National Credit Solutions, Collection Agency, RIP-OFF - BREAKING THE LAW - RE-AGING OF ACCOUNTS, ATTEMPTING TO COLLECT DEBT 8+ YEARS OLD

Today, I checked my credit report recently and noticed that a deroagatory account was added to my credit report for something i do not remember. It was an account with Columbia House stating I owed $190 and they said in 2001 I signed up for free DVD movies. However, they reported to the 3 credit bureaus that this is an account from 2005 as the first date it became delinquent!

Can you believe that? They let you go 4 years without paying before they inform you an account is delinquent? 100% of all corporations and credit card companies today will put your account in delinquent status if you do not pay after 30 days, and close the account after 90 days. BUT what we are really talking about here, is this collection agency is actually breaking the law using a scheme called "RE-AGING OF ACCOUNTS" which is flat out illegal and against the law.

When i called National Credit Solutions and spoke to a lady this morning about this account, I was being very professional and nicely asked her to show me proof the account is mine, and that I was disputing the $190 amount and wanted an itemized list of how they came up with the $190 in charges, and whether this account was over the statute of limitations, which it clearly is. (IT IS THE LAW).

When i brought this information up, the lady that I was speaking to would start talking over me and not allow me to finish talking, and then she started yelling at me. As a consumer, we ALL have rights, and there are procedures and laws she MUST follow and provide me with the information that I requested. It is OUR god-given rights as a citizen of this great country! AND she chose to throw my rights out the window, tell me she does not care, and there is nothing i can do about it.

She flat out told me it does not matter how old this account is, that it is now on my credit report and will stay there until i pay this account. I hung up on her because she was the most unprofessional person that I have ever spoke to in my life, and I will never allow someone like this speak to me using scare tactics like that. I did get her to admit to me that this was an account from 2001.

But i have never made a payment, and i have never once received any letter, phone call, email, or communication with this company in the last 7 years, if i did, I would have paid the bill, if i did owe it.

THIS COMPANY IS CLEARLY IN VIOLATION OF FTC LAWS REGARDING RE-AGING ACCOUNTS. IT IS FLAT OUT ILLEGAL AND AGAINST THE LAW.

National Credit Solutions HAS CLEARLY violated the federal Fair Debt Collection Practices Act by reporting false, deceptive and misleading information about the plaintiff to the three national credit reporting agencies.

4. I am having my lawyer send them a letter and will sue them here in California. For them to even show up here, will costs them $2000 or more with what they have to pay their lawyers to show up.

BEWARE! Always check your credit reports. You can go to (((link redacted))) and you can check your reports online every day, each month and see what is going on. The collection agencies do this because they know they can get away with it, and they can re-age old accounts whenever they feel like it, because they are getting away with it.

But they are not getting away with this with me!

my mother in-law got a call for me from NCS with this number 1-877-864-6216, is this the same number calling you ?

if so it is a scam, i had my lawyer investigate the number and the first call was made from there office line and got a recording that the number was disconnected and then she triewd from her personal cell phone and it went through and got the greating typical collection recording but then she call the actual NCS toll free number and the recording was totaly different 

i have been going through these kind of calls for abour 6 years now and i can pretty much telll if they are scams or just plain inaprpriate collection agencies, first i seach on line for reports such as these on ripp of report to see whats being said then i started looking for free legal help but i now have my own lawyer because i am a victim of ID  theft 

some debts are legit but i did not create thenm so i do coroporate with them to get things resolved and a way to tell if they are scams is if you ask for all the debt information and they suggest you to pay by phone do not do that just tell them you are going to have your lawyer take a look into it and if they start to try to get you to settle with out your lawyer then more than likely they are just trying to scam you, 

there is all kinds of free legal help online that will investigat the call to determone weather the caller is a scammer, i iknow collection agencies are rude but they are just doing there job as another company hires them to retreive monies that are owed to them and it to me is understandable 

now i am not defendin NCS on here because i honestly do not even know if the company responding is the actual company i would asume they are because they are defending there selves as they do have that right 

all im suggesting is if you get calls like this and you are sure you do not owe have a lawyer investiget the call to see if they are the legit collection agency because if they are not then have a little fun and call them constantly anbd harese them i do it all the time you should hear some of the stuff i tell scammers it kinda amuses me ..lo

NCS is rude and unprofessional

I have told these peolpe to stop calling my cell phone for the past few months because they have the wrong person, however, I have encountered rude an unprofessionla behavior form the agents as well as the manager

(Toni Fisher). Now, I am going to sue them under the TCPA and get paid off of theier mistakes. This is the only way to stop this type of unprofessional harassment from these people. Its ashame that the same people who work for companies like this do not realize that the behavior they are perpetuating could very well come back to them from another debt collecting agency and subject them to the same treatment. Then I would like to see how they would feel about being harrassed and threatened in an unprofessional manner. As far as what the owener has to say, I say that he is full of it and he needs to train his people in professional ettiquette before allowing them to get on the phone with consumers in the first place. Unfortunately, this how people get hurt by instigating someone to a point of contention and anger. NCS needs to realize that they arenot above the law and that there are people out here who know how to handle their business and make them pay for what they are doing according to consumer protection laws!

