My fiance and I dropped off my car, 1994 Blue Saab 900S with a silver hood, at Cole Muffler on Genesee Street in Utica, NY on Friday evening 7/31/09, putting the keys in an envelope with name, phone # & cell phone on it in the mail slot into the garage for brake work.

We brought the brakes, almost $500.00, at a local auto parts store, had the parts delivered to Cole Muffler and have the delivery receipt. We couldn't pick up the car Saturday, when we went to pick up the car on Sunday,August 2, 2009 it was gone. We could not get ahold of the Cole Muffler staff as there was no emergency number listed on the building so we called the local police. The officer we spoke with felt the mechanics may have taken the vehicle somewhere overnight.

Monday morning we began making phone calls. Nothing could be learned and we filed a police report on my stolen vehicle. The Cole Muffler district manager was sympathetic at first, then the corporate office became involved and they are wondering why someone would take my 1994 Saab when there was a newer car with the keys in it in the same parking lot. Implications and innuendos began.

My car and its contents was removed from their property with out my permission and is gone, with no anticipation of any help from Cole Muffler.

That makes more sense. There are no laws here protecting vehicles. Every mechanic I've left my car at always leaves the car in a parking lot, no security whatsoever.

Many around here even encourage you to leave the keys in the vehicle when you drop the vehicle off. I was unaware of any different state law and retract my comment.

Here in NY, when an auto repair facility has your vehicle on their premises for repair, they are required to exercise "reasonable care" to prevent auto theft. This is a requirement established by NYS general business law.

This standard can be met in different ways. Normally, a locked 6 foot high chain link fence meets this requirment.

If the vehicle was left outside in an unsecure area with keys in it-the author of this report has a very good chance of recovering the loss from the establishment directly or vai a claim with the business's insurance company.

The author doesn't give enough information regarding the theft to offer a more substantive suggestion.

The author should make a claim directly to the business or the business's insurance underwriter. If the insurance company (or the business) denies the claim then the author should consult with an attorney to seek remedy in civil court.

What are they supposed to do?

Unless you can prove cole muffler stole your car, what do you expect out of them?

If you left your car at wal-mart while you shopped and it was stolen, would you go after wal-mart?

The biggest question is, did you sign anything saying the mechanic was released from any liability? if you did, then cole muffler is not responsible for your car. You need to keep with the police on finding the stolen vehicle.
