I bought and financed my mobile home with Conseco in May 1999. The following year, due to health problems, I had to move out of my home and move in with a friend. With Conseco's approval, I found a tenant to move into my mobile home. My tenant could not afford to pay me the full amount of my mortgage payment; only about 2/3 of it. I paid the rest, so I was not making any money off of this deal.

I have been late with Conseco and I always let them know when to expect my payment. In June, 2002, I went in and paid half of my payment two days early and told them that the rest of June's payment would be made by July 1st. I was told in person that this would be notated on my account and that it was not a problem.

On June 28, Conseco called my tenant, Sherry. They told her that I was consistently late and that if a payment was not made by the following day, they would repossess the home by July 3rd. They also gave her my account number and my social security number telling her that if she needed to work anything out with them, she could just call them and have all my information handy. Sherry asked them how did they get her phone number and they told her that I gave it to them and that they have no other phone number or address for me. That is not true since they send my monthly statement to my address every month.

I was out of town due to business and Sherry tried to contact me. When she couldn't reach me, she went down to Conseco herself and asked them how much they needed to prevent them from coming to repossess the home on July 3. They told her they needed June's insurance payment of $31.00!!!!!

When I got home, I had a message from Sherry, but none from Conseco. I called my tenant back and she informed me that she was moving out of the home and that I needed to come and get my home. (my home is on her property) She also did not pay the July rental payment, so therefore, I cannot pay Conseco. Sherry told me that her mom doesn't want her involved in this and that she is helping her get another mobile home. I am not upset with Sherry because Conseco scared her out of her wits thinking they were coming to get the home!! Sherry is willing to make a statement about them giving her my personal information.

I don't know what to do. Because of $31.00, Conseco has caused me to lose a tenant and my home will probably be repossessed since I cannot afford to move it and I can't afford to live in it. I would put it up for sale, but for what Conseco wants for it, I doubt anyone would be interested.