4 years after Credit Solutions negotiated a settlement payment with Care Credit Dental they are sending me a bill as if we did not reach an agreement.

Now I know why my credit is bad.  Where has this bill been for 4 year?  Did Credit Solutions take the money and pocket it?  They "said" they were paying the bill.

Now I have to go through all my old records in storage to prove I do not owe this (now) $3,000 and I am worried that other bills are going to mysteriously appear 4 or more years after I settled through Credit Solutions, this is the address I found online 15601 Dallas Parkway, Suite 700,

These people are preying on people's fears

You make it sound like you're completely innocent of any wrong doing.  My sister had a medical bill turned over to collections and you people called her son, her sister, her friends, and employeer and told them she was under investigation for check fraud and that you needed to hear from her right away!!!!!  I was told that by the girl on the phone that she represented an attorney.   I was given a phone number and case number to pass along to her.  When I called the phone number back and asked the name of the lawyer she was representing I was hung up on.  When I called back again they just picked up the phone and hung it up again.  You told her son that if he didn't cooperate he too could go to jail.  Does this sound like legal collection tactics to you?  You people are the frauds, liars and low lifes that you accuse others of being.   If anybody wants to check it out for themselves call 1-888-265-1303 and ask them what attorney they represent.   DJ

These 'advocates' will not help you, they will not take your call.
NCS is simply in the business of collecting, not helping you, not improving your situaton.
If you want a bigger laugh...ask what "PROOF" would suffice for proving that the debt is not yours. The burden of proof is on NCS, they simply disregard this responsibility. As an ex-employee I was trained in these tactics.
Also, any indication by Bridget or from any representative of NCS that they will remove the debt, paid or not, from the credit bureaus IS SIMPLYA LIE! That is another example of the "collect or die" tactics they teach employees at NCS.

I am not "simply trying to convince you, the consumer, to pay NCS without regard for the truth."

I am a Marketing Representative for NCS what this means is that when I was hired I came in with the objective of improving communication with consumers, redesigning the NCS website, and bringing in new clients. ( If you are interested in what my job entails and my motives).

"NCS does not care if the debt is actually yours, they just want to collect. They do not get paid for helping you, only for taking your money."

I would like to explain why it doesn't work like this.

A business is a business. Let's think about what makes a business successful. If one collector breaks the law and harasses a consumer...what happens? The agency gets a lawsuit...loses money? Maybe the agency gets in big trouble, possibly closes down?

SO-- IS IT IN THE AGENCIES BEST INTEREST TO HARRASS CONSUMERS FOR MONEY? NO

Obviously there are tons of accounts with NCS and some of them are debts that people have simply not paid yet due to many possible scenarios others might be honost mistakes that should not have been passed down to an collections agency ( we do the best to weed those out, get them cleared up and closed if appropriate).

The only way that a collections agency can do well is if they maintain a trusting and as pleasant as possible relationship ( under the circumstances) with the debtor. If a collector can help explain the situation or help the person get to the bottom of it then that account is solved, case closed! If they argue and yell at eachother there is no benefit? All im trying to say here is that even though collecting might be un pleasant the collectors are normal people, they have compassion! They CAN NOT simply close the account because you say you don;t owe the money, BUT if you provide proof with your dispute, proving that the debt is not yours then yes, the account is immediatly closed.

I don't understand where you get the idea that the collectors are mean and heartless and that they target innocent people OR that they are trying to get innocent people's money? They are simply given a list! A list of people who the original creditor has said...these are the people who owe us money--this is thier information.

A business will go out of business if they have enough consumers who sign up for something and never pay.

BMG accounts are more complicated than usual cases because they are mail order. There are more cases of fraud.

NCS cares more than anything about thier relationship with consumers and thier reputation because those two things enable thier business to survive and thrive.

I am NCS's answer to all of the Marketing needs that have gone unfufilled. I would be more than happy to answer and questions,concerns, or complaints or to direct you to great sources of information.

