Fairbanks Capital Corporation! What a SCAM! This is the most unprofessional company we've ever dealt with in our lives. They hold the 2nd mortgage on our home - what A NIGHTMARE! It all started Day 1.

No statements.....we'd send our check....it wouldn't be processed for up to 15 days once it was CASHED!!! (we started sending them certified, but they STILL didn't process them correctly) - then the late fees would be added!

THEN, so-called "drive by" assessments, because "your loan is 20 days past-due", which would cost another $150 for which the requested documentation was NEVER sent.

Yeah, right, you drove by my house and assessed it?

Here's a classic.....we were charged $250 for an "interior assessment". I asked how could someone possibly have assessed the interior of my home wihtout my knowledge? Fairbanks answer "they looked in your windows"!!!!!! CAN YOU STAND IT??!!!

Somehow, incredibly and according to Fairbanks, our homeowner's insurance expired (another classic because....the premiums were current and PAID for) but Fairbanks went ahead and added additional charges for insurance (WHY?! we already had the appropriate coverage!)THEN, payments were returned with a note stating they "weren't in the proper amount" because Fairbanks had applied our regular monthly payment TO THE LATE FEES, INSURANCE, and "OTHER CHARGES"!!!!!

And then of course, we get foreclosure notices because "we're not paying our montly payment"!!!!

Ridiculous!!!!! and FRUSTRATING!!!! We can never get a straight answer or any documentation from this company.

They said we were in default and started foreclosure proceedings, to stop this we paid what THEY said we owed, even though we filed a dispute with the customer advocate department -from whom we NEVER HEARD A WORD or any response to our REPEATED written requests for balance history, payment application, etc.

SURPRISED? Don't be.....According to our records, we've OVERPAID Fairbanks $3000 TO DATE!!! This company is driving us crazy! HELP HELP HELP!!!

the Attorney General with your "inside" information or not but I think it would be worth a try. There are many of us that have been fighting FBs for a long time and have had no luck in getting an inside person. Even though you only did drive by inspections, it could be an important piece in the overall puzzle. Give a thought, it may make you feel better if nothing else. God Bless.

Witch Hunt .. Every appraiser in PA should know that drive-bys are illegal

Greg, I am fully aware of which "witches", as you call them, to hunt in Pennsylvania. First, and foremost, RRReview, Inc. (Fairbanks Capital) is located in Pennsylvania. Second, Every appraiser in PA should know that drive-bys are illegal. Third, if a BPO is ordered, the fee is not $150, 250, or even $300, nor should 3 be conducted in one week. Fourth, have you not read the NEW YORK TIMES article on the Poconos? Our homes are over-appraised by thousands of dollars. This is not a one in ten statistic, this is every single home. Why? The Appraisers are in the palms of the powers that be. Believe me, I am on a hunt, but not for witches - they don't steal people's homes, lives and future. I am on a hunt for theiving, lying racketeers, and I know wherein they dwell!

I was a property inspector

I thought you might like to know about property inspectors. I was approached and offered to do property inspections by a company named Mercury Mortgage. One of the companies we did inspections for was Fairbanks, another Olympus. I had no experience and was told only that the job was to go by the houses to see if there were still occupied, sometimes contact owners to give them a note the Mtg. co. wanted to talk to them and to report the condition of the house. I was never to look in the windows (I wouldn't have anyway). I was given a list, told to drive by and fill out the papers. I had to use my own car, pay my own expences, including gas and taxes and made a whopping $3.00 per inspection and if asked for photos a whole $ . 50 for them. I often had to drive 200-400 miles per day.

There is no appraisal, not by anyone qualified anyway. I did this job for about 6 mo. I heard story after story and went home and cried often.

I also Ironically the very first inspection I had was from Olympus...on MY house! Olympus was bad, but I Thanked God I didn't have Fairbanks....a couple months went by and lo and behold I got sold to them! I knew what I was in for and there was no way to stop it.

I am still fighting, I have a complaint on here too. During this job I was promised I would make good money doing the clean-ups and winterizations ... never happened, the creep I worked for gave me all the $3 work and his nephew the money jobs. I ended up losing a lot of money and to make matters worse Mercury Mtg. made me BEG for my checks, which they paid once a month, knowing if I didn't make the payment my mtg. company threatened to take my house!It got to where I had to cry in order to get him to send my check. Thought he was just getting his kicks screwing with my life but now I wonder if he was in on it with Fairbanks?

I was threatened and yelled at by a couple of victims, even when I was trying to tell them I was going through the same thing.

I didn't realize what these inspections really were and esxpect the inspectors you deal with also don't know. I think instead of being angry at them it would be better to talk to them and show them what you are being charged and let them compare it to what they make.

I noticed 75% of the homes I inspected for Fairbanks resulted in the owners leaving within 6 months, near that much for Olympus. I am sorry for having upset anyone, I did my best not to because I knew exactly how they felt...I was in the same boat. My inside knowledge can help when it comes to this...no way should they be charging what they do, sometimes I would have 2-3 inspections on the same house in the same day or same week. I thought it was a mistake but now would guess it was their way of stealing more money.

I am expecting to be on the street in the next month or two, cause I can't keep fighting either. I also files BK...then they added another $800 to my already overcharged account for a BK attorney! My $28,500 loan is now well over $36,000 after paying over $7000 last year alone. In Oct. they began refusing my payments so they can say I am not paying.

