I am being garnished by CAC for the second time in two years for a judgement from 2008. The first time June 2013, I went to court and explained to them that I know I owed them something, but not the amount they were asking for. I gave them my new address and requested an "accounting" of my account. Car was repo'd and sold, I only owed 1 year on the auto, about 5700.00 they are suing me for 7800.00. The judge gave them 30 days to reply, still a year later, I have not gotten a reply from them. They never contacted me to come to court when they 1st went. They had an address from about 10 years ago. They knew where I worked, and they still made no effort to contact me.
Now here we are in June 2014, I get another garnishment from them for the same thing. Mind you they did get about 760.00 from the first garnishment, but I never got the "accounting" that I requested.
At this time, I am going again to file for the courts to dismiss this action, I feel as though I have been more than violated. I am aware that it is my right to ask for an accounting since the car was sold after they took it.
I know they sold the car for what is was probably worth, it was in great condition, low milage and clean (just had it detailed)
They are trying to get over like "fat rats"...hopefully the courts will see where they are just crooks and dismiss this stupid judgement
These debt collectors need to be held accountable for their illegal actions. If you are trying to collect a debt, be fair and give the person a chance to dispute or settle the debt. I was not given either.

I was never notified to go to court to dispute the claim. They never contacted me after they repo'd the car. When I called them, I was told the car was sold and they would send me the balance that was owed. They never did this.
The next thing I got (from my employer) was the garnishment notification. I went and filed to stop the garnishment, to try and get things straightened out with them and asked for an accounting of the claim..what I had paid, what the car sold for and what was due...I never received anything, everything was documented in court. I had agreed to make payments after they send me the information, I never got anything, now a year later---here they come again
GIVE ME A BREAK!!!! I am willing to settle with them, but I don't think I should have to settle for them to make a profit..paying them more than what was owed after sale at the auction.
I didnt leave anything out...My wife was a Debt collector for a bank, they did things fair, notified people and worked with them, CAC is full of it!!! They just want FREE MONEY from people who are already struggling

Here's the sequence of events...This deadbeat lender gets shafted regularly by serial deadbeats...people who don't pay their bills on time. They do a repo. The car is sold at auction. The money they get from that sale is applied to the total amount the serial deadbeat owes. This "total amount" includes the contracted amount of the loan (price of the car plus interest) extra interest generated because of the deadbeat's late payments, repo and storage fees. No lender can simply garnish someone's wages WITHOUT filing suit in court. The deadbeat usually loses and the garnishment begins and the serial deadbeat is notified by the court a judgement has been entered against them.
I have a feeling you are leaving alot out of this story. Bottom line is no lender is under any obligation to help me, you or anyone else. If we need advice, there are plenty of places to get it. The lender is not a charity, nor your mother, pastor, finacial counselor or friend. No, I don't work for them.