Obviously dealing with a collections agency is not the most pleasant but it really doesn't have to be a bad experience. Lots of people are happy to work with NCS because many times you need someone to explain what is going on and someone to help walk you through the process. Some things that I can tell you from personal experience and from witnessing is that you will not be harassed. This is not legal and they actually are not even able to. Collectors are monitored not only by the law but by a managing staff that is on the floor every day all day. The collectors are trained and know exactly what they can and can't say and will not try and bully you. (Some are more polite/pleasant than others).

If NCS reports to your credit there are certain things you should do

1) Request validation (MUST BE WRITTEN REQUEST)
2) Talk to someone at NCS find out how much you owe. Why you owe it, ask questions they are there to help

IF YOU DON'T BELIEVE THAT YOU OWE THIS DEBT
1) File a dispute with NCS and submit any PROOF that you have

I know it can be frustrating and it is instinctive to point fingers but think about it. It is very unlikely that a company like BMG is just making up bogus accounts? These accounts require personal identification (if you have an overdue account with them, someone provided YOUR information in order to make the transactions)

NCS is also NOT out to get you. It is a streamlined process after an account is overdue for a long period of time it is passed down until it reaches an agency. An agency might receive hundreds or millions of accounts, some mistakes can be expected BUT most of these automatically are reported to the credit bureau. Your credit is a reflection of your financial up keeping. NCS is simply a middle man between you and the person/company that is saying that you owe them money. Their job is to collect what they can so that the issue is resolved by the best means possible for BOTH parties (this might mean payment in full, payment plan, settlement, or investigating the account and closing it) They are on your side, doing this for you so that your name can be crossed of the list of overdue accounts that the original creditor has (this is not a list you want to be on!)

Please, I worked for NCS and I can tell you that "Bridget" is simply trying to convince you, the consumer, to pay NCS without regard for the truth. NCS does not care if the debt is actually yours, they just want to collect. They do not get paid for helping you, only for taking your money.
NCS was in somewhat of a panic mode over all of these posts against them on this site and many others. They know that debts are often reported to the credit bureaus simply because of a matching name. No one gives their social security number to BMG. NCS does not care, again they just want to collect or they do not get paid.
"Bridget" is NCS's answer to all of your complaints, they use another name on other complaint boards but the posts are all the same. Notice that "Bridget" indicates payment in full as a way to get this collection removed from your credit bureau report. Reputable collection agencies do not have to offer "pay for delete" because they actually have proof that the consumer owes the debt.

whether it was you ordering from a company (like BMG) a long time ago and you just can't remember OR it was someone with your information ordering the merchandise EITHER WAY the order is under your name because of the information that was provided. If you submit a WRITTEN request for validation NCS will supply that to you no problem at all ( they have 30 days to get it to you)

You may or may not have been contacted by the original creditor for attempts to receive payment before they handed over the account to a 3rd party collections agency. It stinks to find something on your credit report without any warning HOWEVER once the account is handed down to a collections agency ( the last step)they have the right to report it to the Credit Bureau without notification (With the exceptions of 3 states).

NCS contacts the credit bureau ever Friday for updates. This is a lot faster than most agencies which makes the process easier and more convenient for you. After NCS receives contact from you or contacts you personally, 5 days from this initial contact you will receive a letter stating your rights and the amount owed. If they don't hear back from you it is assumed that you have received the notice.

After receiving this first notification from NCS you have 30 days to send in a formal written request for validation. After 30 days NCS is not legally obligated to send you a validation but may or may not as a common courtesy.

It is very important to resolve any issues with collections agencies in order to avoid increasing fees and to maintain a good credit score. Some people might say don't pay, reporting to your credit is just a bullying tactic. This is bad advice because the longer you wait to pay your debt the more fees build and your credit worsens. In extreme cases your credit card may be cancelled, you may be refused a loan or unable to make any serious purchases.

NCS acts as a middle man between consumers and original creditors. Regardless of what you say according to what NCS has on file you owe a certain amount of money. These files were not created by NCS so do not be upset with NCS they were handed down to them from another company. (these companies collect on these debts because a business must hold consumers accountable in order to STAY IN BUSINESS) If you can prove that this information is false then the account will be closed immediatly. Otherwise, it is plain and simple--you owe money and after a certain time when that money is not paid it eventually ends up on your credit report. This is no one's fault except your own? NCS is truly willing to work with you to see what is going on if you have a special circumstance. They will validate all debts, they will investigate an account for you, they will even work out a payment plan or settlement if you are struggling financially. They are all respectable, humane, people and if you talk to them civilly they can answer your questions and give you a good deal.

