Cookd Sales & Portable Buildings UNETHICAL PRACTICES Atlanta Georgia

Please do not ever use or think of entering into a contract or any type of binding agreement with Cook Sales aka, Cook Warehouse and Portable Buildings.  I am having a horrible time with them since I entered into a contract in 2011 for the purchase of a portable building.  They are unscrupulous and know they have you over a barrell so they take every advantage of their customers.  If you ever have the misfortune of being late, (Beware), they charge outrageous late fees.  On a 92.00 monthly payment they charge $35.00 if you are more than 10 days delinquent.  When a pickup person arrived today at my home.  I had not received any type notice of pickup nor had I received a delinquency notification, he just appeared with intent to seize my portable building.  I explained to him I had just made a payment and he asked what month am I past due I state "only one month".  He proceed to call in to Cook Sales, and when he got a representative on the phone, she told him her computers were down and could not pull up my account.  So he ask when did she think the computer would be back on she said perhaps 30 to 45 mins.  So he told me he would leave and come back afterward.  I told him I would go inside an call them to try to get the matter resolved. 

When I called I go someone instantly and she was able to view my account within seconds of him leaving my premises.  She was very, very rude and rambled off protocol about contract "things which I was already fully aware of".  She told me I needed to pay 2 payments plus any accrued late fees along with driver pickup charge of $240.75.  I told the Cook representative that I had made a pymt. of $100.00, could she deduct that payment, she said no she could not.  So I had to make a pymnt of $185.02 (reflects two reg. months)  late fee of 102.00 plus a driver fee of $240.75.  Total submitted to cooks today $507.00, NOW mind you I was only one month past due December 30th payment which has a grace periord until 1/9/14. 

Today is 1/15/14.  My monthly payment is only $92.51 per month.  I would have understood if she told me I owe $92.51 plus $35.00 ridicoulos late fee.   I told her "Mamn I have not received a notice from Cook regarding delinquency AND nothing regarding pickup schedule.  She told me because I made a payment in December, it must have kicked the notice out.  "You should have known your payment was late" she replied.  I stated, yes mamn, I am aware of the status of my account which is why I made a payment as soon as I possible could, but reminded her that I did not received a "notice of delinquency or in particular a "notice of Pickup".  She said it was my responsibility to make sure that the pickup man did not have to come.  I tried to explain my hardships, but she was cold hearted and non-understanding.  I told her I have been a customer for more than 3 years and that should in itself show my intent to pay my indebtedness to them.  At any rate I wish someone could please look into Cook Sales business practices and file a Class Action Law Suit I am sure the attorney who handle the case would be rewarded handsomely for his efforts.
