C.R. England LIED,

I was employed through CRE until 1/16/2008. When I terminated my employment with CRE, I was asked to turn my truck in at the designated facility in Irving ,Tx.
I did so as instructed and began seeking employment with other companies. During the process , I had two separate companies inform me, that CRE, had posted on my DAC report that I had abandoned my equipment. This allegation is completely false.

The whole negative experience began when I received a new DM (Renee Smith) on or about 10/01/2007. Nothing ever came out right with her. She would send me load assignments, that would not give me enough time to pick up the load. She then would give me a service failure for her failure. She would tell me, that I was going to get detention or layover pay, only received it once. Company still owes me $615.00 for layover and reimbursement fees. The reimbursement fees are now going to be withheld since they are lying about me apparently abandoning my equipment.

I cannot get anyone on the phone, or to return messages I have left trying to resolve this issue directly through the company. I even sent a message on the qualcomm to my DM to prove I had dropped the truck off. If I am not mistaken , these message stay in the system for a lengthy period of time. They know they are wrong and they will not acknowledge there fault in this process. This is defamation of character in my book. Any company, I now apply to, will see this on my DAC and red flags start flying around the room. I know I am not the only driver this has ever happened to, but I have no idea of what I can do to resolve this issue.

If anyone has any solution to this problem , please let me know..

here is how i handled england

i was also employed by england with all the bs that comes with there lease here is how i handled them i was home my dispatcher quit and left me hanging so they gave me this dork for a dispatcher so i fired him before he could dispatch me so i fought with england over the email for like three days NEVER ON THE PHONE got to make sure you have proof so i did all this bickering with them so they terminated me leases with them so they then said they reinstated them for me which we all know is bs so i then told them to terminate the lease so they send me a email of that accord that i requested that my leases be terminated i then made england come remove there truck and trailer from my property with the little insentive that if they did not i would have there trucked towed off my property and have it impounded and heres how i kept my dac clear

1 do it all on e mail or qualcomm take pic of qualcomm or call them (qualcomm) with your unit number ip address and get them to send you copys but digtial photos work well too always ask for dispute resolution for outside they will 99% of the time try to weasel there way out of it and thats where you got them for violating there own contract.

2 e mail your ic advocate inform them that as soon as they terminated your leases you are no longer aurthorized to operate there equipment and come get it

3 save all your pictures and emails as i still have everything just in case they want to try to be slicker possuim sh*t you have proof of what happened

4 apply for other companys and let them know that you had a ruff time with england so that it does not surprise them when they get there response and most compays will be happy to tell you if your up front

dont take no sh** from them morons in salt lake i handled them just like it says here if they

Dear Sir,
There are a couple of options that you may have to use in your defense.
1.if you took a picture of the qualcom statement ,you can pass that forward to Josh England he is in charge of the lease dept.
2.you are right in the fact qualcom stores this information,you will need to get a lawyer to get a court order to release them.This can be easily achieved in defamation of character suit.All you will need is truck co.,truck number,approximate date and time,to get the information.
3.Like i said there's good news,heres the bad during orientation they clearly specify that you must turn in your truck to the cre terminal in salt lake city to be considered as a legitimate termination,otherwise it will be considered abandonment and subject to recovery fees(up to $500 a day).The only way to beat that is to have either a recorded statement in which you were directed to turn it in elsewhere or documented proof ,such as the qualcom conversation.
4.Unfortunately theres another issue you will be facing.Look at your credit report they have filed against you with them saying you owe thousands of dollars.These charges will consist of: 1 recovery fees,
2 fixed costs occurred while truck was not in salt lake,your payments continue till it reaches salt lake,and there is no rush to recover.
3 repairs (any and all repairs needed to bring the truck back up to there specifications are billed back to you.with out pictures and the turn in inspection sheet,they are free to do and say what ever they want here. new tires ,breaks ,body damage, interior damage are all good possibilities and can reach thousands of dollars)
4 any money left owed to them such as fuel costs,auto advances ,etc.

BE PREPARED TO FIGHT YOUR REPUTATION ISN'T THE ONLY THING AT RISK YOUR FINANCIAL FUTURE IS AT RISK GET A LAWYER IMMEDIATELY!!!!!

I also worked for cr england and everything they told me seems to be a lie. Just quit about 2 weeks ago. the utah labor comm. told me that they can't hold my last check. But I also leased and have money in reserve and I probably will not get that until 45 days! If ever. Our miles were never correct. Just a thought I don't know if they owe you or not.