Bob,

You keep bringing up the rep being pregnant. That has NOTHING to do wit what the original complaint is saying. You want to tug at the heartstrings of humanity, then you better try people who haven't had their lives destroyed by your company.

I just had a $10,000 AMEX card canceled due to the fraudulent information you posted to my Experian credit report. And to add that was my ONLY credit card so now I have no credit which is going to also adversely affect my credit score. There goes the house we were going to buy next year. Thanks!

Before you go posting items on a person's credit report, maybe you should validate the information as accurate first instead of ruining people's lives. Yes, there is a validation and verification process. But how much do we have to lose in the meantime. I already lost my credit, my good interest rate for my mortgage, and potentially any jobs I try to get in which the employer checks my credit.

And we are supposed to care about some 20-something pregnant woman and her feelings? Maybe if she worked for a company which was a bit more ethical, then she wouldn't have to cry at her desk.

I just want everyone to keep this guy in perspective..... I am pretty sure he is the guy that refused to hold and was yelling and screaming when he got put on hold. We were in the middle of an ice storm that was later declared a disaster. When he finally got a hold of someone a day later it was a pregnant girl. I promise you, she will never be the same after what he told her.

Most people work for retailers and banks. When customers don't pay their bills your company can A. higher a collection agency or B. Fire an employee or two. Our industry has saved hundreds and thousands of jobs and pumped billions back into a failing economy. Collection agencies are sent thousands of accounts on a daily basis and after they are done removing the (20 something a day) bankruptcies they begin collection efforts. There is no way for a collection agency to know if fraud has been committed against a consumer. The FDCPA allows the consumer to send in writing a Dispute. The collection agency is then forced to close the account or validate it. I know people get upset when they find something strange on the credit bureau. It's sad that someone has committed this crime that is now affecting the consumer. We have a department that handles these on a case by case basis and sometimes we can prove fraud and close the account.

The person who wrote the report against us may have actually called our company and threaten bodily harm to a worker that is currently pregnant. She was crying on the phone trying to get him/her to mail in his/her dispute. He/she began to cuss and yell at this young lady. He/she was so upset with our company and our employee that he forgot to get upset that someone had stolen his/her identity. Needless to say the pregnant girl is fine and I hope that anyone else that calls will treat the employees with courtesy. Remember, that you can write in a dispute. This company is getting what they have coming...

This week this company showed up on my clean credit report after we just moved into our 1st home. I spoke to a Oklahoma City process server and she told me that their office is comprised of a bunch of 20 something brats that are underpaid and basically told to lie, cheat and do what they can to scare consumers into paying. Long story short, I have a claim suit for $5000 in place for them (already served court summons) to appear in Wyoming court to adress 4 counts of FCRA and 4 counts of FDCPA violations along with collection badgering, refusal to valdate, failure to furnish a dunning letter, illegal collection actions (cursing, threatening to garnish wages without a court order, and more...).

Capital Assistance Group is the internal company for BMG music INC that they are working with on a 2004 debt that is not mine. Funny thing is that Capital AG contacted me Friday very apologetic and said they were sending out a fraud affidavit for me to fill out and to get it closed and removed from my credit reports (after NCS was served...hmmmm). I told him that I would look over the emailed affidavit once sent and send it back if it was reasonable. No affidavit yet. I told him I am still pressing charges in claim court against NCS. They are scared and have to show up Feb 9th at 1:30pm in Wyoming to present their case. We're all set. We have a copy of the FCRA and FDCPA along with factual information in regards to this company to show the judge on a alleged $208 dollar debt.

After we win this, we are pressing federal court charges up to $10,000 against both companies each. We will use the money to pay any debts (pay of my car and some credit cards) to be fully debt free. So don't give up. We are about to nail them hard. I then will most likely make a trip to OK City to see the shithole myself sometime. I am opening up a website dedicated to slamming bad collection companies. I will post soon about this. Stay strong.

You have to remember that COLLECTION AGENCIES report based on the client's information. If a client states that the last activity date of an account is 2005, that is what the collection agency uses. We trust that our client's information is true and correct. Our office provides verification and validation of each debt we have in our office. We just do what we are asked and with all the bad debt in the world, it is true that their is fraud. This is not the agencies fault. The agency will send an initial letter allowing the debtor to claim fraud. At that time the agency can close the account or do an investigation. Consumers are always blaming the agency for something bad being done to them by someone else. The agency is the tangible target. You shouldn't think the person who put the faulty tires on your car is a RIPOFF, you should hold the tire manufacturer accountable. We close accounts as fraud or unverifiable everyday with people who follow the federal laws for dispute. Please, dispute your claim to our office in writing and we will investigate or close.
