Attempted to refinance mortgage thru Countrywide. Talked to a rep, went thru application, part of which included giving debit card #, which I was told would not be charged.

Appraiser was sent out, who returned new appraisal $5000 less than last year.

Loan was rejected, referred to Full Spectrum lending, my debit card charged, and rep disappeared, his phone extension suddenly didn't exist, no one knew who he was. I am now facing foreclosure, going to try a deed in lieu of foreclosure. We will see how that works (if they cooperate), using a housing counselor from Colorado State, or will hire Legal counsel if necessary. Will report back

Dear fellow victims of foreclosure fraud,
Please be very cautious of handing your deed over to ANY mortgage company "in lieu" of a debt they "allege" you owe!!! Before you act under duress, make them PROVE the debt.

It's called "Validation", under Fair Debt collection Practices Act they must validate if you request it in writing. If you hand them the deed you have little or no recourse afterward. Did anyone ask and get in writing whether your credit would be repaired? Will you be able to purchase another home? Will you get any of the equity? Don't be too hasty, possession is 9/10 of the law.

Please be extremely cautious of dealing with any mortgage company that has already shown signs of fraudulent and misleading practices, they didn't change overnight. It's another form of manipulation, a psychological "head game" used regularly by these corporate monsters.

They know the game and how to play it. They also know the law and "bank" on the fact that most consumers don't! If you know you have been a victim, and the foreclosure is wrong, then don't hand over your deed! You will lose any equity you could get if you sold your house yourself. They have already robbed you of your joy, don't give them everything else you are entitled to! What benefit will YOU get out of handing over the deed?

You have a redemption period, usually 3-6 months AFTER the foreclosure "sale", if you sell it during that time you get the equity instead of them. At least you will have a chance to recoup some of your losses, if you hand them the deed you'll probably get nothing. Ask questions, get names and dates!

Notify the mortgage company you are staying in your house or they will claim it has been "abandoned" and take possession in as little as 30 days.

Go on your state's government website and check the foreclosure laws and redemption periods for your state, make sure you have been advised ACCURATELY, properly notified, served, and all proceedings were done by law.

If you find out or suspect that it was not done properly then they do not have the right to take your home. File complaints with Federal Trade Commission and your state's Attorney General.

Find a lawyer who specializes in contract law.You would be amazed how many contracts aren't worth the paper they are written on! A contract is a legitimate meeting of the minds. Did you ever agree in advance to an unforeseeable event like this? If it has an unfair advantage over the consumer it can be a violation of Federal Law.
