No delivery and no refund from CrateFurniture.com and CEO Mark McCracken!

I ordered replacement cushions way back in June 1997 and my credit card was immediately charged for 390.00. I kept getting the shipping date pushed back again, again, and again; until finally there was nobody answering the phone at CrateFurniture.com (only an answering machine). It was way too late to get my money back from my credit card company.

I sent CrateFurniture.com a notice of cancellation on November 7th, along with some data from the FTC regarding the Mail or Telephone Order Merchandise Rule (if merchant is unable to ship within the promised time, it must notify me by mail, telephone, or email, give a revised shipping date and give you the chance to cancel for a full refund). I received a telephone message saying my order had been cancelled. But I received no refund...

On January 3rd, 2008, I received a letter from Mark McCracken apologizing for the delivery problem (apparently due to a mill closing), and a promise that I would receive my refund and I would be given updates regarding my situation.

That letter was FIVE MONTHS AGO, and I have received NO UPDATES and NO REFUND. Letters to CrateFurniture.com asking for an expedited refund go unanswered. It has been a year now, that CrateFurniture has had my money and I have NOTHING in return!!

Virginia Attorney General Bob McDonnell filed a lawsuit against McCracken's company this week alleging it had failed to ship more than 100 orders to callers in the promised time frame.

Consumer losses exceed $80,000, a McDonnell statement said.

"Given the serious nature of the complaints received about HomeSpun Home Fashions, legal action must be taken to provide relief to affected consumers," McDonnell said.

An Internet search of the company's name turns up complaints against the company at various consumer Web sites.

But more significantly, the Virginia Office of Consumer Affairs has received 118 complaints against HomeSpun, including 10 in the past month, McDonnell said.

The Better Business Bureau has given the company an unsatisfactory rating because of 183 complaints in a recent three-year period, he said.

The suit in Petersburg Circuit Court calls for injunctive relief, consumer refunds and civil penalties."

Wow Mr. McCracken is also "suprised" about charges and says "what really hurts is people thinking I am underhanded". Right. All those mean, bad people "harassing" you in order to try and get either the product they ordered over a year ago, or a refund. But you just ignored them. Like the scores of people who posted on this site.

I never got my refund (although some people who placed orders after me got theirs: his "customers will get refunds in the order they placed them was just one of his many lies).

McCracken shouldn't be producing furniture, he should be producing license plates, if you know what I mean...

I accidently typed 1997 as the original date of my order with CrateFurniture.com, but it was actually 2007.
