USC 1983 for denial of civil rights under the Civil Rights Act of 1964 and 1991 and for wrongful death.

King County Medic One is an organ of the king County Municipality. It is sued as part of the municipality for wrongful death, gross negligence, deliberate negligence, violation of the Civil Rights Act of 1964 and 1991 under 42 USC 1983 and medical malpractice.

Harborview Medical Center is sued under 42 USC 1983 for discrimination in violation of the Civil Rights Act of 1964 and 1991 and for wrongful death; medical malpractice,

EXHAUSTION

Claims were made to King County and processed and denied. This suit is filed in a timely manner within the framework of the Statute of Limitations.

Claim was made to the State of Washington in a timely manner and such was denied by the State.  This suit was filed in a timely manner after the denial of the claims and well within the three year statute of limitations period.

 

FACTS, CLAIMS & BACKGROUND

  1. On November 2010 at approximately Zelda Trahan left her two year old daughter, Purpose Goldsmith,  in the care of her then boyfriend, Ronald Wallace Jr. at 36202 21 PL S in Federal Way.  
  2. At 12:55 PM Ronald Wallace called 911 and was routed to 911 Dispatch when he reported that Purpose Goldsmith was irresponsive.
  3. 911 Dispatch contacted AMR and dispatched AMR to the scene for emergency medical treatment and transportation at 12:56..
  4. AMR did not show up at the location. AMR dumped the patient on Medic 8 of King County Medic One.
  5. By failing to show up at the scene AMR engaged in illegal patient dumping in violation of the Anti Patient Dumping Act; and engaged in discrimination against Purpose Goldsmith because of her perceived fiscal circumstances and because of her perceived race. By so doing, AMR did facilitate wrongful death of Purpose Goldsmith.
  6. Instead, eight minutes later, Medic 8 of King County Medic One arrived at 13:04. 
  7. According to Medic 8 of King County Medic One, they found the baby irresponsive and worked and stabilized Purpose Goldsmith and then decided to transport Purpose Goldsmith to Harborview Medical Center in Seattle from Federal Way a minimum of twenty-eight minutes by traffic; a total of 34 minutes in rush hour traffic on the freeway. By not taking Purpose Goldsmith to the nearest hospital and instead to the county facility, Medic 8 of King County Medic One engaged in patient dumping.
  8. In transporting Purpose Goldsmith to Harborview Medical Center when there were closer hospitals available for stabilization, Medic 8 of King County Medic One engaged in patient dumping based solely upon the belief that Purpose Goldsmith did not have insurance to pay for a private hospital.
  9. Medic 8 of King County Medic One committed medical malpractice in the following ways:  1. Medic 8 spent over 35 minutes at the scene when they knew or should have known that they required to either immediately transport Purpose Goldsmith to the nearest hospital or to call for an airlift of Purpose Goldsmith instead of spending the time on the ground and instead of traveling on the freeway in the middle of rush hour traffic 34 minutes to Harborview Medical. It must also be noted that the entirety of the written record regarding the treatment provided by Medic 8 of King County Medic One consists of one page in the record. By their acts of omissions Medic 8 of King County Medic One committed wrongful death upon the person of Purpose Goldsmith.
  10. Purpose Goldsmith arrived at Harborview Medical Center alive.  Harborview Medical Center intubated Purpose Goldsmith and conducted CPR for several minutes. Purpose Goldsmith died at Harborview Medical Center.
  11. Harborview Medical Center never engaged an expert in cardio-pulmonary resuscitation despite the fact that Harborview Medical Center was aware of the traumatic condition of the patient that was headed to the Center.  Upon arrival at Harborview Medical Center Purpose Goldsmith was entered into the general emergency room without any safeguards to protect her health and to preserve her life.   Harborview Medical Center did not have a cardiologist standing by; did not have an expert in CPR technology standing by.
  12. Conversationally, for Medic 8 to transport Purpose Goldsmith, especially given the time spent at the scene, it must be regarded that Medic 8 believed Purpose Goldsmith to be stabilized sufficiently for travel nd Purpose Goldsmith should have survived beyond reaching Harborview Medical Center.
  13. It should also be noted that in taking Purpose Goldsmith to Harborview Medical Center, Medic 8 passed up St. Francis Hospital in Federal Way which has a pediatric trauma wing; passed up Virginia Mason Federal Way which also has a pediatric wing, Auburn Regional which also has a pediatric wing, and sixty-six other hospitals in order to transport Purpose Goldsmith 34 minutes to Seattle.
  14. It is further claimed that King County has a policy of patient dumping in violation of the Anti Patient Dumping Act and uses Medic One to facilitate that illegal policy in that in cases where the person being assisted does not have ready proof of insurance they route the patient to the county facility instead of the nearest facility.

For these acts of omissions, the Plaintiff seeks a jury trial and an award of damages as follows: Against AMR 12,000,000; against Medic One 12,000,000 and against Harborview Medical 12,000,000.
