Conshohocken Health & Fitness (CHFC)/ Tony Dougherty continued to charge my credit card for over $100 after the conclusion of my contract and refused to reimburse me for over $100 in unauthorized charges. 

Tony insisted that the agreement I signed allowed him to continue charging me at the monthly rate at the expiration of my first year.  After reviewing more carefully, the contract was very misleading.  Probably intentionally.

(a) the sales rep never mentioned anything about the agreement automatically converting to month to month, and stated that it would not when specifically questioned.

(b) the language Tony referred to was in the Monthly contract section and did not appear to apply to my annual agreement.  It stated that 60 days notice must be given, and that notice could not be given until the conclusion of 12 months membership (so was I signing a 14 month contract?).

(c) in speaking with Tony, it was apparent that his intent was to grab a few bucks on the way out the door.  Judging by the growing complaints in www.bbb.org, I'm not the first and won't be the last.

Beware this gym, treat the purchasing process like you're buying a used car in a shady part of town.  If you choose to join, review your contract carefully.  If you intend to sign an annual agreement, strike anything pertaining to monthly rates, automatic renewal, 60 days notice, etc.  Even if you don't think it's necessary.  Tony behaved unscrupulously with me, he will with you, too. 

There are other neighborhood gyms in the area.  Shop around before you get ripped off at Tony Dougherty's gym.

There is absolutely no unauthorized charges to any members accounts. It is clearly stated that after the term of the agreement the contract goes monthly until the consumer cancels the agreement. It seems to me this past member did not cancel there membership after the 12 month term. The member could have given notice not to go monthly at any time during the 12 month term. It is not a 14 month contract, as I honor any members request to cancel with a 60 day notice. All agreements go monthly after the term of the contract.

The terms of each members agreement is explained at the time the member purchases a membership. As far as not reimbursing this member, I would not because they did not follow the guidelines of the agreement and cancel the membership. It would not be reasonable or fair to the many members who have the same contract as this member. There are many members who follow the guidelines of the agreement without incident.

My rates are fair and my business practices are fair. Of course, there are times when members are not happy, but the majority of my members, roughly (2500), seem to believe my gym is a professional environment. There is absolutely nothing shady about my business. Complaints! Sure that is going to happen in "any" business, but I work hard to solve any member dispute professionally. This ex-member believes it easier to trash my business on-line than to speak to me face to face. I would love the opportunity to speak to this person to resolve what they feel is misleading.
