First of all, we got sucked into one of the loans that the government now says can't be done - No DOC, No ratio, Stated Income, all rolled into one - 80/20 split -3 year Interest Only ARM 7.75% with a second mortgage of 15 years FIXED with a balloon payment and at a rate of 13.625%. Second, I lost my main support of income in April.

We immediately called Countrywide, just to be told, "Don't worry, we don't want your home, we want you to stay in it and we will help you get through this" YEAH RIGHT....I was unable to make a payment at all in July, I called Countrywide to see what we could do about it...."We can't help you until you are at least three months behind." Do not send in 1/2 payments, if you can't send in the entire payment don't send anything because the monies will not be credited to your account they will be put into a holding account.

Needless to say, I have been trying to "Workout" things with Countrywide since August. I have now gotten back on my feet and able to pay, but I am repeatedly told, "DO NOT SEND IN A PAYMENT UNTIL YOU SPEAK WITH A NEGOTIATOR". FINE....a negotiator denied our modification, because she didn't like the way my husband's paycheck looked - he's the only employee and his check is written on a company check - but not a fancy check with all the breakdowns and withholdings listed - then I was told to provide a profit/loss statement because I am a subcontractor - NOT a business -the only difference is I have to pay my taxes at the end of the year.

I explained this - and was told by a representative by the name of Melissa (and I will be nice and not put a last name) - "JUST TYPE SOMETHING UP FOR US TO SHOW OUR INVESTORS, DOESN'T HAVE TO BE FANCY".....YEAH, now let's just type whatever we want and give to whoever, I could say anything on something like that - doesn't that kinda go along the lines of MORTGAGE FRAUD - just type anything up???

Then another representative Jessica - -who I gave a wonderful "rating" with her supervisor -- tells me she has the paperwork, 3 copies of a loan modification - I need to sign two copies and send it back with the requested information. She said it would be sent to me within the next 15 days via FED EX. I would need to send back copies of checks, copies of bank statements and copies of a hardship letter, this was on October 8, 2007 - I've been waiting for the paperwork to show up so I could send back the "modification contract" along with the required information and a payment via cashier's check/money order.

Needless to say, on October 22, 2007, Dennis - the negotiator - calls me back and tells me that my loan isn't seasoned and I need to wait to ask for assistance...but in the same breath..."If you wait until the loan is seasoned...your house could be in foreclosure"....HELLOOOOO...I've been trying for what 3 MONTHS to figure something out, to be able to take care of this problem, make my payments just to be told to hold them until this negotiator/end all - person calls......and then his remarks are "I've got the final say, I have the right to accept or deny......and I deny it." And the only thing that Dennis can say - "I'M SORRY FOR THE MISCOMMUNICATIONS" - YEAH I BET YOU ARE.....

I in turn called Corporate to file a complaint against Dennis and his attitude and explained to her the situation - "Hold on let me get you someone in that department" - I held for 10 minutes and the rep comes back with "I'm having a hard time locating Dennis, I can't seem to transfer him to you at this time" HELLLOO..I'm filing a complaint against him and you are transferring me to him...oh Yeah, that makes perfect sense...

I had to explain the entire situation again, names/dates/conversations, etc...and by the end she stated "Don't send in the payment, WAIT until you hear back from Countrywide and NO do not type up anything as far as profit and loss, that's FRAUD because we can't verify anything". SO YOU TELL ME, IF COUNTRYWIDE DOESN'T WANT MY HOME/PROPERTY, THEN WHY WON'T THEY TAKE MY PAYMENTS???

I HONESTLY HOPE NO ONE ELSE IS GOING THROUGH THE SAME FLIPPING THING WITH THIS COMPANY, BECAUSE OBVIOUSLY THEY CAN DO WHAT THEY WANT, WHEN THEY WANT, AND HOW THEY WANT....THERE IS NO ONE TO MAKE THEM STOP...

Let's be real

I am a victim of Countrywide, same scenerio, paid lots of money to keep my house and currently struggling to get out of the hole Countrywide has put me in. I sent my check to be deposited into my account with Countrywide only for it to be returned to me. Yes, my check was returned to me. I was trying to make a payment only for them to turn around and send it back to me. Countrywide's reason was because I was behind 1 house payment in November 2005. I have not missed any payments. I have proof.

I went to my daughter-in-laws bank and even they could not figure out how Countrywide is operating. I also was told by Countrywide not to make any payments in January 2007 that my house was in foreclosure and when I went ahead and sent a check = Countrywide returned my check. Countrywide owes so many people their hard earned money back, it isn't funny. Emotionally drained.

Same thing is happening to me. They promise help. They tell the news people that they are setting aside money for modifications. But so far, we all get denied. I just got denied two days ago. Now, its foreclosure for me. Countrywide needs to be investigated for fraud. Something is going on.

I am very sorry that you are going through this, I know very well that it can be very stressful. When you talk to ANYONE at Countrywide make sure you write down the date the time the duration of the call and the name of the person that you talk to.

Call countrywide and ask them to fax you a complete list of all your payments and your current balance. Keep ALL you receipts from your payments if you use a check or Western Union, whatever, just make sure you keep EVERYTHING! Keep all of the letters that they send to you also, that is your proof of communication. They actually sold my home and we found out 5 days later! We made our payments, through a supposed "Work out" but they NEVER sent the paperwork, the same paperwork you are waiting for. She told me it would be overnighted, and we got it 52 days later.

If you have time call them and tell them to fax you a copy of the workout agreement, and sign it and fax it back, once they accept it, and you send your first payment to them, which to them is like sealing the deal, and if they accept it, that is there way of saying that they are in agreement to you and that postpones all the foreclosure actions. (I hate to say that but that is about what t comes down to). The papers basically save face for you and also in the court.

READ ALL THE PRINT IN THE WORK OUT PAPERS! ALWAYS SEND PAYMENTS! By law they can not reject the payments! Get a lawyer now and get ready for a fight. They do want your home and they will buy it for more than what you owe and then screw you on getting it back! Trust me we are not alone.

Send your payments!

Customer service reps are pretty much idiots, they work off a "script" and leave it to other departments to "fix" their ignorant errors!

Your payments will go into suspense until a full payment can be made and applied to your account, if you submit your payment make sure it is a check so you have a copy of them cashing it-that will show effort on your part to keep your loan in good standing-they cannot reject your payment-it may not be applied right away depending on what you are in arrears for but they MUST apply it somewhere-if you have been advanced funds for taxes or insurance be aware that is where your money will be applied first!

If by some idiot move on their part they return your check to you...then file a complaint!
