Coby Electronics Refuses to honor 1 Yr Manufacturers Warranty Carson California

I  purchased 3 Kyros 7035 tablets Christmas 2012. 

Notified Coby USA Electronics in July 2013 that 2 of the 3 tablets were defective.  One would not load the operating system; I could not get beyond the start up screen.  In the other device the charging port became dislodged inside the unit, such that it would not attach/grip the charger once inserted to charge the device. 

Customer service reps stated these were common problems with the tablets and replacing them as part of the warranty should not be a problem.  Customer service rep sent me the following email:


For all Coby products customers must send in the following items to the address below:

1)      The defective product

2)      Proof of purchase (receipt); a copy is acceptable

3)      (if the unit is a netbook or tablet) money order for $15 made payable to Coby for return shipment($15.00 for each item if more than one).

4)      a letter regarding what is wrong with the unit, including customer Name, Address and Phone #.

Please be sure to safely package your product before shipping, preferably in the original packaging.  We recommend you insure the product and send it via a tracking method to verify the unit was delivered.  Coby is not responsible for damage or loss caused during shipment.  We are only asking for the tablet, so you may keep the accessories.

Please allow 4 to 6 weeks for the processing of your claim, (6 to 8 weeks from November to February).

I did exactly as instructed.  Within 6 weeks of shipping the devices back to Coby at an expense of over $30 I received a call from the shipper (UPS) stating that Coby refused acceptance of the package and that I needed to come pick it up.

This experience has been beyond frustrating, especially since I know havee 3 defective devices and am out of pocket the shipping expense, which was per the instruction of the customer service rep.  If anyone is aware of a class action law suit against Coby for its refusal to honor the manufacturers warranty please let me know.  Thanks.
