in april of 2005 i received my first phone call from collins law office. they claimed to be a collection agency trying in collect a debt of 3200.00 from a credit card company. they told me they were going to take me to court if i did not pay. i told them to go ahead because i did not know anything about this debt. on june 3, 2005 i heard from them again. i told them that they needed to send me some information via us postal service so i could investigate this claim myself.

since then they have been harassing me just about everyday by phone. i have stopped answering but this is getting to be too much. these people are crazy. they have told me they would only accept payment by phone, they have threatened to sue me and they have even accused me of being a criminal. at his point i realized that these people are scam artist. someone needs to further investigate this collins law office.

I also received a phone message today from Legal Assistant Jennifer Searne (sp?) from 'Attorney Tom Collins Law Office'. In her message, Jennifer said they sent me a letter approximately 30 days ago (which I never received)in which I am stated as a primary defendant. She stated that either myself or my attorney should call them back regarding this important matter, and stated a case number. The callback # she left was 1-800-798-5675, ext. 31.

Now, I have no idea what this could be about other than an old debt that I had about 10 years ago, which resulted in a chargeoff, which resulted in 7 years of bad credit. What can I say- I was 18 years old and irresponsible. Times have changed and I now have excellent credit. I first had to endure 7 plus years of credit hell in order for my credit to recover and to develop the good credit that I have now.

DO NOT let these scum buckets try to intimidate you. DO NOT give them any of your personal information over the telephone such as your social security number or address. If they supposedly sent you a letter, then you should have received it, especially if it was of a legal nature. If they were able to track you down via phone number, why wouldn't they be able to track you down via your current address? Also, if you were being sued, wouldn't you be served a subpoena in person? These people are stupid. They prey off people who may not have a lot of knowledge of the law and try to scare them into paying debts that are past the statute of limitations.

Good thing I am going to school to study law myself!

You can find some information about them on budhibbs.com. They are associated with Lenahan Law Firm, one of the scummiest of the scum junk debt buyers-pretending-to-be-lawyers. They prey on people's fear and ignorance of their rights.

As stated before, send them a "cease and desist", and also demand that they validate (prove) the debt..they can't. Make them put up or shut up..you will enjoy the quiet that comes from it.

Send Them A Validation Request and a Cease & Desist

You need to send this agency a letter, certified mail, return receipt requested, demanding that they validate the debt, including any paperwork signed by you proving that it is in fact your debt. Tell them they are NOT to contact you by telephone and give them 30 days to provide actual proof. In the meantime, check you state laws and see if collection agencies have to be licensed in your state and, if so, if this agency is licensed. If they are not, report them to the FTC and the Attorney General's office. If you do a search on google regarding collection agencies and state laws, you can find great information on how to legally deal with this type of situation. If they continue to call you after you have proof they received your letter you may be able to sue them in small claims court for continuing to bother you. Good luck.
