On 7/23/09 I responded to a free trial offer for Acai Berry Detox which redirected me to another free offer of Colon Cleanse 3000. I agreed to pay nominal shipping for both free trials.


On 8/19/09 I received the trial offer of Colon Cleanse. As of today, 8/20/09, no Acai Berry Detox has arrived by mail. The trial of Colon Cleanse arrived yesterday, 8/19/09.


Since having prior problems with this and related companies, I checked my Chase Master Card account for recent activity. There was a charge of $83.95 from Colo-Flush Trial.com. I called my Master Card dispute department and began calling Colon Cleanse (800-244-9504). Representative #1 suspended the monthly charges and informed me that I had authorized the initial charge of $83.95 to my account. I asked him to prove it. He said he would send it in an email. No email arrived so I called back.


Representative #2, Sarah, told me that she would email the terms to me. It arrived. Within the fine print it states, "You will have 14 full days from today to evaluate and decide if you wish to keep the remaining 30 day supply and continue receiving Colon Cleanse 3000." I read an ambiguity in that language and called back.


Representative #3, a male, took this call. I asked him what constituted an evaluation. He was unsure of what I was asking. I asked him what I would be evaluating during the fourteen (14) day evaluation period. He replied, "The product." I asked to speak with a supervisor and was placed on hold. After several minutes I was told by Rep #3 that a supervisor would call me back.


The product sample was mailed on August 4, 2009. Why it took from that date to August 19, 2009 to reach me I do not know. However, if I pushed the button on the computer on 7/23/09 (according to their records) and I had 14 full days to evaluate "the product," I would not have had time to do so. If transit time for the package was four days, it would have arrived four days late for compliance. Even at a two day transit time, it would have arrived on day 14 (August 20, 09) past the Internet transaction. Supposition: Today, 8/20/09, given a two day transit time with arrival on the 6th of August, would mark the 14th full day to evaluate "the product." I called today and was told that they would not cancel the $83.95 charge to my account.


A supervisor has not called me back. According to their representative, I am in compliance, having contacted Colon Cleanse 3000 within the full 14 day period of time allotted
