My husband and i paid down and recieved a 1999 mobile home(in 1999 ). Major mistake , because 3 months later we seperated and I gave him all rights to the mobile home . They would not remove my name from the papers and he decided he did'nt want to stay there a year later , so he gave the mobile home to my daughter to take up payments .

Conseco / greentree still would'nt take my name off the papers and my daughter fell into hard times and now they are behind on payments and the phone calls have stated . Conseco / greentree has called me a great deal of times ( even though its been 3 years since i've been living in the mobile home ) and telling me that i need to get them out because they are fed up with the bull s_____. well in the first place I tried to get conseco / greentree to put the mobile home in there name , with no avail .

Times are hard and they should work with people , but instead they want to greedy and mean . they have no right calling and being so rude to me or anyone else .

If they want to be such hatefull people then maybe they should try doing their family that way or have it done to them . My daughter has three kids all under 8 years old and they want to put them out in the streets , maybe we should send them to iraq ?

To many rude , hatefull ,and cold people !

Greetree Loans Just say NO in UTAH!

Just letting you know these people are ruthless our Manufactured Home park is going under and closing most are financed though Greetree .About 75 of the 160 families ask for Loan intervention and they refused So they will be takeing a lot of homes away from the elderly and they will be homless in March of 2007

You would think Greetree would help them with just the cost of the move like low or no intrest tack it on to the loan and continue to get payments.I guess people in there 80's are not important to greetree or so it seems. So sad here.

Technically... Legally they don't have to remove your name or your husband's name from the contract.

Legally they don't have to remove your name or your husband's name from the contract. Legally, you and your ex are liable for that contract with Conseco. As the owner, you and your husband are responsible for the payments even though your daughter does live there.

I feel for you because I know what it is like to help family and get screwed. You cannot throw your daughter and your grandchildren out on the street. The only choices you have is to pay them or let them have the doublewide or try and work with your ex to get the payments in. You half and he half. If that doesn't work, then it is repo.

My husband cosigned with Conseco and we are screwed. The only way we can get out of the contract is if they break the contract in anyway (home is already in repo) by performing illegal acts or we declare bankruptcy.

One thing that you have going for you though is this. Legally they cannot evict you or your daughter unless they hire themselves an attorney and go through the local judge and get an writ of repossession. At that time, they are required to serve you or your tenants with an eviction notice and then she has 30 days to get out. Once that processs occurs though and the property becomes fully repossessed by judgment of writ, then you cannot move back in and take over the home until you pay in full the outstanding balance of the principle plus legal fees.

The thing that is happening right now is a lot of harrassment. Conseco tries to bully people out of their homes by trying to force an eviction in order that they can assume possession of the property without an executive writ. There are only two ways Conseco can legally obtain possession of your home. One if you voluntarily abandon it and two, if they obtain it through executive writ. If they go through the legal process, they have to wait for approval from a judge before they can put your home on the market and then they have to get reasonable value. If they force your daughter out of the home and force abandonment of the property, they can turn around and resell your home within hours without any protest from you. In addition, often they will find some buyer whom they can talk into taking over your loan and they might even keep your loan on the books in case the new owner defaults.

If it were me, I couldn't throw out my daughter. I would tell my daughter what is going on, get mine and her phone number changed to unlisted and then force them to evict her through executive writ. That way, she will have 30 days after the eviction notice to find her a place to live.
