CMIW Claims Management Inc, Melba Ferguson Walmarts insurance provider is trying to SCREW me over an oil change Address in Kentucky, but they work in Arkansas???? Arkansas

Long story, semi short...Walmart did an oil change on my vehicle. They ended up leaving the old gasket on, after removing the oil filter, and placed new filter on top. This "double gasket" resulted in an oil leak, which eventually "busted" on the highway, spraying oil all over the bottom of my truck and causing the engine to lock up immediatey. I had car towed to dealership which relayed the info to me. 

I called up David, the auto manager at the Walmart I use, explained what happened and asked that he call delership to talk with Mike, my mechanic. He looks up my work order on the computer and says he will call immdeiately. SIX days later, the dealership calls and says they haven't heard from David, so I call him. He says, oh we called but got disconnected when they tried to transfer me. And he decides to never call them OR me, as he clearly felt the situation would disappear. 

2 days later I get notice that Walmart has come by to take pictures of the vehicle. One day after that, I get a VM from Melba Ferguson, the adjuster for CMIW. She laves message at 11:28, I return call and leave VM at 1:15. Skip ahead TWO WEEKS and despite more than 25 attempts by email and phone, she NEVER contacts me. On that afternoon, I file with Texas Department of Insurance, BBB, and Attorney General of Texas' office. Amazingly, she emails the NEXT morning. This is where it gets good...

She asks if I have a recipt or work order because they can't find one. I say, no, but David definitely found the work order when I was on the phone with him and read it to me. Then she says, "Well, it was entered into the computer but never pt through as completed." That's not my problem, I'm thinking. I ask her to look at the videotapes, which David said would be part of the process anyways. Keep in mind, he read the work order to me, is manager, and knows when the work was done from the computer. She claims that "the camera footage does not go back that far."

She says she is simply waiting for the pictures of my car to arrive before making a decision. First time she has talked to me in the 3 weeks my car was in the shop while I pay for rental cars and she does nothing. She takes ONE day, to send a denial letter stating, no eveidence was provided showing Walmarts negligence in my "alleged damages". I ask for what evidence does she need...she has a work order showing I got the workdone there, she has pictures showing my car covered in oil, with the oil filter that THEY put on top of old gasket, she has my car at the dealership, with a mechanics statement on what he found the cause and result of the leak to be. Iasked her again through email, what evidence do you need and now she ignores my messages.

She is defitely not going through the process fairly or timely. She is stalling and denying in order to save the King of retail a few bucks, rather than do the right thing and protect the customers which shop there and trust their services. 

Even if they did deny liability, she has shown this is a 2 day "process" yet it has stretched to a MONTH because of their inactivity, and now say they cant even pay for the difference in how long I SHOULD have needed my rental, vs. the time I actually had it. Total RIP OFF and bad faith insurance company.

 Wow, that's a LOT of all caps, you DEFINITELY got your point across, lol. You are an idiot and obviously an employee of one of them, since you seem to know all about their video storage practices. Why don't you tell them that CMIW is a subsidiary of Walmart and directly owned by them. Walmart is CMIW's ONLY client as an insurance company. The ONLY claims, that Claims Management Inc, handles, are WALMART'S! So yes, they are trying to save Walmart, a.k.a, THEMSELVES lots of money. Second reason you are a fool, the MANAGER of the shop admitted the tape was viewable over the phone and said he would review it. He was LOOKING at the work order at the moment and definitely knew the date. But again, you are making A VERY specific reference of 5-6 months. Why not 3 or 4? Why skip from 24 hours, up to 5-6 months..... Hmmmmm? And if you had any idea what happened to my truck you would know it's a problem that develops over time from PRESSURE! NOT necessarily 24 hours. Stupidest thing I've heard in a long time. THIRD example of your idiocracy...there weren't two gaskets "put on". You don't PUT ON gaskets during an oil change, you put on a FILTER. The OLD gasket was not removed with the OLD oil filter as it should have been and the NEW filter with NEW gasket ATTACHED was put on top. When these seals finally popped due to the pressure, it was like steam through a tea kettle but oil. VERY easy to verify they did the work, and not me, as you accuse, is the "technician's", not "certified mechanic's", initials ON the oil filter, but of course WALMART, I mean CMIW, TOOK the oil filter as "evidence". At least, so says the dealership. And FOURTH.. Like I said, I know the game. I KNOW I wouldn't pay on every claim either. I GET THAT. That will be settled later. What REALLY gets me, is AGAIN, this MELBA lady, can make her decision in TWO DAYS, but only AFTER she sits on her ARSE for 2 weeks without so much as the COURTESY of an email to a PERSON needing to get his vehicle back A.S.A.P. and not bleed money into a rental. She has NO information today that she didn't have 2 weeks ago. Again AFTER the manager also did NOTHING for a week. She could have denied and I could have gotten my truck fixed and back in a week But THANKS for your opinions Wally, they were humorous and very entertaining. I'm sure no one's personal life can be SO pitiful that they would comment on some RANDOM report on a Thursday afternoon, meer HOURS after I originally posted it, lol. I respect the opinion of someone who starts their conversation with "... and NO I'm not an...", like I trust a skinny chef, lol. See ya in court

 Actually the insurance company is NOT out to save wally world money, they are saving themselves money. ALL of the evidence provided only shows that walmart did the oil change and DOES NOT show negligence on their part. THAT is why your claim is being denied. The insurance company has NO PROOF OF WRONG DOING!!! Just because YOU SAY that the work walmart has done was shoddy and caused your vehicle to sieze up doesn't make it the truth. Insurance companies have to deal with a LOT of fraud. In THIS instance THEY are assuming that what YOU have claimed is fraudulent. For all they know YOU chose to take it home and didn't like the oil filter and changed it yourself and when the job fails, YOU turn around and blame walmarts work to get yourself a new engine. Im NOT saying that is what happened, but its what THEY have assumed. A insurance companys job is to NOT pay out. EVERYONE, EVERY COMPANY is in it to MAKE MONEY!!!! So if they can deny a claim based on a lack of evidence then they will do so. A insurance company is there to make THEIR shareholders money, NOT to give in to EVERY claim. YOU would have needed video proof of wrong doing. Such as actually videoing THEM putting two gaskets on the vehicle. They WILL NOT take the word of a third party that gains something from them saying your statement is true. YOU also have to factor in the amount of time from them changing your oil to when it supposedly blew out. If its past 24hours then there is no resolution for you. I would suggest that YOU learn how to do your own oil changes. This way the ONLY person to blame is yourself. Its SUPER easy to do, and it will save you money in the long run. No, I don't work for them or wallyworld. I HAVE however had to deal with insurance companies and I know and understand ALL of the tricks used to deny a claim. YOU want them to "Do the right thing" for YOU and NOT the situation. Im sure if you gave the situation MORE thought YOU would understand the WHY of it all. THEY cannot pay out on EVERY claim, and YOU wouldn't either if it was YOUR money. As a victim of course the FIRST thing you would say is "Yes I would" but we ALL KNOW BETTER!!! Im guessing that a good amount of time has passed since the work was done since walmart keeps security footage for over a month. Im guessing its been more like 5-6 months and a LOT can happen in that time. Sorry to hear of your misfortune but you CANNOT expect that YOU are going to get ANY money on the accusation of wrong doing with ZERO proof.