YOUR POST IS SO MUCH LIKE MY EXPERIENCE WITH THIS BLOOD-SUCKING COMPANY IT GAVE ME GOOSEBUMPS. A LITTLE MORE THAN 3 YEARS AGO MY NIGHTMARE WITH FAIRBANKS (HOW IRONIC IS THAT NAME??) BEGAN.. RIGHT AFTER MY MORTGAGE COMPANY WENT BANKRUPT AND SOLD THE "SERVICING" RIGHTS TO FAIRBANKS.

I HAVE BEEN CHARGED ALL OF THE LATE FEES, DRIVE BY FEES, BOGUS APPRAISAL FEES ... AND MORE.. I HAVE BEEN THREATENED WITH FORECLOSURE.... I TOOK EVERYTHING I HAD IN MY RETIREMENT ACCOUNT FOR A COUPLE OF YEARS TO KEEP THESE PEOPLE AWAY. WHEN THAT RAN OUT I FILED CHAPTER 13 BANKRUPTCY.. MY ATTORNEY AND THE BANKRUPTCY TRUSTEE IN MY AREA OF GEORGIA JUST DON'T GET IT.... THEY LOOK AT ME LIKE I HAVE LOST MY MIND...

SO AFTER THREE YEARS OF LIVING IN A NIGHTMARE... A YEAR AND A HALF OF HAVING JUST ABOUT MY WHOLE CHECK SENT TO THE BANKRUPTCY COURT... I QUIT... I GIVE UP... IF FAIRBANKS WANTS THIS HOUSE SO BAD.. THEY ARE CERTAINLY GOING TO GET IT... I JUST DON'T HAVE THE FIGHT LEFT IN ME ANYMORE...

I'M 51 YEARS OLD AND I FEEL LIKE I AM 100 YEARS OLD... THE ONLY THING IN LIFE THAT MEANS THAT MUCH TO ME IS MY FAMILY AND MY FRIENDS.... IN ANOTHER 100 YEARS .

THIS LITTLE HOVEL THAT FAIRBANKS WANTS SO BAD PROBABLY WON'T EVEN BE STANDING... LIFE, FAMILY AND FRIENDS ARE SO MUCH MORE IMPORTANT THAN A STRUCTURE MADE OF STICKS, NAILS AND SOMETIMES BRICKS.... I AM SO READY TO FORGET ABOUT FAIRBANKS CAPITAL AND ENJOY THE TIME THAT I HAVE LEFT ON THIS EARTH.... GOOD LUCK... YOU WILL CERTAINLY NEED IT WITH THIS CROOKED BUNCH.... I THINK THEY'RE UNTOUCHABLE..... THREE YEARS IS ENOUGH...

How would you know soooo much about the way this company practices its trade unless you had something to do with them. I'll bet you get paid a pretty penny to do drive by appraisals and peeking through homeowners windows so that Fairbanks can charge an outrageous fee to the hard working homeowners just so they can blow up the payments they already make. I too have had this done to my home as well as these people trying to file abandonment papers on us while we were still in forclosure but,thanks to the courts paperwork was filed on they to stop this crazy order and Fairbanks verbally backed out.So Greg maybe you need to look into this company further before you go blowing your mouth.

Well for one it not the appraisers fault

Yes you can do drive by appraisals in most states and the term drive by means exterior appraisal you are required by law to still to get out view all sides of the property, take exterior photos. measure the exterior. There is another valuation service that that is called a Brokers price opinion. Which is more commonly done on foreclosed homes and homes going through foreclosure, it is a compulation of similar homes that are listed for sale and have sold. Also Fairbanks uses indepent fee appraisers and real estate brokers. These appraisers and brokers are the same people you go to chruch and out to eat with.They are trying to give a fair market value to the subject homes they appraise. Also most state laws are pretty hard on appraisers. Now, I cannot speak intelligently about your state but I do know the laws in Indiana. So before you go witch hunting figure out which witches you are after.

I like the idea of everyone gathering at a major news station on the same day. They would have to make news then. Just when they saw the sheer numbers. Give me date, time, location, and I'm there. I'd much rather spend my money doing that than throwing it into the black hole that is Fairbanks!

Some places to check into seeing if they can help you with this.

If they are sending you fradulent bills through the mail maybe the postal service will get involved that way.

This sounds like its wide spread interstate fraud and I would think that would be something for the U.S. Attorney Generals office to handle if the they wont look into it on a state level.

You all could make a concerted effort to write letters to arrive at abc news on the same day or week with your stories concerning fairbanks.

If you are active duty military and are deployed you may be entitled to some extra protection from the government from folks like this while deployed.

If you have a govt gauranteed mortgage through something like the va, hud,fha etc check with them and see what they have to say about this company.

Contact your district attorney and ask them what you can do and who you need to to be talking to on a state level and who in the state should be keeping track of these types of complaints in your state. Find out what they are required to provied to you in the way of paper work.

Find out what the laws are in your state regarding home apprasials. How many can they do per year? What is the legal definition of an in home appraisal.

Maybe even flooding the sect of HUD with letters of complaints about this might get some attention. You just need to schedule it so everyones letters arrive in a certain window of time to make the maximum amount of impact.

Drive-By Appraisals

Regarding your "drive-by" appraisals - this is ILLEGAL in Pennsylvania. I also assume the appraisal was done by RRReview - owned by/a subsidiary of Fairbanks. Contact an attorney immediately.

Also, contact the State Attorney General's Office, and the Bureau of Licensing. You are also entitled to a copy of the "appraisal" if the fees for the same have been applied to your account (i.e. - you paid for it - which I'm sure you did). However, don't hold your breath waiting for the appraisal - you won't receive it.

Also, please note that the "appraiser" who did this drive-by stands to lose his/her license. Good Luck!
